Your application was not complete since the stormwater management plan is not sufficient to meet condition no. 3 in Water Quality General Certification No. 3362. Specifically, the above condition requires stormwater management facilities for waters classified as NSW and that are considered to remove 85% TSS. Based on the plans provided with the application only roughly half of the impervious areas of the site would meet this requirement by the use of bioretention areas. As such, it will be necessary to provide similar treatment for the rest of the impervious area at the site. Please note that these requirements may be in addition to those required as part of Cary's nutrient reduction strategy. This information is needed by DWQ in order for us to decide whether this project is approvable. Please contact Todd St. John at 919-733-9584 if you have any questions. The applicant provided some level spreaders (which may not work due to slope as you suggested), some intermittently placed bioretention (and some dry detention w/o level spreaders). In the final analysis, the applicant did not provide 85% TSS stormwater treatment facilities appropriate for NSW waters for all of the impervious cover on the site. C/o Tom Booth 910 East Chatham Street Cary, NC 27511 Dear Mr. Booth: You have our approval, in accordance with the attached conditions and those listed below, to impact 0.416 acres of wetlands for construction of the Salem Castle at Cary, NC, as you described in your application dated July 22, 2002 as amended on August 16, 2002, September 10. 2002, December 16, 2002 and February 28, 2003, 2002 as revised on February 28, 2003. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3362. This certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 2B .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 211.0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). An additional condition is that a final written stormwater management plan shall be approved in writing by this Office before the impacts specified in this Certification occur. The bioretention areas and pocket wetlands must be constructed according to the plans submitted to this Office on February 28, 2003 according to the timeline below with the exception that the bioretention area labeled YI#4 shall be redesigned as an extended detention wetland with the same surface area as the bioretention area. The extended detention wetland must include plans and specifications for stormwater management facilities designed to remove 85% TSS according to the most recent version of the NC DENR Stormwater Best Management Practices Manual. FO SWG100 09/97 Page 1 of 1 ECSSC 25 February 2003 Soil Specification for Bio-Retention Areas The bio-retention areas shall consist of a planting medium having a composition of at least 10 - 25% clay and shall be a sandy loam or loamy sand texture. Loamy soils may be utilized for the planning medium but must consist of 35% sand. In addition, the planting medium shall be of uniform composition, free of stones, stumps, roots or similar objects larger than one inch, brush, or any other material or substance which may be harmful to plant growth, or a hindrance to planting or maintenance operations. The planting medium shall be free of plants or plant parts of Bermuda grass, Quack grass, Johnson grass, Mugwort, Nutsedge, Poison Ivy, Canadian thistle, or other noxious plant growth. The planting medium shall not contain toxic substances harmful to plant growth. The planting medium shall be placed in layers less than 18 inches and lightly compacted (minimal compactive effort) by tamping with a bucket from a dozer ort backhoe. Bio-retention Mulch A mulch layer shall be provided in a 2-3 inch layer on top of the planting medium. An acceptable mulch layer includes finely shredded hardwood mulch or similar material. The approved mulch layer must be aged, uniform in color and free of foreign material including plant material. Aged mulch shall be defined as mulch that has been stockpiled or stored for at least six (6) months. Bio-retention areas shall be mulched upon completion of the planting of trees and shrubs. Chatham Street Receiving Water Course: Walnut Creek Contractor: (List below) Landscape Contractor TBD Grading Contractor TBD OPERATIONS AND MAINTENANCE MANUAL SALEM CASTLE WATERSHED PROTECTION BIO-RETENTION AREAS This manual establishes procedures for maintenance and operation of the SALEM CASTLE Bio-retention areas in accordance with the Town of Cary guidelines as set forth in the UDO Section 10, Chapter 13. MAINTENANCE OF 13110-RETENTION AREAS Vegetation-The drainage areas have a ground cover of fescue, which if properly maintained will prevent erosion of the embankment and provide an easy surface for inspection. The grass will be most difficult to obtain in the area subject to water level fluctuation. Grass should be fertilized every