Hey Sarah! Hope you're doing well. Wanted to check on the attached rescission request for Southern Equipment
Company-NCG020138. I contacted the facility about scheduling an inspection and was told that the mine had been
reclaimed and released from the DLR mining permit several years ago. I then asked them if they had requested
rescission of their stormwater permit and received the attached letter. The letter is addressed to DWQ, but not to the
SPU so I don't know if you guys ever received it to process.

An inspection was made of the above mine on August 3, 2004 in accordance with G.S.
74-56 of the Mining Act of 1971.
The mine was found to be satisfactorily reclaimed. Therefore, your company is
released from further reclamation responsibility for this site with respect to the Mining Act of
1971. The $125,500.00 Surety Bond No. SU178774 issued by Utica Mutual Insurance
Company may be reduced to $33,900.00 to cover Mining Permit No, 74-28 as a reclamation
bond is no longer required for the Beasley Pit (Mining Permit No. 82-11).

modification. This modification documents the change in name at the subject facility. All other terms and conditions in the
original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North
Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U. S. Environmental
Protection Agency dated December 6, 1983.
If any parts, measurement frequencies or sampling requirements contained in this permit modification are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General

pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between the state of North Carolina and the U.S. Environmental Protection Agency, dated December 6, 1983.

Your coverage under this general permit is not transferable except after notice to DWQ. The Division may require
modification or revocation and reissuance of the Certificate of Coverage. This permit does not affect the legal
requirements to obtain other permits which may be required by DENR or relieve the permittee from responsibility
for compliance with any other applicable federal, state, or local law rule, standard, ordinance, order, judgment, or
decree.
Please note that in 1998 Senate Bill 1366 established changes to the permit fee structure for DWQ permits effective
January 1, 1999. This change requires that you pay an annual fee to assure continued coverage under this permit.
You will be invoiced for this fee beginning next year. A copy of the current fee schedule is included with this letter.

Dear Permittee:
Our files indicate that the subject permit issued on 9/13/91. expires on
8/31/96. We have not received a request for renewal from you as of this date.
A renewal request shall. consist of a letter requesting renewal and completion of
the enclosed application, submitted in triplicate. A processing fee must be submitted
with the request. Please find attached a copy of the 15 NCAC 211 .0205(c) regulations.
The processing fee for your facility is based on the design or permitted flow,
whichever is appropriate, listed in the first four categories of facilities. Sludge
renewals are based on total. acres of land permitted. If the facility covered by this
permit contains some type of treatment works, a narrative descripton of the sludge
management plan that is in effect at the facility must be submitted with the
application for renewal.
The Environmental Management Commission adopted revised rules on October 1, 1990
(attached), requiring the payment of an annual fee for most permitted facilities. You
will be billed separately for that fee (if applicable), after your permit is approved.
Please be advised that this permit must not be allowed to expire. If the renewal
request is not received within I80 days prior to the permit's expiration date as
required by 15 NCAC 2H .02.1.1, you will. be assessed an automatic civil penalty. This
civil penalty by North Carolina General Statute may be as much as $10,000 per day. If
a permit renewal request is not received 180 days before permit expiration, a civil
penalty of at least $250 will be assessed. Larger penalties may be assessed depending

on how late the request is made. In addition, any permit renewal request received
after the permit's expiration date will be considered as a new application and will be
required to pay the higher permit application fee.

application and appropriate standard fee, should be sent to:

