Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit is against federal and state laws and could result in fines. A copy of the Compliance Inspection Report is enclosed for your review. Mr. David McKeown, Regional Environmental Manager and John Williford, Production Supervisor, were also present during the inspection and their time and assistance is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES General Permit NCG020000 under Certificate of Coverage NCG020548. Permit coverage authorizes the discharge of stormwater and/or process wastewater from the facility to receiving waters designated as an unnamed tributary to Goulds Fork, a Class C waters in the Yadkin -Pee Dee River Basin. As a result of the inspection, the facility was found to not be in compliance with the conditions of the NCG020000 permit. Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the inspection. Please be advised that violations of the NPDES General Permit are subject to a civil penalty assessment of up to $25,000 per day for each violation. The mines have been inactive over several years (since 2009) and were recently reactivated with the utilization of a stockpile. The Stormwater Pollution Prevention Plan (SPPP) was reviewed. The most recent SPPP was developed in 2013. The SPPP needs to be annually updated, including a list of significant spills over the last 3 years, employee training and certification that the outfalls have been evaluated for the presence of non-stormwater discharges. Please refer to General Permit NCG020000 for the additional required information. The site map also needs to be modified to include the information stipulated in the General Permit. It appears that the active stock pile is shown in an incorrect location on the site map. All Best Management Practices (BMP's)have not been regulary inspected and will need to be inspected once per week. This information will need to be documented as well as any related repairs of the BMP's. Qualitative and Analytical Monitoring has not been conducted at the site and will need to be initiated semi-annually for stormwater and quarterly for wastewater. If there is no discharge from the outfalls, this needs to be documented on the two Discharge Monitoring Forms which cover any stormwater discharges as well as any mine/dewatering wastewater discharges. The outfalls for Basins #16 and #17 were observed in the field with no issues noted. The remaining outfalls shown on the Mine Map are not developed yet and will be installed in the future. This site is located about 35 miles east of the Monroe Brick facility which utilizes clay from the Howell Mine. There are no employees located at the Howell Mine except when mining contractors re -build the stockpile once or twice a year. There has been no activity at this site in years due to the current market for brick. During the first 6-month period-2010, there were instances when there were no discharges, and there may have been some instances when there were discharges, but sampling personnel were working at another Hanson site. There were rain events occurring on Saturdays which makes it extremely difficult to meet the 48-hour holding times for Setteable Solids and Turbidity. Also, warm weather storms are often accompanied by lightning, and it's too dangerous to collect samples. When the new NCG020000 was recently issued, Hanson revised the SWPP Plans and thought its present sampling program would be adequate enough to collect the samples at all its locations. As it became apparent that we were having trouble sampling a discharge, the rain events started to decrease further, and there was little time to utilize consultants. Hanson regrets it was not able to collect samples at Outfall SDO-17 and realizes there are consequences stated in the first footnote under Section B, Table 1 of the permit: "triggers monthly monitoring". Do to the sudden issuance of the newly implemented NCG020000 General Permit, we request the Department allow Hanson the opportunity to successfully sample once during the current, 2no 6-month period, 2010.
