Dear Mr. Averitte: Hanson Aggregates Carolina, Inc. wishes to inform your office that following Hurricane Floyd we have had to begin discharging excess stormwater from the settling basin systems at Cape Fear Sand & Gravel (Permit # NCG020174) to prevent the system having failures of the dikes due to the excess volumes of stormwater. We are discharging to the Cape Fear River at a rate of 2,000 gallons/minute and anticipate discharging for a period of three to four weeks. While discharging stormwater we will not be able to meet the permit discharge limits. Once the excess volumes of stormwater have been discharged form the mine we will return to the required permit discharge sample limits. Staff of the Division of Water Quality have confirmed that this permit is no longer required. Therefore, in accordance with your request, NPDES Permit No. NCG020174 is rescinded effective immediately. If in the future you wish to discharge stormwater to the State's surface waters, you must first apply for and receive a new Stormwater NPDES Permit. Discharge of stormwater from this type of facility without a valid NPDES Permit may subject the responsible party to a civil penalty of up to $10,000 per day. These ponds were previously permitted under a Non -discharge Permit #13229. (WQO0O+zg9S) The settling ponds are constructed such that they should never have a discharge of the process water even during a 100- year storm event. Their function is'to supply water to the process plant to wash and classify sand and stone. This water is then pumped back to the ponds so that the sediment . accumulated during this process will settle out in the pond and the clean water can be reused in the plant.