October and April. Re-Seeding-Periodic re-seeding may be required to establish grass on areas where seed did not take or have been destroyed. Before seeding, fertilizer (12-12-12) should be applied at a minimum rate of 12 to 15 pounds per 1,000 SF. The seed should be evenly sown at a rate of three pounds per 1,000 SF. The seed should be covered with soil to the depth of approximately %". Immediately following the planting, the area should be mulched with straw. Trees and Shrubs-Trees, shrubs and other landscape vegetation should be permitted only as shown on the approved planting plan. The vegetation should be kept healthy and vibrant. If a tree or shrub dies it should be removed and replaced with another tree or shrub from the same species (see attached maintenance schedule). Mowing-Grass mowing, brush cutting and removal of weed vegetation will be necessary for the proper maintenance of the areas. All area slopes and vegetation should be mowed when the grass exceeds 8" in height. Acceptable methods include the use of weed whips or power brush cutters and mowers. Erosion-Erosion occurs when the water concentrates causing failure of the vegetation or when vegetation dies and sets up the environment for rill erosion and eventually gullies from the stormwater runoff. The areas should be inspected. Proper care of vegetative areas that develop erosion is required to prevent more serious damage to the site. Rills and gullies should be filled with suitable soil compacted and then seeded. Methods described earlier on vegetation should be used to properly establish the grass surface. Where eroded areas are detected, the cause of the erosion should be addressed to prevent a continued maintenance problem. Frequently, problems result from the concentration of runoff to one point of the bio-retention area instead of a uniform distribution of runoff. This can be corrected by reshaping, to more evenly distribute the runoff to areas not experiencing erosion problems. Rodent Control-Generally in this urban environment, rodents are not a problem. Rodents such as groundhogs, muskrats and moles are attracted to moist, wet areas and can be quite dangerous to structural integrity and proper performance of the earthwork and drainage. Groundhogs and muskrats thrive on burrowing into the manmade earthwork, which become pathways for seepage. In the event that burrows are detected within the bio-retention area, the rodents should be dealt with by removal. Trash and Debris--Trash acts as a barrier to stormwater infiltration and attracts unwanted pests. The bio-retention area should be kept clear of debris such as loose bottles, cans, food containers and other forms of rubbish. The area should be cleared of debris as needed, but no less than twice a year. MAINTENANCE OF SPILLWAYS AND CONTROL STRUCTURE Inspection of Conduits--Conduits should be inspected thoroughly once a year. Conduits should be visually inspected at the joints. Pipes should be inspected for proper alignment (sagging), elongation and displacement at joints, cracks, leaks, surface wear, loss of protective coating, corrosion and blocking. Problems with conduits most often occur at joints and special attention should be given to them during inspection. Joints should be checked for gaps caused by elongation or settlement and loss of joint filler material. Open joints can permit erosion of the earthwork and possibly the piping of soil material through the joints. A depression in the soil surface over the pipe may be signs that soil is being removed from around the pipe. OPERATION Drainpipes--Drainpipes should always be operable so that the water can be drawn down in the event of severe rain or for repairs or maintenance. Record Keeping--Operation of bio-retention area should include recording of the following: Annual Inspection Reports--A collection of written inspection reports should be kept on record in Section IV of this manual. Inspection should be conducted annually. Copies should be provided to the Town of Cary Stormwater Management Section of the Engineering Department. Observations--All observations should be recorded. Where periodic inspections are performed following significant rainfall, these inspections should be logged into the Periodic Inspection, Operations and Maintenance Form in Section IV of this manual. Maintenance--Written records of maintenance and/or repairs should be recorded on the Periodic Inspection, Operation and Maintenance Form in Section IV of this manual. Other Operational Procedures--The owner should maintain a complete and up-to-date set of plans (as-built drawings) and all changes made to the bio-retention area over time should be recorded on the as-builts. Sedimentation and Dredging--Sedimentation from on-site and off-site soils will eventually result in the clogging of drainage conduits and will have to be removed. The frequency of this