As a result of this on-site determination, the DWQ has determined that the circled drainage feature on the attached aerial photograph of the site initialed by DWQ staff on July 29, 2002 is a modified natural stream and, therefore, is subject to the Neuse Buffer Rules (North Carolina Administrative Code T15A:02B.0233 This modified natural stream has its origin at the junction of the lateral ditch and the culverted farm road crossing. Channels above and. draining to this point are not subject to the Neuse Buffer Rules. In addition, we discussed the possibility of constructing a prison facility on this site.. As long as impacts to the modified natural stream and areas within 50 feet of the top of the stream bank (ditch bank) are limited to those which are listed as exempt, allowable or allowable with mitigation in the Neuse River buffer rules, DWQ believes that this site is permittable. As discussed in the field, we suggest that you give serious consideration to the construction of a constructed wetland on the upper-end of the channel in order to adequately control nutrients from stormwater runoff. This provision would be a condition of any Neuse River buffer approval or 401 Water Quality Certification issued by the Division of Water Quality for this site. In addition, it may be possible to pursue a Major Variance to impact this channel with an activity which is not listed in the Neuse River buffer rules such as a prison. In this case, a constructed wetland and compensatory buffer mitigation (perhaps immediately downstream of the constructed wetland on the same channel) would likely be conditions of an approval if one is issued by the N.C. Environmental Management Commission after consideration of whether the impact to the channel. is unavoidable. This letter only addresses the applicability to the buffer rules and does not approve any activity within the buffers. If you believe that this decision is incorrect, you must submit a written appeal to the Director of the Division of Water Quality within 60 days of the date of this letter. This determination is only applicable to the buffer rules (15A NCAC 2B .0233) and is not intended to delineate Waters of the State or Waters of the United States subject to other State or Federal protection.
