Box 250 Hatteras, NC, 27943 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Branch: October 15, 2002 DWQ# 02-1483 Dare County You have our approval, in accordance with the attached conditions, to fill and excavate 0.094 and shade 0.001 acre of coastal wetlands and estuarine waters in order to perform maintenance dredging and construct a dock and boat slips along the shoreline of your property in Hatteras Village in Dare County, as described in your application received by the Division of Water Quality on September 16, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below: 1. PROJECT SUMMARY: This project involves maintenance dredging, and the construction of new dockage to create 4 additional boat slips along the shoreline of a property in Hatteras Harbor Creek located in the Village of Hatteras, in Dare County. This project also includes the installation of a bulkhead to replace the existing riprap stabilization along the shoreline of this property. Jack T. Branch, Dare County FIELD INVESTIGATION REPORT Wage 2 1' Project Setting The application site is located west of the Hatteras Marlin Club Marina, off Kohlor Drive, in the Village of Hatteras, Dare County. The site consists of a 0.4-acre lot that is situated between the intersection of NC12 and Kohlor Drive, and Harbor Village Creek. This waterbody is also referred to, locally, as Austin Creek. This creek flows through the north part of Hatteras village and connects to the Pamlico Sound both through Hatteras Harbor and Sandy Bay, which is located on the east side of Hatteras village. According to the North Carolina General Warranty Deed provided with this permit application, this parcel is presently owned by both Jack T. Branch and his wife, Pearl S. Branch, and was recorded by the Dare County Register of Deeds on February 13, 2002. Mary Dawn M. Judy and family previously owned this property. This previous property owner obtained delineations, permits, and authorizations for work prior to the sale of this property including the issuance of a Nationwide # 18 by the U. S. Army Corps of Engineers (US ACE), and a Division of Water Quality Certification # 011287, as well as a Division of Coastal Management coastal wetland delineation conducted on January 9, 2002. Prior to this current permit application review, the existing property owner (Jack Branch) was issued CAMA Minor permit (permit # 2002-9) for site development within the Estuarine Shoreline of the Pamlico Sound, and a CAMA General Permit # 31255-A for a bulkhead alignment that was landward of all wetlands. This General Permit expired on April 28, 2002, and the Minor Permit will expire on December 31, 2005. No work was ever undertaken under this general permit authorization. Some site grading work has been undertaken, including upland grading associated with the authorized minor.development within the Estuarine Shoreline Area of Environmental Concern (AEC), and the filling of US ACE jurisdictional wetlands located outside of the Estuarine Shoreline AEC. The lot is a vacant tract with current access from Kohler Drive and through an adjacent front lot along NC 12. This lot has approximately 150-1f of shoreline, and may have been previously used in commercial fishing activities. According to the application, this site is approximately 3.5-ft above the NWL. The site is level and some of the referenced authorized site work has been undertaken. Most of these. fill areas are presently located on a separate recently subdivided lot, that was part of the original parcel, located along NC12. The adjacent riparian property to the east is owned by Desmond R. Foster, Jr. The shoreline along this property is bulkheaded, and much of this adjacent property appears to have been previously filled. The adjacent riparian property to the west is owned by Joseph G. Farrow, and a portion of this property appears to be being used for commercial crabbing and fishing. The shoreline of this adjacent property is stabilized with a bulkhead landward of the existing wharf, and wetland fringe. A concrete pad, near the shoreline, is used for parking, crab-pot and net storage and staging. Existing structures on the application site include a 70-ft by 10-ft boardwalk type dock, somewhat parallel to the shoreline. This boardwalk extends east in front of the adjacent lot, and continues along the applicant's shoreline, a few feet waterward of an existing wetland fringe, approximately 8-ft to 10-ft waterward of the NWL, and a few feet beyond the existing wetland fringe. The boardwalk structure has two 4-ft by 10-ft finger piers that face northwest, and provide 4 existing boat slips. Several miscellaneous mooring piles are also positioned offshore of the existing boardwalk. Approximately 85-1f of the shoreline is stabilized with a wide revetment of concrete slabs, rubble, and riprap material. Jack T. Branch, Dare County Page 