as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

continued operation of a sand and gravel wash water recycle system consisting of a series of three
sedimentation ponds with dimensions of 500 feet x 200 feet x 3 feet (LXWxD), 200 feet x 200 feet x 3
feet, and 100 feet x 100 feet x 3 feet, approximately 200 linear feet of 12 inch diameter gravity flow drain
pipe connecting the sedimentation basins, a 100 feet x 100 feet x 8 feet water storage pond, a 500 gpm
water supply pump, and approximately 200 linear feet of 4 inch diameter force main to serve Paul Beasley
Concrete, Incorporated's Beasley Farm Pit with no discharge of wastes to the surface waters, pursuant to
the application for renewal received June 18, 1991 and in conformity with the project plan, specifications,
and other supporting data subsequently filed and approved by the Department of Environment, Health and
Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until August 31, 1996, and shall supersede
Permit No. 14286 issued February 13, 1987, and shall be subject to the following specified conditions
and limitations:
This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans, specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
The facilities shall be properly maintained and operated at all times.
This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as
may be required by this Division, such as the construction of additional or replacement
wastewater treatment or disposal facilities.
6. The sludge generated from these treatment facilities must be disposed of in accordance with
General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Environmental Management.
7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this facility.
8. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited
10. Freeboard in the settling basins shall not be less than one foot at any time.
11. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall keep an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken
by the Permittee. This log of inspections shall be maintained by the Permittee for a period
of three years from the date of the inspection and shall be made available upon request to
the Division of Environmental Management or other permitting authority.
14. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the purpose
of determining compliance with this permit; may inspect or copy any records that must be
kept under the terms and conditions of this permit; or may obtain samples of groundwater,
surface water, or leachate.
15. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205
(c)(4).
16. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the -Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6.
17. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
18. Noncompliance Notification
The Permittee shall report by telephone to the Fayetteville Regional Office, telephone no.
(919) 486-1541 as soon as possible, but in no case more than 24 hours or on the next
working day following the occurrence or first knowledge of the occurrence of any of the
following:
Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such
as the dumping of the contents of a basin or tank; the known passage of a slug of
hazardous substance through the facility; or any other unusual circumstances.
Any process unit failure, due to known or unknown reasons, that render the facility
incapable of adequate wastewater treatment such as mechanical or electrical failures
of pumps, aerators, compressors, etc.
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-
pass directly to receiving waters without treatment of all or any portion of the
influent to such station or facility.
d. Any time that self -monitoring information indicates that the facility is not in
compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
19. Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified waster treatment plant operator to be in responsible charge of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at
least equivalent to the classification assigned to the wastewater treatment facilities by the
Certification Commission.
20. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.

10. Freeboard in the settling basins shall not be less than one foot at any time.
11. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall keep an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken
by the Permittee. This log of inspections shall be maintained by the Permittee for a period
of three years from the date of the inspection and shall be made available upon request to
the Division of Environmental Management or other permitting authority.
14. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the purpose
of determining compliance with this permit; may inspect or copy any records that must be
kept under the terms and conditions of this permit; or may obtain samples of groundwater,
surface water, or leachate.
15. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205
(c)(4).
16. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6.
17. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
18. Noncompliance Notification:
The Permittee shall report by telephone to the Fayetteville Regional Office, telephone no.
(919) 486-1541 as soon as possible, but in no case more than 24 hours or on the next
working day following the occurrence or first knowledge of the occurrence of any of the
following:

a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such
as the dumping of the contents of a basin or tank; the known passage of a slug of
hazardous substance through the facility; or any other unusual circumstances.
b. Any process unit failure, due to known or unknown reasons, that render the facility
incapable of adequate wastewater treatment such as mechanical or electrical failures
of pumps, aerators, compressors, etc.
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-
pass directly to receiving waters without treatment of all or any portion of the
influent to such station or facility.
d. Any time that self -monitoring information indicates that the facility is not in
compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
19. Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified waster treatment plant operator to be in responsible charge of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at
least equivalent to the classification assigned to the wastewater treatment facilities by the
Certification Commission.
20. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.

of a series of three sedimentation ponds with dimensions of 50O'x2O0x3', 200'x 200'x3'
and 1OOx10O'x3', approximately 200 lineal feet of 12-inch diameter gravity flow drain
pipe connecting the sedimentation basins, a l001x100'x 8' water storage pond, a 500
GPM water supply pump, and approximately 200 lineal feet of 4-inch diameter force main
to serve the Williams Sand and Gravel Pit operated by Paul Beasley Concrete Company,
Inc. on SR 1620 in Sampson County, N. C., with no discharge to the surface waters of
the State,
pursuant to the application received January 2, 1987, and in conformity with the
project plans, specifications, and other supporting data, subsequently filed and
approved by the Department of Natural Resources and Community Development and
considered a part of this permit.
This Permit shall be effective from the date of issuance until February 28,
1992, and shall be subject to the.following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in
accordance with the approved plans, specifications and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes
described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable.
5. In event the facilities fail to perform satisfactorily, the Permittee shall take
such immediately corrective action as may be required by this Division.

6. Solids, sludges, or other pollutants removed or resulting from the wastewater
storage facilities shall be contained and disposed of in such a manner as to
prevent any contamination of the surface or groundwater of the State.

water into the pond. Until we receive this permitt we are re-
quring James Herring to keep a check on this to make sure there
is no water running into the pond.

