Kyle Ward W & W Partners 1000 Darrington Drive, Suite 105 Cary, NC, 27513 APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules with Additional Conditions, Wetland Restoration Program Dear Mr. Ward: You have our approval, in accordance with the attached conditions, to place permanent fill in 0.4464 acre of riparian wetlands and 36 linear feet of intermittent streams and to impact 8,478 square feet of protected Neuse Buffers in order to construct the Princeton Manor residential subdivision in Wake County, as described in your application received by the Division of Water Quality on September 4, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3362, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Nationwide Permit Number 39 when issued by the U.S. Army Corps of Engineers. This approval is also valid for the Neuse River Buffer Rules (15A NCAC 213.0233). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification as well as the additional conditions listed below: 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands ; 2. An additional condition is that stormwater shall be directed to flow in a diffuse manner at non-erosive velocities through the entire protected stream buffers without re-concentrating; 3. The outside buffer, wetland or water boundary and along the construction corridor within these boundaries approved under this authorization shall be clearly marked by orange fabric fencing for the areas that have been approved to infringe within the buffer, wetland or water prior to any land disturbing activities to ensure compliance with 15A NCAC 26 .0233 and General Certification 3362; 4. We understand that you have chosen to contribute to the Wetland Restoration Program (WRP) in order to compensate for the impacts to wetlands in order to obtain the necessary 404 Permit for this project. Please note that wetland mitigation is not required by DWQ for this project since cumulative impacts associated with this project fall below the one-acre mitigation threshold. Until the Wetland Restoration Program receives and clears your check (made payable to: DENR - Wetlands Restoration Program), wetland impacts (including fill) shall not occur. Please refer to the attached USGS map, which displays the property. Ms. Amanda Jones of the USACE approved the wetland delineation of the site on April 24, 2001 (Action ID #20012766). Mr. Bob Zarzecki of the NC- DWQ confirmed the buffer start points on November 15, 2000. A copy of Mr. Zarzecki's letter (DWQ Project #00-1457) is attached. The attached impact map reflects the boundaries of both determinations. Impacts 1, 2, 3, 4, and 7 result from proposed roads needed to provide access to the property. The only buffer impacts on property are also from road impacts. Impacts 5 and 6 result from proposed lot fill required for lots 177, 393, 394, and 395 (see maps). Proposed impacts for the project will total 0.4464 acre of wetland, 36 linear feet of intermittent stream, and 8,478 ft2 (0.1946 acre) of riparian buffer impact. The wetland area north of Impact 5 and east of Impact 7 (see map) had originally been planned for three lots and would have required fill. The plan was revised to avoid impacting this wetland area and will now designate this area as open space. The client requested a detailed delineation of the property prior to developing site plans in an effort to minimize an avoid impacts to the maximum extent practicable. All other wetlands and stream channels on property have been avoided. The areas between the power line easement and the railroad line do not have any impacts proposed. The one proposed stream crossing (Impact 7), impacts only 36 linear feet of intermittent channel. Buffer impacts resulting from this crossing total 8,478 ft2 (4,707 ft2 in Zone 1 and 3,771 ft2 in Zone 2). Current DWQ policy does not require buffer mitigation if buffer impacts do not exceed 1 /3 acre per stream channel. Because the one proposed buffer impact has buffer impacts September 4, 2002 S&EC Project #: 00-5705 Page 3 of 3 totaling less than 1/3 acre (i.e. "allowable" activities), no buffer mitigation should be required for this project. The Town of Knightdale has adopted a nitrogen reduction plan to treat stormwater and reduce the amount of nitrogen entering streams via stormwater. Because of this, no cumulative impacts to the watershed should occur as a result of the completion of this project. The USACE has requested wetland mitigation for the impacts using a 2:1 ratio. Explain the purpose of the proposed work: The proposed subdivision will provide additional housing for the expanding Knightdale area. The proposed roads will provide access to home lots on the property. IV. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. An additional portion of property is on the eastern side of Hodge Road however no site plans have been proposed at this time. Portions of the property south of the trail tracks will most likely not be used do to the lack of access and the relatively small amount of usable area. No additional permits are known to be required at this time. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. Impact Justification (Avoidance and Minimization) Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The iurisdictional features were delineated prior to the site Man development in order to avoid impacts to the maximum extent practicable. The delineation was approved on April 24, 2001 by Ms. Amanda Jones of the USACE (Action ID #200120766). The Neuse River Riparian Buffer determination was made on November 27, 2000 by Mr. Bob Zarzecki of the NC-DWQ (DWQ Project #00-1457). The distance between the two required roads intersecting with Hodge Road was detennined by the Town of Knightdale. The position of the southern most access road was shifted further south than the originally proposed location in an effort to utilize a portion of upland and minimize the amount of impacts to the wetland area. Page 5 of 9 Three earlier proposed lots were abandoned in the area adjacent to impacts 2 and 3. The abandoned area will not be used as home lots. Where possible, wetlands and jurisdictional drainages, including buffered channels, were placed at the back of lots in an effort to avoid impacts. VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/sti-l,ngide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Payment to the NC-Wetland Restoration Program is proposed to mitigate for impacts to wetlands. Ms. Amanda Jones of the USACE is requiring a 2:1 mitigation ratio. This will require a total of 0.8928 acre of mitigation. Because the NC-WRP uses % acre increments, 1 acre of wetland mitigation will be required. No stream mitigation or buffer mitigation is proposed or should be required because impacts are below mitigation thresholds (i.e. stream impacts are less than 150' and buffer impacts are less than 1/3 acre). Project # 00-5705 Mingo (Mango) Creek [03-04-02; 27-32; C NSW] Dear Mr. Clark, On November 15, 2000, I met with you at the subject property located along Hodge Road (SR2516), north of Mingo (Mango) Creek and west of the Neuse River, Knightdale, Wake County. The purpose of this meeting was to determine the applicability of stream features located on the property to the Neuse River Riparian Buffer Protection Regulations (15A NCAC 2B .0233). As a result of this meeting, in addition to information provided within your letter dated 11/15/00, it was determined that the stream features indicated on the "W&W Partners / Knightdale Site Project #00-5705" map provided as an attachment to your letter dated 11/15/00 and initialed by me on 11/27/00 are subject to 15A NCAC 2B .0233. The map indicates streams "1, 2 and 3", including the approximate location of the start of two streams (1 and 2), subject to the buffer regulations as confirmed and flagged in the field on 11/15/00. The stream indicated as "3" is subject from somewhere north of the northern property line to the southern property line. The drainage features "A, D, E, F, G and I" on the attached Wake County Soil Survey are indicated containing streams within them. However, it was determined during our site visit that no "surface waters" subject to the riparian buffer protection rules actually exists within them. This office recommends that the subject streams be properly located and identified prior to any site design to ensure compliance with 15A NCAC 2B .0233. This letter only addresses the applicability of 15A NCAC 2B .0233(3) and does not authorize any activity within the protected buffers.
