On 7/2/2009, the Division of Water Quality received your request to rescind you coverage under Certificate of Coverage
Number NCG020632. In accordance with your request, Certificate of Coverage Number NCG020632 is rescinded
effective immediately.
Operating a treatment facility, discharging wastewater or discharging specific types of Stormwater to waters of the Slate
without valid coverage under an NPDLS permit will subject the responsible party to a civil penalty of up to $25,000 per
day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished
permit coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires
permit coverage, you shouICI notify this office —immediately. Furthermore, if in the future you wish to again discharge to
the State's surface waters, you must first apply for and receive a new NPDES permit.
If the facility is in the process of being sold, you will be performing a public service if you would inform the new or
prospective owners of their potential need for NPDES permit coverage.

In 2004 you were issued coverage under the Mining NPDES stormwater general permit. This permit was renewed in early
2005 by the Division of Water Quality (DWQ) and we are forwarding herewith the reissued stormwater general permit. Please
review the new permit to familiarize yourself with the changes in the reissued permit. The general permit authorizes
discharges of stormwater and some types of wastewater. You must meet the provisions of the permit for the types of
discharges present at your facility. This permit is reissued pursuant to the requirements of North Carolina General Statute
143-215.1 and the Memorandum of Agreement between the state of North Carolina and the U.S. Environmental Protection
Agency, dated December 6, 1983.
The following information is included with your permit package:
• A new Certificate of Coverage
• A copy of General Stormwater Permit NCG020000
• A copy of a Technical Bulletin for the general permit
• Five copies of Discharge Monitoring Report (DMR) Forms - wastewater and stormwater

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require modification
or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal requirements to obtain other
permits which may be required by DENR or relieve the permittee from responsibility for compliance with any other applicable
federal, state, or local law, rule, standard, ordinance, order, judgment, or decree.

I spoke this morning with Ricky Revels in the Fayetteville regional office of the Division of Water
Quality. Ricky asked me about the status of your permit application at the request of, I believe,
Wesley Anderson, of Anderson Engineering & Associates. There seems to be some confusion over the
status, which would be understandable, since it has been awhile since I spoke with you.
My notes indicate the following.
a) Our office received your permit application on October 12, 2003.
b) I sent a letter to you, with a copy to Anderson Engineering, on November 10, 2003, noting that
I needed the mining permit in order to continue processing your stormwater application.
Unfortunately, your letter was returned undelivered, on December 8, 2003, because of a faulty
address. I believe that the copy to Mr. Anderson was delivered successfully. I have attached a
copy of that letter.
c) I left voice messages for both you and Mr. Anderson on December 1, 2003 inquiring about the
status of your mining permit.
d) On December 30, 2003 you and I spoke on the phone about the status of your mining permit.
At that time you expressed the hope that you would receive the mining permit in the first week
in January.
e) On January 30, 2004, we spoke again, and you still hoped that the mining permit would be
issued soon.
f) On February 23, 2004, I spoke with Floyd Williams in the Division of Land Resources about the
schedule for your mining permit. He indicated that it was not ready, and that his group still had
some issues to work out before they could issue the mining permit.
I hope this clears up any confusion about the delay at my end on the stormwater permit. Please call
me if I can help in any way.
