Box 1877 Kill Devil Hills, NC, 27948 APPROVAL of 401 Water Quality Certification with Additional Condition Dear Mr. Dorman: October 15, 2002 DWQ# 02-1344 Dare County You have our approval, in accordance with the attached conditions, to fill 0.028 and shade 0.024 acre of coastal wetlands and estuarine waters in order to install a boat ramp and courtesy dockage along the shoreline of a tributary to the Pamlico Sound in the Windover Waves Subdivision in Dare County, as described in your application received by the Division of Water Quality on August 22, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge, Water Supply Watershed and U.S. Coast Guard regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). PROJECT SUMMARY: This project involves the installation of a boat ramp and courtesy dockage along the shoreline of a tributary to the Pamlico Sound in Wind Over Waves Subdivision in Waves, Dare County. C., Dare County FIELD INVESTIGATION REPORT Page 2 7 Proiect Settiniz The application site is located between lots 24, 33 and 35, one block west of NC 12 at the end of on Otter Way, Wind Over Waves Subdivision, in the Village of Waves, Dare County, along the easement to a small coastal creek that connects to the Pamlico Sound. Otter Way is a paved cul- de-sac. Several large homes are being constructed in this subdivision and in the vicinity of the proposed project. This property is a vacant lot with no improvements. According to the platwork and application submitted, the site consists of a 29,007-sf lot, with over 700-1f of shoreline along a small coastal creek and the Pamlico Sound. The submitted platwork and North Carolina General Warranty Deed provided with the CAMA application indicate this property is owned by Wind Over Waves, L. L. C. of Kill Devil Hills, NC. The submitted platwork indicates that the proposed development is located within a 30-ft easement. However, the submitted North Carolina General Warranty Deed does not describe or mention this easement area. The application lists properties owned by David P. Farrow and Valerie A. Reese, lots 24 and 35, respectively as the adjacent riparian property owners. A review of the submitted application platwork indicates that the property owner of lot 33 may also be an adjacent riparian property owner, or may be the correct adjacent property owner instead of lot 24, owned by V. A. Reese. The owner of lot 33 is BGR development (i. e., Billy G. Roughton) and is a related partner to the Wind Over Waves, L. L. C. In this regard, the applicant's agent notified V. A. Reese as the next adjacent riparian neighbor to the proposed development. This lot has a level grade and has a reported elevation of 3.5-ft above the NWL. The soils on this lot are sandy with organic-hydric type soils found between the shoreline and a distance of 10 to 20-ft from the shoreline. This lot is vegetated in both upland grasses, as well as many facultative- wet and obligate wetland plant species. Much of this parcel is vegetated with Spartina patens. The entire shoreline of the parcel is vegetated in coastal wetland fringe. Some `404' wetland vegetation is located along the landward portions of this coastal wetland fringe. The coastal wetland fringe varies in width between 2-ft and more than 30-ft, and is much narrower along the south side of the creek. The eastern side of the parcel is vegetated in a thick wetland fringe that includes Juncus roemerianus, Spartina alterniflora, Scirpus spp., and Spartina patens. This fringe extends in a northeast direction off the parcel and into the adjacent lot 33. Due to wind tides, these wetlands receive regular flooding from the connecting waters of the Pamlico Sound. These wetlands have also been recently impacted by aggressive mowing that resulted in land disturbance that actually resulted the grade along the shoreline being lowered in some areas. Upland plant species on the parcel include wax myrtle, live oak and eastern cedar. No water dependent structures are located on this or any immediately adjacent properties. A community walkway and dock-platform are located approximately 400-ft south of this site. The creek width varies between 60 and 80-ft, and has an approximate length of 300-ft. The water depth in the creek varies between NWL and 3.5-ft, and the average depth is about 2.0-ft below the NWL. The slope is gradual at the east end of the creek from NWL to about 1-ft at a distance of 5- ft offshore. The water bottom consists of predominately sand with some organic material. Some areas of submerged aquatic vegetation were observed along the water bottom of the creek during the application site visit. Available records do not indicate any previous dredging or below NWL excavation along this tributary. . Wind Over Waves, L. L. C., Dare County Page 3 FIELD INVESTIGATION REPORT The waters of this tributary carry the same water classification as the Pamlico Sound. The North Carolina Environmental Management Commission has designated these waters as `SA' waters (suitable for shellfish propagation and harvesting); however, the waters in this vicinity are closed to the commercial harvest of shellfish. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of the Pamlico Sound as Coastal Waters. During the site investigation, no shellfish were observed along the water bottom in the vicinity of this project. Juvenile finfish were observed within the waters and wetlands along the shoreline, as well as some crustaceans and shore birds. The Coastal Resources Commission (CRC) has also designated these waters as Estuarine Waters and Public Trust Areas of Environmental Concern (AEC). Also under the designation of the CRC, a Coastal Shoreline AEC extends in a contour of 75 ft landward of the NWL. The CRC has also designated coastal wetland vegetated areas, like the one described above, as a Coastal Wetland AEC. Project Description Wind Over Waves, L. L. C. is the applicant for this CAMA Major Permit application. The application proposes to construct a concrete boat ramp, and shoreline and courtesy dockage along the shoreline creek portion of the parcel. The facility will be for the private use of the subdivision residents and their guests. A concrete boat ramp is proposed along the southeastern corner of the parcel, and will connect to Otter Way with a drive from the street to the shoreline. The over all length