Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the
requirements of North Carolina General Statute 143-215.1 and the Nlemorandum of Agreement between North
Carolina and the U.S. FInvironmental Protection Agency dated May 9, 1994 (or as subsequently amended).
2003:
This final permit includes the following changes from the draft permit sent to you on September 10,
• Monitoring frequencies for most parameters have been changed to 3/VC7eek (rather than Daily) to
conform to requirements for Class II t facilities.
• lnstrcam monitoring for fecal coliform has been deleted to conform with current policy for facilities
treating 100`%, domestic waste.
If any parts, measurement frequencies or sampling requirements contained in this permit at unacceptable to
you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of
this letter. This request must be in the form of a written petition, conforming to Chapter 15013 of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 NImI Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to obtain
other permits which may be required by the Division of Watcr Quality or permits required by the Division of Land
Resources, the Coastal Area Nlanagenment Act or any other Federal or Local governmental permit that may be

accordance with effluent limitations, monitoring requirements, and other conditions set
forth in Parts 1, II, 111 and IV hereof.
This permit shall become effective January 1. 2004.
This permit and authorization to discharge shall expire at midnight on December 31, 2007.

permit issuance, any previously issued permit bearing this number is no longer effective. Therefore, the exclusive

2. After receiving an Authorization to Construct (ATC) from the Division, expand the
facility to achieve up to 1.0 MGD treatment capacity.
3. Discharge from said treatment works at the location specified on the attached
map into Shallowbag Bay, classified SC waters in the Pasquotank River Basin.

l . All instream monitoring samples shall be instantaneous samples. These shall be collected three times
per week during June, JUly, August, and September, and once per week during the rest of the year.
They shall be collected as grab samples at one -foot intervals vertically throughout the water column.
Instream sampling locations are as follows: 1) at the mouth of Douglas Creek. 2) near the mouth of
Scarboro Creek. 3) in Shallowbag Bay approximately 800 feet northeast of Sandy Point, 4) in
Shallowbag Bay approximately 0.4 miles southeast of Ballast Point, and 5) in Roanoke sound
approximately 200 feet outside of Shallowbag Bay.
2. The monthly average BOD5 and Total SUspencled Solids (TSS) concentrations shall not exceed 15% of
the respective influent value (85% removal).
3. The daily average dissolved oxygen concentration shall not be less than 6. 0 mg/1-
4. Whole Effluent Toxicity shall be measured by the Acute Toxicity (P/F) test using fathead rrtinrtow at
90%. Testing shall be conducted in February. May, August and November (see condition A. (3)).

A. (3.) ACUTE TOXICITY PERMIT LIMIT (Quarterly)
'I'hc Pcrnhittcc shall conduct acute toxicity tests on a nab basis using protocols defined in the Not Carolina
Procedure Document entitled "Pass/bail iMcthodology For Determining Acute Toxicity In A Single Ffflucnt
Concentration" (Revised -July, 1992 or subsequent versions). The monitoring shall be performed as a Fathead Minnow
(Piniephalet pronue&u) 24-hour static test. The effluent concentration at which there may be at no time significant
acute mortality is 90% (defined as treatment two in the procedure document). Effluent samples for self -
monitoring purposes must be obtained during representative effluent dischatgge below all waste treatment. The tests will
be performed during the months otFebruary, May, August and November.
All tosicitV testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring
Form (MR-1) for the month in which it was performed, using the parameter code TGH6C. Additionally, DVCFQ Form
AT-2 (original) is to be sent to the following address:

Completed Aquatic Toxicity Tcst Forms shall be filed with the Gnviromncriml Sciences Branch no later than 30 days
after the end of the reporting period for which the report is made.
Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in
association with the toxicity tests, as well as all dose/response clata. Total residual chlorine of the effluent toxicio, sample
must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should there be no discharge of flow from the facility during a month in which toxicity monitoring is required, the
Permittee will complete the information located at the top of the aquatic toxicity (A'f) test form indicating the facilit}
name, permit number, pipe number, countq., and the month/year of the report with the notation of "No Flow" in the
comment area of the form. T'hc report shall be submitted to the I nvironnhcntal Sciences Branch at the address cited
above.
Should am' single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin
immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to
quarterly in the months specified above.
Should the Permittee fail to monitor during a month in which toxicity monitoring is required, then monthly monitoring
will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert
to quarterly in the months specified above.
Should any test clatu from cidicr these monitoring requirements or tests performed by the North Carolina Division of
\Chafer Quality indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include
alternate monitoring requirements or limits.
NG"I'G: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival and appropriate environmental controls, shall constitute an invalid test and will require immediate follow-up
testing to be completed no later than the last clay of the month following the month of the initial monitoring.

