Flynn 700 Skipjack Lane Kill Devil Hills, NC, 27948 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Flynn: You have our approval, in accordance with the attached conditions, to fill 0.027 and shade 0.02 acre of vegetated and non- vegetated wetlands in order, to construct a bulkhead, pier, dwelling, driveway and septic system on your property in Dare County, as described in your application received by the Division of Water Quality on September 10, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at htto://h2o.enr.state.nc.us/newetiands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, ypu should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below: 1. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed. l If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. PROJECT SUMMARY: The applicant Eugene Flynn proposes to construct 80 linear feet of bulkhead a maximum distance of 2' waterward of normal water level, construct a 5'x 120' pier with a platform and gazebo; construct a dwelling, a driveway and a septic system at 100 Sunrise Lane, Swan View Shores, Dare County. Approximately 1,147sf of Section 404 Wetlands, and 60sf of Coastal Wetlands, will be filled in conjunction with the project. Eugene Flynn Field Report Page 2 PROJECT SITE The applicant's property is located at 100 Sunrise Lane, in Swan View Shore, on Colington Island, Dare County. The property is 26,255sf in area with three pockets of Section 404 Wetlands totaling 2,132sf, and an intermittent Coastal Wetland fringe of salt meadow hay (Spartina patens) approximately 60sf in area. Other vegetation found on the site includes, but is not limited to, live oak (Quercus virginiana), loblolly pine (Pinus taeda), poison ivy (Toxicodendron radicans), common reed (Phragmites communis), soft stem bulrush (Scirpus validus), groundsel tree or groundselbush (Baccahris hamifolia), greenbrier (Smilax bona-nox), wax myrtle (Myrica cerifera), and red bay (Persa borbonia). The property is a heavily vegetated rectangular lot with approximately 80 linear feet of shoreline, located adjacent to a street cul-de-sac. The average elevation of the lot is approximately three feet above normal water level and is within a designated AE (EL9) Flood Zone. On the northwest and southeast sides of the property, there are developed residential lots, and to the southwest is the Albemarle Sound. The shoreline along the applicant's property has a distinct erosion escarpment with a riprap alignment one to two feet waterward of the escarpment. The rock alignment was placed at and landward of NWL. Riprap along the property has a low profile with a base width of only three feet. There is evidence of little to no erosion landward of the riprap alignment. According to the application, water depths adjacent to the applicant's property are approximately three feet 120' waterward of normal water level (NWL). Staff measurements indicate that the water depth is closer to two feet at a distance of 120' offshore. Waterward of the riprap the water bottom is sandy with a gentle slope, and has no evidence of submerged aquatic vegetation. The rock riprap alignment was approved via CAMA Major Permit #110-00, and was issued to the previous owner, George Mendelson. Shoreline protection along this section of Swan View Shoresvaries from natural barriers, to bulkheads and riprap. Two lots northwest of the site there are no erosion control structures, while on the neighboring lot, there is a bulkhead (issued to William Bowling Permit #35-01). On the southeast side there are six contiguous lots that have received permits to place riprap along the shoreline for erosion control, the last three lots belonging the Sterling Webster, who also received a CAMA Major Permit #180-00. Albemarle Sound is classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for the Albemarle Sound is SA (shell fishing). Additional review indicates that there are no known geological formations associated with the applicant's property. PROJECT DESCRIPTION The following development has been proposed: 1) Bulkhead: The applicant, Eugene Flynn, proposes to construct an 80 linear foot bulkhead, a maximum of two feet waterward of NWL, along the northwest corner, with the remaining bulkhead being placed at NWL. Approximately 10sf of shallow water habitat and Estuarine Water will be filled, and result in the placement of one cubic yard of fill dirt being placed waterward of normal water level. The bulkhead will tie into an existing bulkhead on the northwest side and terminate at the property line on the southeast corner, at a return wall. Backfill will result in the loss of approximately 60 sf of Coastal Wetlands. Eugene Flynn Field Report Page 3 2) Construction of a Pier and Platforms: The applicant proposes to construct a 5'x 120' wooden pier with ;floating platform in the approximate center of the pier, and an octagonal gazebo on the waterward end. The proposed gazebo will be 174sf and the kayak platform will be 125sf, for a total area' of 299sf. The total area to be shaded by the proposed pier and platforms will be 889sf i 3) Section 404 Wetland Fill: The applicant proposes to fill two areas of Section 404 Wetlands on the property for a total 1,147sf. Approximately 51 sf will be within the 30' buffer and 10 sf will be outside of the 75' Estuarine Shoreline Area of Environmental Concern (AEC). 