Dear Mr. Dorney:
We received the NCDENR Letter of Approval with Additional Conditions for Neuse Buffer
Protection issued on September 16, 2002 for the referenced project. We appreciate your timely
review and approval of our submittal. In the approval letter, a single condition was added that
states The sewer system shall comply with the Non-Discharge Rules (15A NCAC 2H .0200), ... "
The project does not include proposed construction of any sewer (sanitary) system and
therefore it is our understanding that the Non-Discharge Rules (15A NCAC 2H .0200) do not apply
and this condition is invalid. Please notify our office if this interpretation is incorrect.

APPROVAL of Authorization Certificate per the Neuse River Buffer Protection Rules (15A NCAC 2B .0233) with
ADDITIONAL CONDITIONS
Dear Mr. Windley:
You have our approval, in accordance with the attached conditions and those listed below, to impact approximately 2,400
square feet of Zone 2 of the riparian buffers to install the proposed sewer system as described within your application
dated August. 9, 2002. After reviewing your application, we have determined that this fill is covered by the Division of
Water Quality (DWQ) General Water Quality Certification Number 3374. This Certification allows you to use Nationwide
Permit No. 12 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as your approved
Authorization Certificate for impacts to the protected Neuse River Buffers as required under 15A NCAC 213 .0233(8). In
addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead
with your project including (but not limited to) Erosion and Sediment Control Permit and Non-Discharge. Also, this
approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for cgmplying with
all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 feet stream,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you
must follow the conditions listed in the DWQ General Water Quality Certification No. 3374 and any conditions listed below.
Conditions:
• The sewer system shall comply with the Non-Discharge Rules (15A NCAC 21-1.0200), General Water Quality
Certification. No. 3374 and the Neuse Buffer Rules.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act and the Neuse

Neuse River Basin Riparian Buffer Rule Approval
Dear Mr. Zarzecki:
The referenced project includes the construction of approximately 304,500 linear feet of 20", 12",
8", 6", 4", and 2" water line comprising the Buffalo Water District located north of the Town of
Selma in Johnston County, North Carolina. Several directional bores are proposed at major
creek crossings including Buffalo Creek and Little River. The majority of the water line will be
routed within road right-of-way approximately five feet from the edge of the roadway
pavement.
We have applied for a Nationwide Permit 12 from the US Army Corps of Engineers for the
proposed temporary impacts to wetlands and waters of the US. The construction of the water
line will be handled in strict accordance with the Nationwide Permit 12 and will meet all
requirements of the Water Quality General Certification. All stream crossings will be
perpendicular non-electric utility crossings within construction corridors less than 40 feet.
Therefore, we are not requesting a 401 Water Quality Certification. However, we are proposing
temporary impact to a Riparian Buffer (Zone 2) along an intermittent unnamed tributary to the
Neuse River. The proposed alignment places the water line in this buffer zone only to avoid
disturbing a significant area of wetlands that border the outer limits of the riparian buffer. We
have attached for your review, an 8-1/2" x 11" sheet that was included in the application to the
USACE representing the channel crossing where the proposed temporary impact occurs. We
have also provided a USGS Quadrangle map and SCS Soil Survey map showing the location of
the impact.
Under the North Carolina Administrative Code Section 15A NCAC 2B 0.0200, the proposed
impact is allowable without mitigation but requires notification and buffer rule approval.
We hereby request on behalf of the Buffalo Water District, Buffer Rule Approval for the
referenced project.
