Thanks for the questions. Since the 401/404 submittal, we realized that the stream buffer was inappropriately shown at
the edge of the surveyed stream. The attached sheet is the revision that will be submitted to Durham County for erosion
control approval. The buffer is shown to the culvert, based on aerial data. We do not have comments/approval back
from Durham County but we received Durham County verbal approval via phone conversations about the buffer.
Also, the note on L103 is incorrectly worded, as you state, because Durham County will be the buffer authority. We
submitted to Durham County for buffer impact approval. The note was intended to refer to the stream impact
permitting and will be revised to state: "401/404 PCN has been submitted for stream impact".

Hi Patrick,
I am reviewing this project to help out the DWR Raleigh Regional Office and I have a quick question before I start my
review. The plan sheets show the start of a stream and buffer area along the channel above the upper pond. Was this
start point for buffer regulations verified by the County? Also, the plan sheet L103 notes "Buffer Disturbance Covered

Under 401/404 permitting" and I'm not sure what that means. I believe that Durham County should be the buffer
authority and make all buffer decisions/reviews.
