This letter shall act as your approval for the use of the "General" Major Variance; From the Neuse and Tar- Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management Commission (EMC) on May 10, 2001. In addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control and CAMA permits. This approval shall expire when the variance expires on April 11, 2006 unless it is renewed before that time by the EMC. This approval is only valid for the purpose and design that you described in your variance request. If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. Conditions Stormwater Control / Infiltration Areas / Diffuse Flow All new stormwater drainage shall be directed to the proposed "infiltration areas" or vegetated areas at non-erosive velocities prior to entering the protected riparian buffers as identified within 15A NCAC 2B .0233(5). 2. Buffer Mitigation You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to compensate for impacts to the protected riparian buffers is 408 square feet as required under this variance approval and 15A NCAC 2B .0242. We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC Wetlands Restoration Program (WRP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 2B .0242(7), this contribution will satisfy our compensatory mitigation requirements under this variance approval. Until the WRP receives and clears your check (made payable to: DENR -Wetlands Restoration Program Office), no impacts specified in this variance approval shall occur. Deed Notifications Deed notifications or similar mechanisms shall be placed on all retained protective buffers in order to assure compliance for buffer impact. These mechanisms shall be put in place prior to impacting any buffers approved for impact under this variance approval. If these conditions can not be met, then this approval will not be valid. An individual Major or Minor Variance from the Neuse Buffer Rules may be sought from the EMC (Environmental Management Commission). This letter completes the review of the Division of Water Quality under the Neuse River Riparian Buffer Protection Rules (15A NCAC 2B .0233 (9)(b)). PROJECT DESCRIPTION The project is located in the Neuse River Basin, specifically an unnamed excavated tributary of the Trent River. This project proposes development in the 50' riparian buffer and the 75' CAMA setback areas. It is proposed that a residence, patios, driveways, and sidewalks be constructed on the site covering a total impermeable area of 3,161 SF. Portions of this impermeable area are located within the 75 foot CAMA AEC and 50 feetRiparian Buffer Area. A CAMA Minor permit must be issued to authorize construction. A General Major Variance of Riparian Buffer Rules must also be approved. Approval must also be sought from the City of New Bern to construct outside the established building setbacks. The attached sketch delineates the proposed construction and planed stormwater control measures to be employed on this project. B. RIPARIAN BUFFER IMPACT The proposed construction will affect the Neuse River Riparian Buffer areas as follows: RIPARIAN AREA EXISTING IMPERVIOUS AREA NEW IMPERVIOUS AREA 30' Zone 1 Buffer Area 0 SF 408 SF 50' Zone 2 Buffer Area 0 SF 1, 152 SF The total proposed impervious area within the Neuse River Riparian Buffer area is 1,560 SF. In order to mitigate the proposed impact to the Neuse Riparian Buffer areas, it is proposed to make an off-set payment to the Wetlands Restoration Fund in the amount of $1,497.60 (0.96 per square foot x 1560 SF). In addition, stormwater runoff from the new impervious areas will be directed away from the waterfront area. A gutter system installed on the residence will direct a portion of the building runoff to an infiltration swale located along the side property line. This stormwater treatment system is being installed to comply with CAMA regulations. C. CAMA 75' AEC IMPACT The proposed construction will include the development of 2,931 SF of impermeable surfaces within the 75 foot CAMA AEC. CAMA regulations allow for development in the 75 foot CAMA AEC zone up to a limit of 30% built-upon without special stormwater considerations. The proposed impermeable surfaces represent 44.15 % of the total lot area within the 75 foot AEC. Therefore, a stormwater treatment system is required. As outlined on the attached plans, it is proposed that a portion of the roof water from the structure be collected and be routed through an infiltration swale system located along the side property lines. The infiltration areas are designed to collect the runoff from the 10 year, 24 hour storm (6.75 inches) with a conservative allowance of one inch of infiltration occurring during the 24 hour storm period. The net stormwater volume to be retained is 5.75 inches. Runoff from approximately 1,000 SF of impermeable roof surfaces are proposed to be collected. The total runoff volume from this impermeable area is 450 cubic feet. The infiltration swales as designed can fully contain this runoff volume. The resulting storage depth in the infiltration basin is 0.5 feet. Runoff that accumulates in the infiltration basin will infiltrate and not runoff towards the surface waters located adjacent to the lot. The proposed design is considered an innovative method of treating stormwater runoff for the project and meets the intent of 7H.0209, Paragraph E2 of the Coastal Management Act. PROJECT DESCRIPTION The project is located in the Neuse River Basin, specifically an unnamed excavated tributary of the Trent River. This project proposes development in the 50' riparian buffer and the 75' CAMA setback areas. It is proposed that a residence, patios, driveways, and sidewalks be constructed on the site covering a total impermeable area of 3,161 SF. Portions of this impermeable area are located within the 75 foot CAMA AEC and 50 feetRiparian Buffer Area. A CAMA Minor permit must be issued to authorize construction. A General Major Variance of Riparian Buffer Rules must also be approved. Approval must also be sought from the City of New Bern to construct outside the established building setbacks. The attached sketch delineates the proposed construction and planed stormwater control measures to be employed on this project. B. RIPARIAN BUFFER IMPACT The proposed construction will affect the Neuse River Riparian Buffer areas as follows: RIPARIAN AREA EXISTING IMPERVIOUS AREA NEW IMPERVIOUS AREA 30' Zone 1 Buffer Area 0 SF 408 SF 50' Zone 2 Buffer Area 0 SF 1, 152 SF The total proposed impervious area within the Neuse River Riparian Buffer area is 1,560 SF. In order to mitigate the proposed impact to the Neuse Riparian Buffer areas, it is proposed to make an off-set payment to the Wetlands Restoration Fund in the amount of $1,497.60 (0.96 per square foot x 1560 SF). In addition, stormwater runoff from the new impervious areas will be directed away from the waterfront area. A gutter system installed on the residence will direct a portion of the building runoff to an infiltration swale located along the side property line. This stormwater treatment system is being installed to comply with CAMA regulations. C. CAMA 75' AEC IMPACT The proposed construction will include the development of 2,931 SF of impermeable surfaces within the 75 foot CAMA AEC. CAMA regulations allow for development in the 75 foot CAMA AEC zone up to a limit of 30% built-upon without special stormwater considerations. The proposed impermeable surfaces represent 44.15 % of the total lot area within the 75 foot AEC. Therefore, a stormwater treatment system is required. As outlined on the attached plans, it is proposed that a portion of the roof water from the structure be collected and be routed through an infiltration swale system located along the side property lines. The infiltration areas are designed to collect the runoff from the 10 year, 24 hour storm (6.75 inches) with a conservative allowance of one inch of infiltration occurring during the 24 hour storm period. The net stormwater volume to be retained is 5.75 inches. Runoff from approximately 1,000 .SF of impermeable roof surfaces are proposed to be collected. The total runoff volume from this impermeable area is 450 cubic feet. The infiltration swales as designed can fully contain this runoff volume. The resulting storage depth in the infiltration basin is 0.5 feet. Runoff that accumulates in the infiltration basin will infiltrate and not runoff towards the surface waters located adjacent to the lot. The proposed design is considered an innovative method of treating stormwater runoff for the project and meets the intent of 7H.0209, Paragraph E2 of the Coastal Management Act.