of the boat ramp and its approach drive will be a total of 97-ft long, and will be 20-ft wide. The ramp will extend approximately 10 ft into the waters of the creek. According to the submitted platwork, the water depth at the proposed end of the ramp will be 3.0-ft below the NWL. No return walls are indicated on the submitted platwork for the ramp. This application does not propose any fill, excavation, or shoreline stabilization to construct, align, or protect the ramp gradient. The applicant also proposes to construct two 6-ft wide docks adjacent to the proposed ramp. The dock to the north of the ramp is configured as an `L' tilted 90 degrees clockwise with 10-ft of the structure aligned along the ramp, and 40 -ft of the dock aligned along the shoreline to the north. The dock to the south of the ramp will have a 22-ft long section adjacent to the ramp that will extend out into the creek to the end of the ramp, and then turn counterclockwise to the west. This section of the dock will be aligned along the shoreline, extend about 6-ft beyond the NWL, and will be approximately 130-ft long. This portion of dockage will be within the riparian setback of lot 35. This proposal does not include any excavation of the adjacent water bottom areas. Wind Over Waves, L. L. C., Dare County Page 4 FIELD INVESTIGATION REPORT Antidp& Impacts The boat ramp alignment is proposed to cross the existing coastal wetland fringe. The ramp will transect a portion of the existing coastal wetland fringe that is more than 15-ft in width. Since this wetland fringe was recently disturbed, and is currently being restored through a DCM Notice of Violation and Restoration Agreement, it is difficult to estimate the current fringe width, but the area directly adjacent to the proposed ramp location has an existing wetland fringe well over 20-ft in width. Estimating the proposed ramp location has a wetland fringe 30-ft in width (the platwork shows 40-ft), and using a ramp impact width of 35-ft (based upon a diagonal measurement across the proposed ramp area), the ramp will displace over 1,000-sf of coastal wetland vegetation, and the habitat within this area. In addition, this proposed development would likely impact the adjacent remaining coastal wetland fringe. The current ramp location would probably also result in future dredging proposals to deepen the creek, especially in the eastern-most end of the creek. The proposed courtesy dockage and walkways will also result in some shading (960-sf) of the coastal wetland fringe, but most of this dockage will be aligned slightly waterward of the NWL. If these structures are elevated at least 3-ft above the wetland substrate, the resulting shading should not significantly impact these wetlands. The ramp will result in the placement of 200-sf of fill within the Public Trust Area and Estuarine Waters-water bottom habitat. The boat ramp will also result in the placement of about 4-cy of fill (concrete slab) below the NWL. The overall land disturbance within the Coastal Shoreline, associated with the boat ramp structure will be approximately 900-sf. This project, as proposed, will impact over 2,100-sf of Coastal resources within the Estuarine System. An inspection of mapping data on cultural resources revealed that an archaeological or cultural resource site has been recorded on the available maps in the vicinity of this project. It is important to note that Hatteras Island has a rich heritage in cultural resources, and these maps have not been updated in at least 10 years. The potential for the discovery of additional cultural or historical resources is possible. The proposed boat ramp and dockage, although within an `easement', will be within 15-ft of the adjacent properties. This project, as proposed, may infringe upon these adjacent riparian landowners Public Trust Area uses. The ramp structure, as proposed in this application, will also cross and be located near the widest portion of the coastal wetland fringe along the shoreline of this parcel. If the ramp were located in an area where the fringe is only 2-3-ft wide, the wetland and habitat loss impacts would be reduced. This would also locate the ramp farther away from the remaining marsh area that is currently being significantly impacted by the adjacent subdivision development. Submitted by: Dennis W. Hawthorn Date : August 19, 2002 PROJECT NARRATIVE Windover Waves, LLC LAMA Major Waves, North Carolina The purpose of this document is to provide a narrative description of the proposed project. The subject property is an approximately 29,907 sf parcel of land located at the end of Otter Way adjacent to the Pamlico Sound in Waves, Dare County, North Carolina. The project proposes the construction of a boat ramp and 208 linear feet of dock for the private use of the residents within the Windover Waves subdivision. The proposed boat ramp will be located in the open space of Phase 1 in the Windover Waves subdivision and accessed through an easement located between lots 33 and 35. The boat ramp access will begin at the edge of the existing asphalt and a concrete ramp will extend into the adjacent waters approximately 20' to reach the adequate water depth for boat launching and retrieval. A total of 785 sf of wetlands are to be impacted by the boat ramp of which 385 sf are coastal wetlands. The remaining 400 sf are section 404 wetlands and a nationwide permit will be obtained from the US Army Corp of Engineers to fill these wetlands. The reinforced concrete ramp and drive aisle will be set on top of the existing grade and the filled used for the drive aisle to the ramp will consist of sand and gravel which will also be placed over the existing grade. The existing water depths are of sufficient depth therefore no excavation is being proposed at this time. All docks proposed are 6 ft. wide and will serve as temporary docking area for boats being launched and retrieved from the boat ramp. The boat ramp is to be used by the residents within the subdivision therefore no parking is being proposed at the facility. Boats will be launched from the boat ramp and vehicles will be parked at there respective homes until needed. The orientation of the proposed boat ramp has been positioned in such a way that tries to minimize impacts to coastal wetlands and at the same time access the deeper waters within the creek.
