Dear Mr. Dischinger;
The Division of Water Resources (Division) is in receipt of your responses to a Notice of Violation issued
by this Division on March 20,2 020. The response proposes to restore the original grades of the riparian
buffer and to stabilize the area with temporary and permanent seeding immediately upon removal of
the required erosion control measures. In addition, the restoration plan specifies planting native
hardwood species within Zone 1 of the riparian buffer by February 28, 2021.
The Division approves the proposed buffer restoration plan with the following additional requirements:
1. You shall notify the Division upon completion of the Zone 1 buffer tree planting activities.
Upon completion of the buffer restoration activities the areas shall be visually monitored twice a
year for three (3) years for buffer replanting success. Tree vigor and survival shall be monitored
and trees that do not survive shall be replanted at the next appropriate planting season. The
Division shall conduct a final inspection of the restoration areas at the conclusion of the
monitoring period and may require additional planting or an extended monitoring period if the
buffer restoration is unsuccessful.
Thank you for your attention to this matter. The Division requires that the violations, as detailed above,
be abated immediately and properly resolved.
Pursuant to G.S. 143-215.6A, the above -mentioned violations and any future violations are subject to a
civil penalty assessment of up to a maximum of $25,000.00 per day for each violation. Your above -
mentioned response to this correspondence will be considered in any further process that may occur.
