The Division has determined that your application is incomplete and cannot be processed. The application is on hold until all of the following information is received: 1. Has an evaluation been conducted to determine the volume of accumulated sediment in the reservoir? If so, how much is present? How have you determined that draining the lake will not release more than a de minimis amount of sediment? [15A NCAC 02B .0200] The North Carolina Wildlife Resources Commission recommends a rack spacing for the intake trash rack not to exceed 0.4 inches. Can the recommended rack spacing be implemented? If not, why? [15A NCAC 02H .0506(b)(2)] 3. Duke Energy has an approved Woody Debris and Trash Management Plan for the Whiteoak Creek Diversion Dam. Will collected woody debris in the proposed drag rake extension be passed downstream in general accordance with the noted plan? [15A NCAC 02H .0506(b)(2)] Pursuant to Title 15A NCAC 02H .0502(c), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. Feel free to contact me if you have any questions.