55 intersection. Travel north on NC 55.for
approximately 2 miles until SR 1620y
intersection. Turn right onto SR 1620 and
travel approximately .8 mile. The Sand and
Gravel Operation is located on the left just
before you reach Jernigan's Pond.
6. The latitude and longitude of the site:
Latitude: 350 17' 20"
Longitude: 780 33' 10"
7. Size: This mining operation is approximately 40 acres in size.
8. Topography: Flat to gently sloping
9. Location of nearest dwelling: The nearest dwelling is a foreman's
residence approximately 200-250 feet
from the mine site.
10. Receiving Stream: N/A This is a non -discharge system and should
not impact the State's surface waters. The
closest surface waters to the proposed
facility is Big Juniper Run which is classed
as "C Swamp" waters in the Cape Fear River
Basin.
PART II - DESCRIPTION OF RECYCLE OPERATIONS
1. Type of wastewater: Wastewater will be generated as a result of the
washing of sand and gravel used as aggregates
in concrete. The wastewater will consist of
"- --" --- --- - --' _ -- -- water _containing suspensions of sand, silt,
clay, and debris (sticks, roots, etc.).
2. Type Treatment: According to Mr. Glen Tew, Godwin, Jordan and
Associates, Consulting Engineers for Paul Beasley
Concrete. The subject facility will be a closed
loop system with no discharge to the State's
surface waters. Once the sand and gravel is
washed, the wastewater will flow through a series
of three (3) sedimentation ponds. The sand and
gravel is washed and the wastewater will flow
through a series of three 200' X 200' X 4' sedimen-
tation ponds. Once the wastewater reaches the
third (3rd) pond it will flow back into a storage
area (100' X 100' X 8') which will be the water
supply for the washing operation. Should more make
up water be necessary than the storage area can
supply, water can then be pumped from.Jernigan
Pond.
PART III - OTHER PERTINENT INFORMATION
1. The Land Quality Section of the Fayetteville Regional Office is
currently assisting Paul Beasley Concrete regarding theiErosion
Control Plan and Mining Permit.
2. According to Godwin, Jordan and Associates the 100 year flood
elevation at the subject facility is approximately 150 feet.
3. Groundwater comments for the subject facility have been submitted
by the Fayetteville Regional Office Groundwater Section.
4. All sand and gravel utilized by this facility will be hauled to the
wash facility by dump truck or front end loader.
5. Paul Beasley is a locally owned concrete company who proposes to
use the sand and gravel mined at this facility as aggregates in the
making of concrete. According to Mr. Glen Tew, the subject
facility will produce approximately 300 ton/day or approximately
72,000 tons of sand and gravel per year (65% sand, 35% gravel).
The facility will operate approximately 5 1/2 day/week 4-5
hour/day.
6. The proposed non discharge/recycle system will consist of a closed
loop series of three (3) 200' X 200' X 4' sedimentation ponds.
Once the sand and gravel is washed, the wastewater will flow
through these ponds and finally into a 100' X 100' X 8' storage
pond which can then be recycled back to the washing operation. The
wash water will initially originate from a surface drainage pipe
from Jernigan's Pond located on Big Juniper Run, Class C Swamp,
Cape Fear River Basin. All wastewater will be contained in the
sedimentation lagoons with no discharge to the State's surface
waters. The proposed sedimentation ponds will be excavated on
existing ground with no proposed lining due to the relatively flat
grade. It is estimated that the flow rate from the proposed mining
operation will be approximately 1.3 cft/sec.. The solids (sedi-
ment) from the sedimentation ponds will be dredged periodically and
this material will be land applied on the subject property to fill
in low areas.
PART IV - RECOMMENDATION
It is the recommendation of this office that Paul Beasley Concrete,
Inc. be issued a non discharge permit for a non discharge closed loop
sedimentation pond system for the processing (washing) of sand and
gravel to be used as aggregates in the mixing of concrete.

PERMISSION IS HEREBY GRANTED TO

construction and operation of an inorganic solids settling and water recycle
system consisting of four (4) settling basins in series (three (3) basins
20 feet X 30 feet X 4 feet deep and one (1) basin 40 feet X 100 feet X 8
feet deep) connected by 3 foot wide channels, a water supply basin, an
800 GPM supply pump, a force main to the washing system, a suction line
to the water supply basin or the river, a gravity return line from the
washing system to first settling basin and with pipes, valves, fittings,
and appurtenances to serve Paul Beasley Concrete located off US-421 East of
Dunn, North Carolina, with no discharges to the surface waters of the State,
pursuant to the letter of request received February 24, 1983, and in
conformity with the project plans, specifications, and other supporting
data, subsequently filed and approved by the Department of Natural
Resources and Caumunity Development and considered a part of this Permit.
This Permit shall be effective from the date of issuance until July 31,
1988,_shall be subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are operated in
accordance with the approved plans, specifications and other supporting
data.
2. This permit is effective only with respect to the nature and volume of
wastes described in the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.

