On-Site Determination for Applicability to the Neuse River Riparian Area Protection Rules (15A NCAC 2B.0233)
Dear Mr. Clark:
On August 20, 2002, at your request I conducted an on-site determination to review one (1) drainage feature (depicted as "Subject
Feature" on the attached Soil Survey initialed by DWQ staff on August 20, 2002) on the subject property for applicability to the Neuse
Buffer Rules (15A NCAC 2B .0233). As a result of this on-site determination, the DWQ has determined that the "Subject Feature"
contains a modified, ephemeral stream not subject to the Neuse Buffer Rules.
The DWQ had previously conducted an on-site determination of streams located on the subject property on Apri1..24, 2002. You
requested an appeal of the determination made on the "Subject Feature" (previously depicted as Feature "A") as provided within 15A
NCAC 02B .0233(3)(a). At your request, I conducted an appeal of the determination as stated above. During my. review I evaluated
the stream'using the "NC DWQ Stream Classification Form". I used this information to make my determination that the stream was
ephemeral and not subject to the buffer rules. This determination replaces the determination made on April 24, 2002. However, please
note that any other on-site determinations made during the April 24, 2002 review do not change. The owner (or future owners) should
notify the DWQ (and other relevant agencies) of this determination in any future correspondences concerning this property.
This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. Nor does this letter
approve any activity within Waters of the United States or Waters of the State. Wetlands or other Waters of the U.S. may exist on the
property. You should contact the U.S. Army Corps of Engineers to ensure compliance with wetland regulations. If you have any

Re: Division of Water Quality (DWQ) Appeal Meeting of the Neuse Buffer Determination for the property
known as the Pineview Estates Property, Durham County, NC.
Dear Ms. Ashley:
On August. 20, 2002, Mr. Bob Zarzecki of the DWQ, and I reviewed the channel features on the property in
order to appeal the first determination made on April 24, 2002. It was determined that Feature A is
subject to the Neuse River Riparian Buffers starting at and downstream of flag 151. Flags 100-150
demarcate a jurisdictional channel that is not subject to the Neuse buffers. As per the April 24, 2002
meeting, features B and C are not subject to the buffers and Feature D is subject. Please note that
feature A will most likely be considered a jurisdictional channel between flags 100-151 and should be
confirmed by the USACE. A site visit with the USACE may be required. Please advise.
Neuse River Buffer Rules
The Neuse River Buffer rules protect up to 50 feet from the edge of existing "surface waters" (intermittent
streams, perennial streams, lakes, ponds and estuaries) found within the Neuse River Basin. The 50-foot
buffer basically consists of two zones. The first zone is measured 30 feet landward from the top bank of
streams and intended to contain an undisturbed-forested area. The second zone is measured 20 feet from
the edge of the first zone and is intended to contain a vegetated buffer. A couple of notable points of the
rules include; the allowance of grading with re-vegetating within Zone 2 (the outer 20 feet) and the
requirement of mitigation for road crossings greater than 150 feet in width and utility lines running parallel
and within the buffers. Please call if you would like to discuss these new changes.
Durham Development Ordinances
The Durham City-County Zoning Ordinances were revised and adopted on 6/21/99 to include the addition
of "Section 11, Natural Resources Protection Standards". These new standards include Floodplain
Protection Standards, Stream Buffer Protection Standards, Steep Slope Protection Standards, Wetland
Protection Standards and Durham Inventory Site Protection Standards. The Stream Buffer Protection
Standards require a 30-foot buffer for "intermittent streams" and a 50-foot buffer for "perennial streams"
indicated on either the USGS quadrangle topographic maps or USDA Soil Survey of Durham County Map
and drain an area twenty-five (25) acres or greater. The Wetlands Protection Standards require a twenty-
five (25) foot buffer for retained wetlands that do not receive a 404 Permit issued by the USACE or 401
Water Quality Certification issued by the NC-DWQ and are greater than 1 acre in size. This buffer can be
limited to ten (10) feet if the site employs construction management techniques that provide at least a
comparable level of protection for the wetland areas. Allowable activities within the buffers include street
crossings, utility crossings, passive recreation activities, clearing and re-vegetating for the purposes of
improving its pollutant removal efficiency, and stormwater control facilities and wetlands constructed for
mitigation purposes. Variances from these rules can be applied for through the Board of Adjustments.
