Sullins, Director Division of Water Quality Subject: Intent to Store Ethanol, Tank #10 NPDES Permit NCO004839 Charlotte Terminal 2 Mecklenburg County The Division of Water Quality (the Division) received your site map and letter of July 30 stating your intent to store ethanol in bulk at the subject facility. A permit modification is not required. We understand that you intend to store this new fuel product in existing Tank #10 and monitor any potential environmental impact utilizing your existing Water Pollution Prevention Plan under the subject NPDES permit. The Division concurs with your assessment that changing the contents from petroleum to ethanol in Tank #10, as monitored through permitted Qutfall 001, does not require a formal modification of your existing permit. The change in contents is necessary to support ethanol storage and loading activities at the referenced facility. The attached site map identifies the location of Tank #10 (indicated by a yellow star). Stormwater Outfall 001 (also denoted on site map) receives stormwater from the bermed area that contains Tank #10. Per the requirements of existing NPDES Permit No. NC0004839, Outfall 001 is currently monitored on an annual basis for acute toxicity. Since Tank #10 is an existing tank (Le. not newly constructed) and acute toxicity monitoring is currently performed at the NPDES outfall associated with the bermed area that contains Tank #10 (Outfall 001), it is our understanding (per communication with NCDENR - Division of Water Quality personnel) that changing the contents of a tank from petroleum to ethanol does not require a formal modification to the existing permit.