3 FIELD INVESTIGATION REPORT A 7-ft to 30-ft wide coastal wetland fringe exists along this shoreline. Vegetation has grown through much of this concrete material, landward of the NWL, including Baccharis halimifolia, Spartina alterniflora, Borrichia frutescens, and Spartina patens. In addition, through the existing concrete riprap material that is waterward of the NWL, a healthy obligate 2-3-ft fringe of Spartina alterniflora and Scirpus spp. is established. According to the application, no erosion has occurred along this shoreline within the last year. Aerial photos from 1995 and 2000 indicate this to be the case over the last seven years. Village Harbor Creek appears to have been channelized, and serves more as a harbor basin in the vicinity of this project. At the project site, the creek is over 200-ft wide, and has a water depth, at a distance of 3-ft offshore, of one ft or less. The application platwork indicates that the water depth, 25-ft offshore, is 5-ft, at NWL, and out into the harbor channel, at 60-ft offshore, the existing water depth is 10-ft, at NWL. The harbor bottom consists predominately of sand, muck and debris, and during the application site visit, there were no visible areas of submerged aquatic vegetation. The waters of this creek carry the same water classification as the Pamlico Sound. The North Carolina Environmental Management Commission has designated these waters as `SA' waters (suitable for shellfish propagation and harvesting); however, the waters in this vicinity are closed to the commercial harvest of shellfish. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of the Pamlico Sound as Coastal Waters. During the site investigation, no shellfish were observed along the water bottom. Juvenile finfish and some crustaceans were observed within the waters and wetlands along the shoreline. The Coastal Resources Commission (CRC) has also designated these waters as Estuarine Waters and Public Trust Areas of Environmental Concern (AEC). Also under the designation of the CRC, a Coastal Shoreline AEC extends in a contour of 75 ft landward of the NWL. Coastal wetland vegetated areas, like the one described above, have also been designated as Coastal Wetland AEC by the CRC. Project Description The applicant proposes to remove the existing concrete riprap material along the existing shoreline and wetland fringe areas, and install a wood bulkhead. The proposed 144-1f bulkhead alignment is an average and maximum distance waterward of the NWL of 4-ft and 8-ft, respectively. The application does not indicate whether this structure will directly tie into the adjacent bulkhead structures, will have separate return walls at each end, or some combination of these options. The bulkhead structure will include wood pilings and sheathing with conventional steel rods and deadmen construction. The tieback area will be backfilled with sand material previously dredged and stockpiled from a recent approved local dredging maintenance project. Jack T. Branch, Dare County Page FIELD INVESTIGATION REPORT v The applicant proposes to allow the existing 10-ft wide boardwalk to remain jalong the southwest side of the property's shoreline, and connect an additional 82-1f of 6-ft wide boardwalk along the remaining portion of the shoreline in a northeast direction. The proposed new boardwalk portion will connect to the existing boardwalk at an approximate 90-degree angle. A 6-ft wide elevated walkway, that will provide access from high ground near the center of the'lot's shoreline, will connect to the boardwalk dockage at this same location. The new boardwalkwill also include two 12-ft long by 3-ft wide finger piers. Four new mooring pilings will be positioned in conjunction with these finger piers, and will provide four additional mooring slips. This will increase the number of available slips to a total of 8 slips. The applicant also proposes to accommodate these slips by excavating a 3,360-sf area (60-ft by 56-ft) of the harbor bottom for these 4 new slips. The water depths in this, area currently range between 3-ft to 6-ft below the NWL. The applicant proposes to commence excavation at the existing 3-ft water depth, about 20-ft offshore, and dredge to a 10-ft, below NWL depth. This 10- ft water depth.is proposed to match the existing water depths of the neighboring slips and the harbor channel. Anticipated Impacts This project does not propose any development for non-water dependent uses. The principle anticipated impacts from this project are associated with the proposed 3,360-sf of harbor excavation, the mooring encroachment into an adjacent riparian setback area, and the approximate 150-1f of bulkhead alignment and the coastal wetland losses that will result from this bulkhead alignment. This alignment will result in the loss of 750-sf of coastal wetland habitat. This bulkhead alignment will also