sediment removal can be reduced by ensuring that the site areas around the building be stabilized with a vegetative ground cover such that it restrains erosion. This would include a periodic application of fertilizer and/or other treatment necessary to promote a stable ground cover and minimize sedimentation to the pond. The removed material should be hauled offsite to a suitable landfill site or mounded somewhere on site and stabilized with a ground cover sufficient to restrain erosion. Inspect the stormwater pocket wetland detention basin system for sediment accumulation, erosion, trash accumulation, vegetated cover, and general condition. b. Check and clear the orifice of any obstructions such that drawdown of the temporary pool occurs within 2 to 5 days as designed. 2. Repair eroded areas immediately, re-seed as necessary to maintain good vegetative cover, mow vegetative cover to maintain a maximum height of six inches, and remove trash as needed. 3. Inspect and repair the collection system (i.e. catch basins, piping, swales, riprap, etc.) quarterly to maintain proper functioning. 4. Remove accumulated sediment from the stormwater pocket wetland detention basin system semi- annually or when depth is reduced to 75% of the original design depth (see diagram below). Removed sediment shall be disposed of in an appropriate manner and shall be handled in a manner that will not adversely impact water quality (i.e. stockpiling near the stormwater pocket wetland detention basin, bio- retention basin, stream, etc.). The measuring device used to determine the sediment elevation shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments. When the permanent pool depth reads 474.27 feet in the forebay [and micro-pool], the sediment shall be removed. If the elevation of the adjoining marsh areas exceeds the permanent pool elevation, the sediment should be removed to design levels. This shall be performed by removing the upper 6 inches of soil and stockpiling it. Then the marsh area shall be excavated six inches below design elevations. Afterwards the stockpiled soil should be spread over the marsh surface. The soil should not be stockpiled for more than two weeks. Remove cattails and other indigenous wetland plants when they cover 50% of the basin surface. These plants shall be encouraged to grow along the vegetated shelf and forebay berm. If the basin must be drained for an emergency or to perform maintenance, the flushing of sediment through the emergency drain shall be minimized to the maximum extent practical. 7. All components of the stormwater pocket wetland detention basin system shall be maintained in good working order. 8. Level spreaders or other structures that provide diffuse flow shall be maintained every six months. All accumulated sediment and debris shall be removed from the structure, and a level elevation shall be maintained across the entire flow spreading structure. Any down gradient erosion must be repaired and/or replanted as necessary. The applicant agreed to building an extended detention wetland as opposed to a bioretention area at YI #4 (the large basin area on the north side of the stream). This structure would be adequately sized to treat the entire drainage area draining to it. The bioretention areas in series with it would be bonus. The only problem is that the bioretention area (DA - 0.3 ac) adjacent to the tilt yard (the oval shaped structure on the east side of the project) is 20% too small. Its size is maximized. In any event considering the amount of bonus treatment that we would be getting (even at this location), I recommend that we approve it as is. Here's some lingo: An additional condition is that a final, written stormwater management plan shall be approved in writing by this Office before the impacts specified in this Certification occur. The bioretenion areas and pocket wetlands will be constructed according to the plans submitted to this Office on February 28, 2003 according to the timeline belowwith'the exception that the bioretention area labeled YI #4 shall be redesigned as an extended detention wetland with the:same surface area as the bioretention area. This letter will provide the information you requested in the August 22, 2002 office meeting concerning the cumulative impacts to the watershed (comment 1 on the July 30th letter) of the proposed Salem Castle project. The channel present on site is buffered throughout its existence on-site. As the channel exits the project site it enters the State Capital Soccer Park (SCSP) Project and then flows into Walnut Creek. The stream channel has a 100-foot buffer on each side throughout its extent on the SCSP site. The channel joins another tributary (feature B) on the SCSP site prior to entering Walnut Creek. Feature B has a 50-foot buffer applied to each side. The area in the vicinity of the stream channel on the SCSP site that