You have our approval, in accordance with the attached conditions, to shade 0.10 acre of vegetated and non-vegetated wetlands
in order to construct a pier with a T-head and two boat lifts in an unnamed gut and marsh adjacent to Pungo Creek in Beaufort County, as
described in your application received by the Division of Water Quality on September 12, 2002. After reviewing your application, we have
determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at
hfti):Hh2o.enr.state.nc.us/newetlands. This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal
Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not
limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. Also this approval
will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition
listed below:
1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401
Certification has been completed.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N:C. 27699-6714. This
certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

8. PROJECT SUMMARY: The applicant proposes to construct a 6' x 448' pier that crosses an unnamed gut and
marsh adjacent Pungo Creek and extends 60' waterward of the normal water level to reach 4' of water depth in
Pungo Creek. The applicant proposes to construct a 12' x 16' T-head and two boat lifts at the waterward end of
the pier.

Project Setting
The project site is located off SR 1718 at Banjo Creek Estates on an unnamed gut off
Pungo Creek a tributary to the Pungo River in Beaufort County neaI ? Belhaven, North Carolina.
The site consists of two lots (Lot no. 15 and Lot No. 30 at Banjo Creek Estates) situated on either
side of the unnamed gut. Lot No. 30 is developed located oni the east side of the gut,
approximately 1.27 acres, vegetated with upland grasses and various hardwood trees. There
exists a single story residence that was constructed on top of a knob that slopes down toward a
coastal wetland/marsh and gut adjacent/offPungo Creek. The shoreline on Lot no. 30 is situated
on the gut and has no shoreline that fronts Pungo Creek. A dock and wooden frame boat ramp
are located on the gut shoreline. The gut is widest at its confluence With Pungo Creek. The gut is
approximately 56' wide in the vicinity of the dock but narrows significantly immediately
upstream of the dock. The gut is shallow with water depths 1' or less. The gut had previously
been navigable to the dock and boat ramp but has experienced some shoaling over time that now
precludes use of the dock and boat ramp.. Widgeon Grass (R pia maritime is growing in the
organic soil found in the gut. Across the gut on the west side is thle undeveloped Lot No. 15,
approximately .70 acre in size, which consists of uplands some 7' !above the elevation of the
adjacent coastal wetland/marsh. Lot No. 15 fronts both Pungo Creek and the unnamed gut. A
wide expanse of marsh, approximately 400' wide separates the highground on Lot 15 from the
Pungo Creek. The width of the coastal wetland/marsh separating thej highground from the water
narrows in the gut.
Pungo Creek is classified as SC NSW by the Environmental Management Commission.
Pungo Creek, at this location, is classified as Inland Waters by the Division of Marine Fisheries
Commission and N.C. Wildlife Commission.
Project Description
The applicant proposes to construct a 6' wide x 56' long pier/footbridge elevated 6' above
the normal water level across a gut to a 6' wide pier that will leave f#om the highground on Lot
No. 15 and span the coastal wetlands some 342' to Pungo Creek then another 60' into the creek to
a 12' x 16' platform with two boat lifts. The pier/footbridge will have a 10' wide navigational
span in the center of the gut.
Anticipated Impacts
There will be some localized short-term turbidity during the construction activities in the
gut and Pungo Creek. The pier and platform will shade 816 ft2 of Pungo Creek bottom. The
access will shade t 2,100 ft2 of Coastal wetlands. The pier/footbrid ' e across the gut will limit
access upstream (waters less than 1' in depth) to craft less than 6' in eight, and less than 10' in
width.

other instrument under which the applicant claims title
to the affected properties. If the applicant is not
claiming to be the owner of said property, then

and cross-sectional drawings) drawn to scale in black
ink on an 'S 1/2" by 11" white paper. (Refer to
_.. Coastal Resources Commission Rule 7J.0203 for a
detailed description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if an
adequate number of quality copies are provided by
applicant. (Contact the U.S. Army Corps of
Engineers regarding that agency's use of larger
drawings.) A site or location map is a part of plat
requirements and it must be sufficiently detailed to
guide agency personnel unfamiliar with the area to the