result in the probable loss of the remaining coastal wetland fringe waterward of this alignment. According to this application, this proposed bulkhead alignment would result in the placement of approximately 22-cy of fill material below the NWL. The proposed dredging will result in the removal of approximately 187-cy of material from the water bottom near the shoreline. The dredge depth of the proposed excavation area will not exceed the connecting water depths of the adjacent harbor channel. This excavation will not directly result in the loss of any SAV's or shallow water habitat. The proposed dredge spoil retention structure will be located landward of the Coastal Shoreline Buffer. The proposed boardwalk, access walkway and finger pier alignments will result in the shading of approximately 70-sf of coastal wetlands. Also, portions of the proposed walkway, one finger pier, one mooring piling, and one slip will encroach into the adjacent riparian setback to the east. According to correspondence signed July 10', 2002, included with the application, this adjacent riparian neighbor, Desmond R. Foster, Jr., appears to have no objection to the project as proposed, and appears to waive any right of objection to work or placement of these structures within the riparian setback. Jack T. Branch, Dare County FIELD INVESTIGATION REPORT Page C The overall land disturbance associated with the proposed bulkhead and associated land disturbing activities will result in impacts to an area approximately 11,250-sf.of Estuarine Shoreline. This development will impact a combined area of about 4,100-sf of Estuarine Waters/Public Trust Area and Coastal Wetlands, and a total of 0.353 acres of waters, wetlands, and land area within the Estuarine System of the Pamlico Sound. The most significant, anticipated loss associated with this project would be the loss of over 750-sf of coastal wetlands. An inspection of mapping data on cultural resources revealed that archaeological or cultural resource findings in the vicinity of this project have been recorded on the available maps. It is important to note that Hatteras Island has a rich heritage in cultural resources, and these maps have not been updated in at least 10 years. Submitted by: Dennis W. Hawthorn Date: September 9, 2002 PROJECT NARRATIVE Branch CAMA Major Hatteras, North Carolina RECEIVE 'AUG 2 2002 COASTAL MANAGEMENT ELIZABETH CITY The purpose of this document is to provide a narrative description of the proposed project. The subject property is an approximately 17,696 sf parcel of land located at the end of Saxon Cut Drive adjacent to the Pamlico Sound in Hatteras, Dare County, North Carolina. The project proposes the construction of 144 linear feet of bulkhead, a 6' wide by 82' long dock with 4 boat slips for the private use of the residents of the property. Also propos4 is the dredging of an area approximately 60'x 56' to provide additional water depth for the proposed boat slips. The subject parcel of land is a subdivided lot that is situated on Harbor Village Creek and is bordered by numerous existing commercial and recreational boat slips and marina facilities. Currently there is 70 linear feet of dock and 4 boats slips located on the western end of the property. Approximately 85' of the existing shoreline is protected by concrete rip rap while the remaining portion has no shoreline protection at this time. The two adjacent properties have a bulkheaded shoreline and currently have boat slips and docking immediately adjacent to the subject property. The proposed project will provide four additional deep water boat slips as well as provide shoreline protection for the property. The proposed bulkhead will be 144 linear feet, and tie into the existing adjacent property bulkheads to the east and west. Also proposed is a 6' wide dock that will extend from the existing dock and provide access to the boat slips and walkway to the property. The project also proposes to excavate an area in the creek 60' wide by 56' (3,360 sf) waterward from the proposed dock alignment to a depth of 6' at the dock edge to a maximum depth of 10'. The excavation depths proposed will match existing depths found in the adjacent property boat slips and the average maximum depth in the center channel. The proposed bulkhead will be constructed waterward of the existing rip rap and tie into the existing bulkheads on the adjacent properties. This bulkhead alignment and associated backfill will impact 400 sf of coastal wetlands on the subject property. The remaining 1,200 sf of coastal wetlands will remain undisturbed and will not be impacted by the proposed excavation which will take place waterward of the proposed dock. The proposed excavation will produce approximately 187 cubic yards of material which will be contained on the property in a 100' by 40' area located landward of the 30 ft. buffer.