4) Construction of a Dwelling, Garage, Driveway and Septic System: The applicant proposes to construct a dwelling, of which approximately 809sf of enclosed area and 657sf of open deck, will be within the Estuarine Shoreline AEC. No development is proposed within the 30' buffer. Total impervious surface being proposed within the AEC is 13.1%. Anticipated land disturbance based on the site plan submitted will be approximately 10,375sf. If approved, the total area affected will be 14,000sf of land disturbance, 10sf of shallow water habitat/Estuarine Water fill and 889sf of shading from the proposed waterward development, for a total of 114,899sf. ANTICIPATED EWIPACT • Approximately 12,793sf of high ground disturbance, including filling and grading, will be undertaken in association with the construction of the proposed bulkhead, dwelling, garage and associated infrastructure. Approximately l Osf of shallow water bottom and Estuarine Water will be filled in association with the, construction of the bulkhead. • Approximately 1,147sf of Section 404 and 60sf of Coastal Wetlands will be filled in association with the proposed development. • It is estimated that 889 square feet of Estuarine and Public Trust Waters will be shaded by the proposed pier, platform and gazebo. • Temporary localized turbidity will occur during construction of the bulkhead and pier system. • A reduction in shallow water habitat is anticipated if the bulkhead is approved and the riprap removed. Submitted By: Lynn Mathis Date: September 4, 2002 PROTECT NARRATIVE AUG 2 0 2002 COASTAL NIANAGEMENT ELIZABETH CITY The project is located on Lot 40, Swan View Shores Subdivision, Atlantic Township, Dare County, North Carolina and is owned by Eugene Flynn. The property address is 100 Sunrise Lane, Kill Devil Hills, NC 27948. The property fronts the Albemarle Sound and is surrounded by residentially developed lots. The property consists of approximately 24,132 SF of wooded and grassy uplands and 2,123 SF of Section 404 wetlands as confirmed by the US Army Corps of Engineers (USACE). There are three separate areas of wetlands as shown on the accompanying site plan. Also shown on the site plan is a mature and healthy live oak with a large canopy and branches that splay in all directions from the base. Normal Water Line (NWL) as confirmed by NCDENR, Division of Coastal Management (DCM) is shown on the site plan as a line bisecting stakes NW-1 through NW-4. Existing along NWL is a line of rock rip rap for shoreline stabilization. Also shown on the site plan is a proposed three-sided wood bulkhead that ties into the existing wooden bulkhead on the adjacent property to the north. Notice that the existing bulkhead is partially on the subject property. This was not done purposely by the adjacent riparian owner. The proposed bulkhead lies approximately 2 ft waterward of NWL on the north end, but will run along NWL across the majority of the property shoreline. A total of approximately 1 cu yd of fill material is proposed to be placed waterward of the current NWL during bulkhead construction. On the south side of the bulkhead, it proposed to run along the property boundary approximately 14 ft to aid in stabilization. Site.investigation by DCM indicates approximately 60 SF of intermittent coastal wetland fringe indicated by Spartina patens growth. After construction, the bulkhead is to be backfilled for increased stabilization. This will disturb the intermittent coastal wetland fringe that located landward of the existing rip rap. A pile supported dock (5 ft wide) is proposed to be constructed approximately 3 ft above NWL, and is to run approximately 105.5 LF. On the end of this dock is a proposed wooden gazebo, that makes the entire length of the dock and gazebo stretch 120 LF from the proposed bulkhead. The gazebo is proposed to be octagonal with an area of 174 SF. In addition to the gazebo, there is a proposed floating wood platform (125 SF) for canoe and kayak access to the Sound. Water depths gently increase from the shoreline to about 3 ft to 3.5 ft at the end of the proposed dock during normal tidal conditions. A Major CAMA Permit is required for this project due to the proposed backfill of 1,147 SF (0.026 SF) of Section 404 wetlands within the 75 ft Estuarine Area of Environmental Concern (AEC). This area is shown on the site plan and includes two separate shaded areas (1,042 SF and 105 SF respectively). A Nationwide #18 Permit application has been submitted to USACE for this proposed backfilling. The backfill material will come from a sandy off-site source. The need for this backfill is to provide adequate space for the proposed house in between the shoreline and the live oak growth. The adjoining property to the north has received a fill permit for the previously connecting wetland area on that property, which may now tend to direct stormwater runoff onto the subject parcel. This backfill will prevent standing water from collecting for an extended time after storm episodes with high amounts precipitation or overwash. This work is to be performed with dump trucks and a back hoe. Residential construction is also included in this Major CAMA Application. The maximum building footprint is shown on the site plan. On the waterward side of the house is a proposed open, slotted wood deck. The total impervious coverage within the AEC is 809 SF (13.1%). This coverage will not be exceeded, but may actually become less if the scale of development is lessened. Also included as a component of this project is garage, driveway and on-site septic system installation.