q Any monitoring deemed necessary by the Division of Environrrnntal
Management to insure surface and ground water protection will be
established and anacceptable sampling reporting schedule shall
be followed.
5. This permit is not transferable.
6. In event the facilities fail to perform satisfactorily, the Permi.ttee
shall take such immediate corrective action as may be required by this
Department.
7. Solids, sludges, or other pollutants reoved or resulting from the
wastewater treatment process shall be contained and disposed of in
such a manner as to prevent any contamination of the surface or
ground waters of the State.
8. Diversion or bypassing of the untreated wastewater fran the wastewater
recycle system is prohibited.
9. The facilities shall be effectively maintained and operated as a
nondi.scharge system to prevent the discharge of any wastewater
into the surface waters of the State.
10. Freeboard in the settling ponds shall not be less than one foot at
any time.
11. The Permi.ttee, at least six (6) months prior to the expiration of
this Permit, shall request its extension. Upon receipt of the
request, the Cornnission will review the adequacy of the facilities
described therein, and if indicated, will extend the Permit for
such period of time and under such conditions and limitations as
it may deem appropriate.

methods. The site investigation revealed .that'a discharge of wash water.'

Since this facility has no discharge permit, such s discharge is in.
direct violation of various portions of N.C.'General Statutes 143-215.

Initial review of this project indicated the following items that must be
resolved before a permit can be issued:
1. The application shows the facility located in Harnett County and the drawing
indicates Sampson County. Which is correct? The DOT and USGS maps say
Sampson County when using the locator map on the plans.
2. As drawn, the system appears to be potentially a discharging system via the
ditch from the Mingo Swamp. Usually these systems pump the make-up water
from the supply. Please explain how it can be a non -discharge system as
depicted. If it discharges, an NPDES Permit will be needed.
3. Please show complete plan and profile drawings of the system from the
Mingo Swamp.
4. What is the 100-year flood elevation for this section of the Mingo Swamp?
Does this facility flood frequently?
5. What is the size of the supply pump, and what is the normal daily volume
pumped through the system. What is the size and lengths.of the suction
and discharge piping.
6. What are the sizes and lengths of the discharge lines to the manhole? How
long is the pipe from the manhole to the ditch?
7. Will the sedimentation ponds be lined? If they are be lined, please furnish
the details of construction. If they are not going to be lined, what are
the side -wall slopes to be for these ponds?
8. How much freeboard is planned for the ditches and.the ponds? A minimum two
foot freeboard is recommended.

In reply to your letter of September 30, 1983, regarding the above referenced
permit, it is our intent to begin construction on the recycle facility within
the next two weeks,
The reason for delay in building the recycle facility is due to the fact that
our sand and gravel operation has been closed for quite a while. As you know,
this has been an extremely dry summer, and due to lack of water supply for
the operation, we were forced to close it. I can assure you that the recycle
system will be installed and that I will notify your office as soon as it is
completed.
If you need any additional information on the matter, or if my suggestion
does not meet with your approval, please contact me.

SUBJECT: Non Discharge Reconnaissance Inspection
Sand and Gravel Washing Operation (Permit #9198)
Beasley Concrete
Sampson County
On Thursday, May 3, 1983, the writer visited the subject facility for the
purpose of conducting an inspection of Beasley Concrete's Recycling Sand and
Gravel non -discharge washing operation. The wastewater from this system flows
through the a series of three (3) 20' x 30' x 4' sedimentation ponds, from here
the wastewater flows into a pond (40' x 100' x 8') for final settling. From
this pond the water flows into a storage area which is a closed loop system
and no wastewater flows into the State's surface waters. The subject facility
is in the final construction stages and should be completed by June 1984. The
reason for the delays in construction are due to the extremely wet weather
this area has experienced. The various components of the system are in place
and in operation, and only grading and seeding type work remains incomplete.
According to Mr. Tony Beasley, owner, the soil will not support the heavy
equipment necessary to perform the final construction phase. Mr. Beasley assured
the writer that as soon as the material was dry enough all work would be completed.
The facility appeared to be operated in an acceptable manner and no dis-
charge to the surface waters was observed. Thus, it is the opinion of the
writer that the subject facility is in compliance with its permit.
