PROJECT SUMMARY: The applicant proposes to construct an eight (8) slip commercial dock. Hap Alexander for Howard Batts / Sears Landing Project Page Two 9. PROJECT DESCRIPTION: The applicant's project is located at an existing commercial development known as Thomas' Seafood and Tackle Shop. This property is located along the northwest side of the NC Highway 50/210 Swing Bridge crossing the AIWW at Surf City, in Pender County. The entrance to the property is on the north.side of the causeway, just to the east of Harbor Pointe Subdivision. The Existing business is located on a 0.41 acre parcel of land situated along a small boat basin adjacent to a tributary of Topsail Sound. This basin area is connected to the AIWW by a small channel which extends past the Harbor Pointe development. Near the basin the channel makes a bend to the north and continues behind a series of dredge spoil islands which separate the channel from the AIWW. The proposed dredging of a portion of this channel is the subject of an earlier CAMA Major Permit Application by Homeco Builders, Inc. and is described in a Field Investigation Report dated July 15, 2002. The property has approximately 179 feet of shoreline along the boat basin. The property is bordered on the south by the community boat ramp at Harbor Pointe Subdivision and on the north by an existing commercial ramp located at property currently owned by Homeco Builders, Inc. Existing development at the project site includes: a one story, commercial, cinder block structure used currently as a tackle, bait and seafood business; a parking lot; a concrete pad on the waterward side of the building, which extends to an existing failing bulkhead; and a haphazard arrangement of docks and pilings primarily used for the mooring of commercial fishing vessels. A CAMA General Permit was issued to Hap Alexander on August 1, 2002 for the reconfiguration of these docks into a floating dock. Based on the existing configuration of the docks and pilings, it was determined that there was existing docking space for six vessels. As of the date of this Report, the construction of the floating docks under this General Permit has not begun, however, much of the old dock structure has been removed. A CAMA General Permit was also issued to authorize the replacement of a portion of the existing failing bulkhead on the property. The Town of Surf City Land Classification Map classifies the upland areas of the project site as Limited Transition, however, the Land Use Plan includes all Areas of Environmental Concern , as well as spoil islands in the Conservation class. The waters of the AIWW and Topsail Sound are Classified SA by the Division of Water Quality. The area is designated as a Primary Nursery Area by the Division of Marine Fisheries and is open to the taking of shellfish. The applicant is proposing to increase the number of slips at the property by the construction of a floating dock system, at which the applicant is proposing eight (8) slips. Including the structures authorized under the CAMA General Permit, the entire structure would consist of a 6 feet wide by 102 feet long floating dock located directly adjacent to the bulkhead. Near the southern property boundary, the dock would turn 90 degrees and extend into the basin for approximately 110 feet. At the end of the structure the applicant is proposing a 6 feet wide by 26 feet long finger pier. On the remaining portion of the dock the applicant is proposing three additional finger piers. Starting at the eastern end of the main floating dock, these fingers would measure: 6 feet by 18 feet; 6 feet by 24 feet; and 6 feet by 16 feet, respectively. The finger piers would be spaced approximately 30 feet apart. Water depths at the waterward end of the structure would average approximately -4 feet at mean low water (MLW). The docking facility would provide leased slips as well provide temporary tie-up for patrons. Hap Alexander for Howard Batts / Sears Landing Project Page Three 10. ANTICIPATED IMPACTS: Construction of the proposed floating docks would result in the incorporation of approximately 1,746 sq. ft. of public trust area. Localized increases in turbidity can be expected during piling placement. It should be noted that an application is currently in process for the adjacent properties to the north and south which includes the construction of an additional ten (10) slips in the vicinity of this basin (See Harbour Pointe Field investigation Report Revision, dated September 4, 2002. The cumulative effect of multiple docking facilities along this shoreline could potentially impact the shellfish closure status of this body of water. The applicant and the adjacent property owners have reached an agreement on separation distances from each ofthe proposed docks as well as setbacks from the common areas of riparian access. Submitted by: Jim Gregson Date: September 20, 2002 Office: Wilmington Recommendations for State Permit - Hap Alexander for Howard Batts / Sears Landing Project Construction of floating dock system could potentially provide more docking space than the eight (8) slips that the applicant is proposing. Docking at the outside areas of the southern dock and northern finger pier could be discouraged by not installing mooring devises in these areas and by the construction of handrails and/or the posting of signs. Conversations with Shellfish Sanitation indicate that if adequate distances are not maintained between adjacent docking structures the slip total may count cumulatively in making a closure recommendation. It appears that the applicant has reached an agreement with the adjacent property owners in this respect (See attached dock location agreement signed by Jimmy Pierce on September 19, 2002 and by the President of Sunset Cove Development, Inc. on September 18, 2002.) If the proposes dock configuration and slip numbers at this project, as well as at the adjacent Homeco Builders, Inc. project, do not result in a closure recommendation by the Shellfish Sanitation Section, it is recommended that a permit issued with following conditions: This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of the structure without permit modification. No non-water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 2. The permitted docking facility shall provide docking space for no more than eight (8) vessels. At no time shall more than eight vessels be moored or located at the facility. This restriction shall apply to all marine vessel types, including but not limited to motor boats, sailing vessels and personal watercraft. 3. At no time shall vessels be moored at the facility in such a manner which would block or impede the use of the existing community boat ramp located at the Harbor Pointe Subdivision. 4. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5. The authorized structure and associated activity must not cause an unacceptable interference with navigation. 6. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. 7. In order to protect water quality, runoff from the construction must not visibly increase the amount of suspended sediments in adjacent waters. 8. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit.
