This letter shall act as your approval for the use of the "General" Major Variance; From the Neuse and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management Commission (EMC) on May 10, 2001. In addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control and CAMA permits. This approval shall expire when the variance expires on April 11, 2006 unless the variance is renewed before that time by the EMC. This approval is only valid for the purpose and design that you described in your variance request. If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. Conditions: 1. Certificate of Completion - Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer Rules, and any subsequent modifications, the applicant is required to return the attached certificate of completion to the 401N1letlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. 2. Diffuse Flow -All new stormwater drainage shall be directed to vegetated areas as diffuse flow at non-erosive velocities prior to entering the protected riparian buffers as identified within 15A NCAC 2B :0233(5). No new ditching or piping of stormwater through the protected buffers is allowed. 3. Deed Notifications - Deed notifications or similar mechanisms shall be placed on all properties and lots with retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. The required area of mitigation to compensate for impacts to the protected riparian buffers is 671 square feet as required under this Variance Approval and 15A NCAC 26.0260. We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC Wetlands Restoration Program (WRP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 26 .0260(7), this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0259(9)(C). Until the WRP receives and clears your check (made payable to: DENR - Wetlands Restoration Program Office), no impacts specified in this Authorization Certificate shall occur. Mr. Ron Ferrell should be contacted at (919) 733-5208 if you have any questions concerning payment into the WRP. You have one month from the date of this approval to make this payment. For accounting purposes, this variance approval authorizes payment into the Riparian Buffer Restoration Fund to compensate for 671 ft2 of required riparian buffer mitigation for impacts to 671 ft2 of protected riparian buffers; 03-03-13 river and subbasin, 29-(40.5) stream index number." If you choose not to make this payment, then the DWQ will accept an alternative form of mitigation (such as restoration or enhancement) pursuant to 15A NCAC 02B .0260. If you choose this option then a final, written buffer mitigation plan shall be submitted to and approved in writing by the Division before the impacts specified in this variance occur. The buffer mitigation plan must include plans and specifications according to 15A NCAC 02B .0260. 5. Protective Fencing The outside buffer boundaries and along the construction corridor within these boundaries approved under this authorization shall be clearly marked with orange fabric fencing (or similar high visibility material) for the areas that have been approved to infringe within the buffer. This fencing shall be installed prior to any land disturbing activities to ensure compliance with 15A NCAC 26 .0259. The protective fencing should be removed once construction is complete. If you do not accept any of the conditions of this approval, you may ask for and adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition that conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-6714. This approval and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under the Tar-Pamlico River Riparian Buffer Protection Rules (15A NCAC 2B .0259 (9)(b)). Question 4 (1) The owner and family have owned the property for over 50 years. The current regulations have significantly limited the use of the property. By following the existing regulations the property becomes unbuildable without the issuance of a variance for the proposed project. In the process of following these new requirements and their exceptions, we hope to forever outline the use of this property in accordance with the new guidelines. Question 4 (2) The property of over 74,947 sq.ft. is comprised of 80% coastal marsh in front adjacent to John Gaskins Drive, and 13,740 sq.ft. of uplands that are adjacent to the Pamlico Sound. The current regulations did not anticipate this type of property or situation, therefore these hardships result in the variance request. Question 4 (3) The economic hardship associated with this project is directly related to the strict interpretation of the Tar-Pamlico Buffer Rules that are currently in place. A sound front property located on Ocracoke Island has a significant value associated with it and as a result of the existing rules the property would have very little value because a residence can no longer be constructed without the issuance of a variance.