has not already been developed does not have any plans for development. The SCSP site has a cross country trail planned which will cross the creek. The permit application for this trail is currently being prepared and will be submitted shortly. The trail proposes a vegetated trail (grass) and will avoid all large diameter trees. The proposed trail plan has changed slightly and will proposed the use of a culvert and/or fill to cross the creek with an impact of approximately 15 linear feet at each crossing. After discussions with Integrated Design, the Salem Castle site planner, the site should not contribute to any cumulative impacts downstream because stormwater from the site is being treated prior to entering the buffers and/or stream and is required to meet the Town of Cary's strict stormwater BMP's. As requested I have attached a copy of the current zoning for the surrounding properties in the same small watershed. We have several questions about this project as outlined below: 1. It appears that a retaining wall is still planned within Zone 2 of the stream buffer at the southwestern part of the site (adjacent to the loading dock?). Please address this issue. 2. Stormwater plan - This project shall require a stormwater management plan for the entire site that includes bioretention areas, extended detention wetlands and/or wet or dry ponds followed by forested filter strips designed to meet 85% TSS removal criteria according the NC DENR Stormwater Best Management Practices Manual, April 1999 as required by General Certification 3362 and/or 3375. These requirements may be in addition to the nutrient reduction requirements administered by the Town of Cary. Additionally, please provide details as to whether a direct discharge of stormwater is planned at the road crossing or whether this stormwater will be treated before discharge. Also the stormwater discharge from the castle itself will need to be treated before discharge to the stream. The plan does not show any treatment devices in this location. We will need preliminary designs or calculations for the bioretention areas before we can issue the required approval so we can be certain that this treatment is feasible. 3. Please address the shape of the protected stream buffer at the northwest corner of the castle. The shape of the buffer is not symmetric - that is, it bends northward from the castle but is not similarly bent on the opposite side of the stream. We are concerned that the stream and buffer locations may not be properly shown. Please submit information which depicts the exact location of the buffer and stream on the site. Pursuant to 15A NCAC 21-1.0507(a)(3), the permit application will remain on hold until we are supplied the necessary information. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers continue to place the permit application on hold. We have several questions about this project as outlined below: 1. It appears that a retaining wall is still planned within Zone 2 of the stream buffer at the southwestern part of the site (adjacent to the loading dock?). Please address this issue. 2. Stormwater plan - This project shall require a'stormwater management plan for the entire site that includes bioretention areas, extended detention wetlands and/or wet or dry ponds followed by forested filter strips designed to meet 85% TSS removal criteria according the NC DENR Stormwater Best Management Practices Manual, April 1999 as required by General Certification 3362 and/or 3375. These requirements may be in addition to the nutrient reduction requirements administered by the Town of Cary. Additionally, please provide details as to whether a direct discharge of stormwater is planned at the road crossing or whether this stormwater will be treated before discharge. Also the stormwater discharge from the castle itself will need to be treated before discharge to the stream. The plan does not show any treatment devices in this location. We will need preliminary designs or calculations for the bioretention areas before we can issue the required approval so we can be certain that this treatment is feasible. 3. Please address the shape of the protected stream buffer at the northwest corner of the castle. The shape of the buffer is not symmetric - that is, it bends northward from the castle but is not similarly bent on the opposite side of the stream. We are concerned that the stream and buffer locations may not be properly shown. Please submit information which depicts the exact location of the buffer and stream on the site. Pursuant to 15A NCAC 2H .0507(a)(3), the permit application will remain on hold until we are supplied the necessary information. Furthermore, until the information is received by the NC Division of Water Quality, we request (by copy of this letter) that the US Army Corps of Engineers continue to place the permit application on hold.