A. (4) UFFLU IsNT POLLUTANT SCAN
The Pci inittec shall perform an annual Gfflucnt Pollutant Scan for all parameters listed in the attached table. The
Permiuce shall perform an annual EYALICnt Pollutant Scan for all parameters listed in the attached cable. The analytical
methods shall be in accordance with 40 CFR Part 136 and shall be snfficiently sensitive to determine whether parameters
are present in concentrations greater than applicable standards and criteria. Samples shall represent seasonal
variations. Unless otherwise indicated, metals shall be analyzecl as "total recoverable."

BACKGROUND
The Manteo WWTP (Class IV) has a phased permit for 0.6 MGD and LO MGD. The permit was
originally issued on January 11 and expired on February?8, 2003. The Permittee submitted EPA Form
2A on September 4, 2002 in order to request renewal of the permit. The Permittee has not requested any
changes to the existing permit.
Instream Monitoring, Verification of Existing Conditions and DMR Data Review
]'his facility discharges to Shallowbag Bay in subbasin 03-15-01 of the Pasquotank River Basin. The
Bay is classified SC waters at the discharge point and is not on the 2002-303(d) list.
Although the facility is required by the NPDES permit to collect instream data, none were available in
Central Files. A request for these data will be made in the cover letter.
DMR data from January 2001 through May 2003 were reviewed. Data for conventional parameters are
summarized in Table 1.

While not necessarily evident in these data. the facility has also experienced problems meeting the
weekly average fecal coliform limit. This will be discussed further in the Correspondence section.
This facility also collects data for total nitrogen, total phosphorus, and ammonia nitrogen (NH3-N).
These are summarized in 'fable 2. Total nitrogen and phosphorus data appear typical of this type of
facility.

Finally. total residual chlorine (TRC) is also monitored through the permit. Most samples were below
detection level, with an average TRC from January 2001-June 2003 of 0.1 ftg/L.
Correspondence
The Washington Regional Office (WaRO) conducted several site visits during this permit term to
evaluate compliance. For the most part, the facility was found to be in compliance and has made
considerable improvements since the previous permit term.
The Manteo WWTP has received six Notices of Violation (NOVs) over the course of this permit term.
Four of these were issued for violations of monthly and weekly average fecal colifonn limits and all were
severe enough to warrant civil penalties. It should be noted that because this discharge is to SC waters,
the fecal coliform limits are more stringent than those in many other municipal permits.
The other two NOVs were issued for a late toxicity report and a violation of the BOD5 weekly average.
The facility has otherwise been in compliance with its toxicity limit.
PERMITTING STRATEGY
Waste Load Allocation (WLA)
The Division prepared the last WLA for the previous permit renewal. The previous and current effluent
limits were based on guidelines and water quality standards. The Division has judged previous
parameters and limits to be appropriate for renewal with some exceptions. Weekly average ammonia
limits based on a 3:1 ratio with the monthly average will be implemented in this permit. This is a new
statewide policy that resulted from EPA requirements. The resulting summer weekly average limit will
be 6.0 mg/L and the winter limit will be 12.0 mg/L.
In addition, an annual pollutant scan will be added such that the Permittee can collect the necessary data
required by EPA Form 2A throughout the permit term. This condition is now standard on all major
municipal permits in North Carolina.
Finally, zinc was detected in the priority pollutant analysis submitted with the renewal application. The
level at which it was detected exceeds the NC water quality criterion for zinc. Quarterly zinc monitoring
will be added accordingly.
SUMMARY OF PROPOSED CHANGES
In keeping with Division policies, the following will be incorporated into the permit:
• New weekly average ammonia limits (both summer and winter)
• Annual pollutant scan
• Quarterly zinc monitoring

Road. Proceed approximately 0.5 mile to the facility located on the left side of the road
at 710 Bowsertown Road.

Facility is an activated sludge process consisting of mechanical bar screen, grit
chamber, multi -channel oxidation ditch, dual secondary clarifiers, traveling bridge
tertiary filters, chlorine gas disinfection, dechlorination, post aeration, aerobic sludge
digester and aerated sludge holding basin.

applied by Atlantic Nutrients under their permit.
