Director > Division of Water Quality Tommy Williamson 2510 Smith Harbor Drive Denver, NCi 28037 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Williamson: September 6, 2002 DWQ# 02-1188 Lincoln County You have our approval, in accordance with the attached conditions, to place fill in 0.07 acre of waters at Lake Norman in Lincoln County, as you described in your application received by the Division of Water Quality on July 29, 2002. After reviewing your application, we have decided that this work is covered by General Water Quality Certification Number 3373, which can be viewed on our web site at http:Hh2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Regional Permit Number 198200030 when the Corps of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. No trees greater than 6 inches diameter at the stump may be removed except for those directly within the construction corridor. If trees are removed, forested vegetation shall be re-established within the construction access. or other temporary impact area occurring in the protected buffer zone within the next growing season following construction of the project; 2. This project is for the installation of a rip rap and rockwood seawall to prevent further erosion of the property due to wave action. The use of mechanical equipment on the beach must be minimized; 3. Equipment and materials may be offloaded to the beach at the bulkhead site, but steps must be taken to keep all equipment out of the reservoir; 4. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 1506 of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The banks of the shoreline were approximately 2 to 3 ft. in height. Approval recommended. WATER QUALITY SECTION September 5, 2002 CERTIFIED MAIL Return Receipt Requested Mr. Tommy Williamson 113 Bridgeport Dr. Mooresville, NC 28117 Subject: Notice of Violation (NOV) Catawba Riparian Buffer Rules 2510 Smith Harbor Dr. Lake Norman Lincoln County, NC Dear Mr. Williamson: Mr. Alan Johnson of this Office conducted a site inspection' on September 3, 2002 at the subject property in response to your shoreline stabilization request. While conducting the inspection Mr. Johnson observed what appeared to be a violation of the Catawba Riparian Buffer Rules (15A NCAC 2B. 0243) at the site. Mr. Johnson noted that fill dirt had been placed in Zone 1. Also, at least three plastic corrugated pipes were placed to discharge into the buffer area. A review of our files indicates that a NOV was issued in October 2001 for this offense. The rules restrict development impacts within a 50-foot wide area beginning at the lake project elevation (in this case the 760 foot elevation) and extending landward. Zone 1 consists of the first 30 feet from the project elevation and Zone 2 consists of the remaining 20 feet. The rules require that no disturbance occur in Zone 1. Limited disturbance can occur in Zone 2. In addition diffuse flow (sheet flow) must be maintained through the buffer zone. Be advised that the Division of Water Quality (DWQ) requires that approval be obtained prior to conducting land disturbing activities in Zone 1. The cutting, clearing, and grading in Zone 1 and Zone 2 that was observed at the site are not allowed under the current regulation. Page 2 Williamson Even if the removal of the vegetation as described above occurred prior to the implementation of the aforementioned rules, the riparian buffer zones still apply to this property, and any future development within the buffer will need to comply with this regulation. In Zone 2, all trees can be cut provided that the land is stabilized and revegetated (e.g. garden, shrubs, lawn). Attached is a photo of the site and a copy of the riparian buffer fact sheet for the Catawba River. Be advised that approval for the shoreline stabilization will be forthcoming as soon as the fill dirt is removed from Zone 1 and the drainage pipes (for roof runoff) are removed from both Zone 1 and Zone 2. The drainage system must be designed in a manner that diffuse flow (sheet flow) can be maintained through the buffer. It is requested that a written response be submitted to this Office by September 19, 2002. Your response should address your plans to restore the riparian buffer. Failure to respond to this NOV and restore the affected area may result in a Recommendation for Enforcement for the unauthorized impacts. Be advised that water quality violations can result in civil penalty assessments of up to $25,000 per violation, per day for every day the violation continues. Gentlemen, We propose to build a 3' x 75' Rockwood Retaining wall near existing dock. The rest of the 233' shoreline will be rip-rap. The top of existing grade is 3' above full pond. Since lot has no trees along shoreline and field grass exists now, we will be planting turf-type fescue seed to provide lawn area up to wall and rip-rap.
