In accordance with your request, Certificate of Coverage Number NCG020269 is rescinded effective inunediately. Operating a treatment facility, discharging wastewater or discharging specific types of stormwater to waters of the State without valid coverage under an NPDES permit will subject the responsible party to a civil penalty of up to $25,000 per day. It is the intention of DWQ that enforcement proceedings will occur for persons that have voluntarily relinquished permit coverage when, in fact, continuing pennit-coverage was necessary. If, in retrospect, you feel the site still requires permit coverage, you should notify this office immediately. Furthermore, if in the future you wish to again discharge to the State's surface waters, you must first apply for and receive a new NPDES permit. If the facility is in the process of being sold, you will be performing a public service if you would inform the new or prospective owners of their potential nee for NPDES permit coverage. Upon completion of construction and prior to operation of this permitted facility, a certification must be received from a professionalengineer certifying that the permitted facility has been installed in accordance with the requirements of this permit and the approved plans and specifications. A set of approved plans and specifications for the subject project must be retained by the applicant for the life of the project. 7. Tn the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take such immediate corrective action as may be required by this Division, including the construction of: additional. or replacement wastewater treatment or disposal. facilities. 8. Any monitoring deemed necessary by the Division of Environmental Management to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 9. The solids generated from these treatment facilities must be disposed of in accordance with General Statute 143-215.1 and in a. manner approvable by the North Carolina Division of Environmental Management. 10. Diversion or bypassing of the untreated wastewater from the recycle system is prohibited. 11. Freeboard in the settling pond and clear water pond shall not be less than two (2) feet at any time. 12. Adequate facilities shall be provided to prevent surface runoff- from carrying any disposed or stored material into any surface waters. 13. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. s 14. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. Directions to Site: The Hall-Rackley Mine is located on the east side of SR 1001, approximately 1 mile off NC 24-27 in Harnett County. 6. Size: The original development of the Hall-Rackley Mine included approximately 67 acres. This proposed addition involves another 85 acres located immediately adjacent to the original site. 7. Topography: Rolling. 8. Location of nearest dwelling: Approximately 1000 feet from the plant site. 9. Receiving stream: N/A PART II - DESCRIPTION OF TREATMENT WORKS 1. Type of waste: Wastewater at this facility will consist of water used in a sand washing operation, mingled with silts and sands removed during that process. 2. Size of facility: This facility is expected to produce 300-375 ton/hr of washed sand. This system is designed to provide 1800 gpm of settled water back to the washing -screening equipment. 3. Type of treatment: GSM proposes to use two settling basins in series to provide physical treatment for this wash water. The primary basin, approximately 8' deep, will have a surface area of + 1.75 acre. The secondary basin will contain approximately 3.5 acres at a depth of. 10-12 feet. Mr. Harmon indicates an estimated total capacity of 10,000,000 gallons. Using 1800 gpm and assuming a 24-hr. operation, this should provide more than adequate retention time (approximately 96 hours). Staff Report and Recommendation Page 2 No outlet to surface waters is to be constructed. Notes indicate that all runoff from the site is to be collected in the wash water settling basins. Unless it is necessary to collect this runoff for use as make-up water, it should be excluded from these two basins. Due to the extremely sandy nature of this site, surface runoff is expected to be minimal. If necessary, additional sediment storage area can be found in sections of the site that have already been mined. PART III - EVALUATION AND RECOMMENDATION It is the recommendation of this office that Permit No. 11195, issued to Mr. R. G. Kirkpatrick for GSM, Inc., be amended to include the above described wastewater treatment facilities. This recommendation is based on the deter- mination by this office that the site appears suitable for the size and type system proposed.
