Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The site is located off of Factory Road in Pander County, NC. It is located adjacent to the AIWW and a recently constructed channel and upland basin marina extend from the AIWW into the southern part of the site. Wetlands extend above the open water channel in the southern part of the site and support black willow and wax myrtle in the shrub layer and cattails, rushes, and pennywort in the herbaceous layer. A stream is located in the eastern portion of the site. Several small wetlands drain into this channel in the central and eastern part of the site. These wetlands support a sparse canopy of black gum and sweetgum, with sweetgum and wax myrtle in the shrub layer and a dense assemblage of sedges, pennywort, and ferns in the herbaceous layer. A linear network of ditches extends throughout the site and intersects the stream bed. Phase 1 of the overall site area (southern and eastern portions of site) has been cleared of vegetation and is currently being developed into a marina and single family homes. Authorized wetland impacts have been installed. Phase 2 of the project area is mostly uplands and consists of a loblolly pine plantation. Adjacent land use to the north, east, and west is residential. Some forested areas epst to the southwest and the AIWW is located to the southeast. V 4b. Explain the purpose of the proposed project:* The purpose of the project is to construct Phase 2 of the Salters Haven Subdivision. Phase 1 of the project was recently authorized and site development has begun. Because of market demand for residential lots within a marina community, the developer plans to begin selling Phase 2 lots quickly. A wetland impact is needed to widen an existing road crossing. Other jurisdictional channel (non -stream) impacts are needed for road crossings, lot development, and installation of a stormwater pipe. Impacts to a stream are needed to replace a culvert under Factory Road (required by NC DOT). 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The residential subdivision will contain a total of 308 lots (119 lots in Phase 1 and 189 lots in Phase 2) single-family lots, a clubhouse with amenities, and an upland basin marina. Roads, utilities, and stormwater ponds are also proposed. The limits of disturbance will be cleared of vegetation. Roadways and utilities will be installed. Then home construction will occur. Track hoe, loader, dump truck, bob cat, and other standard construction equipment will be used. Additionally, NC DOT is requiring the developer to upgrade the culverts that currently run under Factory Road because of Phase 1 development. They need to replace the existing 30" and 24" culverts with two 48" culverts. In addition to replacing the culverts, they will install 20 LF of riprap on the downstream end and are also proposing 15 LF of temporary impact for construction access. 4j. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts were minimized as much as possible during the site design. The wetland impact for Phase 2 is needed for a road crossing. This crossing has been positioned at an wasting crossing to minimize impacts. Since there will only be a small of wetland remaining above the road, the entire pocket was considered impacted. Several jurisdictional channels extend into the site and impacts were needed to make the adjacent uplands buildable (for lots and pond). The stream impact is a requirement of NC DOT and is needed to replace and upgrade existing culverts under Factory Road. 1b. The NC Natural Heritage Program database was used to determine the presence of rare species. According to their files, there are no known observations of federal (or state) protected species on the site. Two federally -protected species, the Atlantic sturgeon and the West Indian manatee, are known to occur within a one mile radius of the site, likely within the Atlantic Intracoastal Watennay located just southeast of the site. LMG evaluated the site in 2018 and determined that it did not provide suitable habitat for most federally -listed species known to occur in the area. However, forested areas within the site may support appropriate roosting habitat for the northern long-eared bat. Since no hibernacula or roosting trees are known to occur in close proximity to the site, any effect to the species from tree clearing would be exempt per the 4(d) rule.
