In accordance with your request, Certificate of Coverage Number NCG020461 is rescinded effective immediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished permii coverage when, in fact, continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit -coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the Slate's surface waters, you must first apply for and receive a new NPDES permit. Box 190 Lumberton, NC 28359 Dear Mr. Hunt: Division of Land Resources RE: Notice of Deficiency, Forks Pit Permit Number: 78-40 Robeson County, North Carolina River Basin: Lumber On 5/7/2009, an inspection of the subject mine was performed by Eric Matuszewski of this office. Deficiencies were observed that require your prompt attention. The deficiency(ies) discovered and the necessary corrective action(s) is/are as follows: Operating Condition #4B Mining activities, including the installation and maintenance of the approved sediment traps and associated temporary diversions, shall be conducted as indicated on the mine maps received by the Land Quality Section on July 26, 2004 and August 06, 2004 and supplemental information received by the Land Quality Section on April 21, 2004 with the stipulation that a minimum four foot long weir section shall be installed in the sediment traps. The four sediment traps located in the mine have not been installed as per the mining map. Because of the improper installation, sediment has entered the storm drain pipes and has drained directly into a watercourse. (OC#I IA) No on -site disposal of refuse or other solid waste that is generated outside of the mining permit area shall be allowed within the boundaries of the mining permit area unless authorization to conduct said disposal has first been obtained from both the Division of Waste Management and the Land Quality Section, Department of Environment and Natural Resources. The method of disposal shall be consistent with the approved reclamation plan. Offsite refuse has been dumped in the boundaries of the permitted mine area. 3. (Reclamation Condition 44) Reclamation shall be conducted simultaneously with mining to the extent feasible. In any event, reclamation shall be initiated as soon as feasible after completion or termination of mining of any mine segment under permit. Final reclamation, including revegetation, shall be completed within two years of completion or termination of mining. Reclamation efforts are not adequate. If the previously described deficiencies are not corrected within 30 days following your receipt of this Notice this matter will be referred to the Director, Division of Land Resources/Department of Environment and Natural Resources, for issuance of a "Notice of Violations" in an effort to secure compliance. In addition, failure to correct the deficiencies may result in the assessment of civil penalties and/or injunctive relief against you. Please review the new permit to familiarize yourself with the changes in the reissued permit. The general permit authorizes discharges of stormwater and some types of wastewater. You must meet the provisions of the permit for the types of discharges present at your facility.
