The site is currently primarily undeveloped, vdth the southeast portion of the site being a parking lot and adjacent commercial building. The site is primarily uplands but is bounded by a
perennial stream to the west. The surrounding area is primarily developed as mixed use, including urban residential and commercial development.

The purpose of the project is to provide infrastructure and utilities to the 40-acre development site. The overall 40-acre mixed use development will include office, retail, apartments,
hotel, and senior living facilities.
41. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:*
The project consists of public roads, stormwater management and utility infrastructure to support a 40 acre mixed use development. Some mass grading will be completed with the
roadway infrastructure. Stornrvvater management is achieved through a wet retention basin and a level spreader with grass filter strip. Two of the smaller parcels will be treated with sand
filters. The sanitary sewer mainline that serves the site must come from the property to the west and cross the Big Branch Creek. Upon completion of the roads and infrastructure the
site will be developed into a mix of office, retail, apartments, hotel and senior living.

Impacts to Big Branch are temporary. The proposed sewer line will be connected to the existing sewer main on the western side of Big Branch using
standard open cut methods and will impact 31 linear feet. After installation of the sewer line, the stream will be returned to original grade and contours.

6i. Comments:
Buffer impacts are the result of the construction of a 30-foot wide City of Raleigh Sanitary Easement. On the proposed site (east of Big Branch), there
will be 1058 square feet of temporary impacts to Zone 2, which will be returned to original grade and contour after construction and seeded with
herbaceous vegetation. The 1,275 square feet of permanent Zone 1 impacts will result from the clearing and maintenance of the 30-foot sanitary
easement. The 742 square feet of temporary Zone 1 impacts are located within an existing City of Raleigh sanitary easement and are necessary to
connect the proposed sanitary sewer line to the existing main. All areas of the riparian buffer will be returned to original grade and contour and
seeded with an herbaceous seed mix after construction is complete.

E. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:
With the exception of the sole stream crossing necessitated for the sanitary sewer crossing, all stream and buffer impacts have been avoided within
the site. Per the City of Raleigh, the crossing is necessary in order to provide sewer to the site. The site was selected to allow for a perpendicular
crossing with minimal impacts from paralleling the stream.
1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques:
Tree Protection Fence will be installed to avoid any impacts into buffers or sensitive areas. Standard best management practices will be implemented
throughout construction including sediment basins, sediment fence, wheel wash areas and temporary storm water diversion if needed. Specific
attention will be paid to ensure grading is only performed to the extent needed for the proposed project and all grading not required will be avoided.

If your project contains suitable habitat for any of the federally-listed species known to be
present within the county where your project occurs, the proposed action has the potential to
adversely affect those species. As such, we recommend that surveys be conducted to determine
the species' presence or absence within the project area. The use of North Carolina Natural
Heritage program data should not be substituted for actual field surveys.
If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely
to adversely affect) a federally-protected species, you should notify this office with your
determination, the results of your surveys, survey methodologies, and an analysis of the effects
of the action on listed species, including consideration of direct, indirect, and cumulative effects,
before conducting any activities that might affect the species. If you determine that the proposed
action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally
listed species, then you are not required to contact our office for concurrence (unless an
Environmental Impact Statement is prepared). However, you should maintain a complete record
of the assessment, including steps leading to your determination of effect, the qualified personnel
conducting the assessment, habitat conditions, site photographs, and any other related articles.
Please be aware that bald and golden eagles are protected under the Bald and Golden Eagle
Protection Act (16 U.S.C. 668 et seq.), and projects affecting these species may require
development of an eagle conservation plan (http://www.fws.gov/windenergy/
eagle_guidance.html). Additionally, wind energy projects should follow the wind energy
guidelines (http://www.fws.gov/windenergy/) for minimizing impacts to migratory birds and

the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for
