April 2, 2020 US Army Corps of Engineers Wilmington Regulatory Field Office Ms. Emily Greer 69 Darlington Avenue Wilmington, NC 28403 Re: Hilltop Business Park & Storage NC -Division of Water Resources 401 & Buffer Permitting Unit Mr. Paul Wojoski 1617 Mail Service Center Raleigh, NC 27699 Hampstead, Pender County NWP 39 PCN Submittal - After the Fact USACE AID: SAW-2015-01338 WR Project #03200325.00 Dear Ms. Greer and Mr. Wojoski, On behalf of Hilltop Management, LLC., we are requesting "after the fact" authorization from the USACE to use NWP 39 for 0.09 acres of permanent wetland impacts for construction of two road crossings necessary for construction of the Hilltop Business Park and Storage project. Please note that the proposed project and impacts do not require written authorization from NCDWR, as the projects did not meet any conditions requiring written authorization under General Water Quality Certification No. 4139. Therefore, we are providing a copy of the PCN to NCDWR as a courtesy. The southern parcel (PIN: 4215-23-1857-0000) is currently under construction as a boat/self- storage facility, which is being constructed entirely in uplands. The road connection between the storage facility and business park was not intended to be constructed until the necessary permits had been received and was supposed to be stubbed short of Wetland C. The contract partially constructed the crossing through Wetland C (Impact 1) to access the outfall of the western stormwater pond outfall, as well as stockpile materials, which resulted in 0.05 acres of unauthorized wetland impact. The wetland impact for the road crossing (Impact 2) within the business park (PIN: 4215-33-0904-0000) has not been constructed. This application will bring the project into compliance and permit all wetland impacts for the entire project. The project is located in the Cape Fear River basin (HUC: 030300070803) and drains to Trumpeters Swamp. The Water Quality Classification for Trumpeters Swamp is C;SW, and the Stream Index Number is: 17-74-49-2-1-1. Proposed Proiect The purpose of the proposed project is to construct a mixed -use business park and boat/self- storage facility to meet the demand for these type of facilities in eastern Pender County. The proposed project consists of construction of 12 flex -space commercial/retail buildings, a boat/self- storage facility, access roads, parking and associated infrastructure (water, sewer, stormwater management, electrical, etc.). 219 Station Road, Suite 1011 Wilmington, NC 28405 t: 910.256.9277 www.withersravenel.com I License No. C-0832 Asheville I Cary Greensboro I Pittsboro I Raleigh I Wilmington Hilltop Business Park & Storage, Hampstead, Pender Co. :: withers Rave n e l Our People. Your Success. The project will be constructed using traditional commercial construction equipment and techniques. Proiect History The USACE issued an AJD (SAW-2015-01338) for the northern ±18.5 acre parcel (PIN: 4215-33- 0904-0000) on 4/22/2016. A copy of the AJD has been provided as an Appendix. The southern ±5.71 acre parcel (PIN: 4215-23-1857-0000) was reviewed by WithersRavenel in July 2017, and was determined to consist entirely of uplands as documented in the "Wetland Assessment Report" dated 8/10/2017, which has been provided as an Appendix. The boat/self-storage facility on the southern parcel (PIN: 4215-23-1857-0000) is currently under construction. Construction of the business park on the northern parcel (PIN: 4215-33-0904- 0000) has not begun. Proposed Impacts The proposed impacts consist of 0.09 acres of permanent wetland impacts for construction of road crossings for internal access within the project, as well as to provide two points of access as required for emergency services. Impact 1(0.05 acres) is needed for a perpendicular crossing through Wetland C in order to provide interconnectivity between the boat/self-storage facility and business park. This crossing also provides a second point of access to Machine Gun Road as required by Pender County for emergency services access. A culvert will be installed within the road crossing to provide hydrologic connectivity between the undisturbed portions of Wetland C remaining on each side of the road. Impact 2 (0.04 acres) will result from construction of the main access road for the business park from Hwy 17, which will slightly encroach into Wetland A. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. Proposed impacts have been minimized to those necessary to construct internal roads to access the developable uplands within the project, as well as meet the Pender County requirements for two points of access for emergency services. There are no proposed impacts associated with construction of the proposed office buildings or parking. Wetland impacts have been minimized by crossing Wetland C (Impact 1) perpendicularly. The access road within the business park has been designed for minimize impacts to Wetland B (Impact 2) by encroaching only into the outer edge of the wetland. The site design has minimized wetland Page 2 of 3 Hilltop Business Park & Storage, Hampstead, Pender Co. :: WithersRavenel Our People. Your Success. impacts to the greatest extent practicable, and has minimized permanent wetland impacts to less than 0.10 acres. Silt fencing will be installed around all disturbed areas to prevent sediment from escaping into undisturbed wetlands, and access during construction will be within uplands. Mitigation The proposed permanent wetland impacts are less than 0.10 acres, and therefore mitigation is not proposed. The current request is for 0.09 acres of permanent wetland impacts (see the attached maps and PCN for details). Please feel free to call if you have questions or require additional information. Violations (DWR Requirement) 2a. Is the site in violation of DWR Water Quality Certification Rules (15ANCAC 2H .0500), Isolated Wetland Rules (15A NCAC 2H .1300), or DWR Surface Water or Wetland Standards or Riparian Buffer Rules (15A NCAC 2B .0200)? * r Yes f• No 2b Provide an explanation of the violation(s): 3. Cumulative Impacts (DWR Requirement) 3a. Will this project result in additional development, which could impact nearby downstream water quality?* r Yes r No 3b. If you answered "no," provide a short narrative description. The proposed project is a single and complete project, and future phases are not anticipated at this time. Furthermore, the project is located along the Hwy 17 corridor between Hampstead and Topsail where there is very little development activity, and is not anticipated to be a catalyst for future development that could impact nearby downstream water quality. 4. Sewage Disposal (DWR Requirement) 4a. Is sewage disposal required by DWR for this project?* r Yes r Nor NIA 4b. Describe, in detail, the treatment methods and dispositions (non -discharge or discharge) of wastewater generated from the proposed project. Does this project involve (1) blasting, and/or (2) other percussive activities that will be conducted by machines, such as jackhammers, mechanized pile drivers, etc.? r Yes r No 5j. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? WR reviewed the NC Natural Heritage Program database, located at http://vmw.ncnhp.org/web/nhp/home to identify if there were any known occurrences of endangered species on or near the proposed project. The reviewof the NHP data did not identify any occurrences of federally listed threatened or endangered species or critical habitat on the subject property or within 1.0 miles of the project, see attached NCNHP project review letter. Site reviews did not identify any potential habitat for any federally protected species known to occur in Pender County, except for the Northern Long Eared Bat. Potential habitat for the northern Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used for roosting during the day. The proposed project area contains sparse trees over 3" DBH, and therefore is considered potential northern long eared bat habitat. The proposed project is located outside of a red HUC and there is no pile driving, blasting or percussive activities proposed. Therefore, WR concludes that the project "may affect, but is not likely to adversely affect" the northern long-eared bat and the SLOPES ALP Situation 1 is applicable to this project. Will this project occur in or near an area designated as an Essential Fish Habitat?* r Yes IT No 6b. What data sources did you use to determine whether your site would impact an Essential Fish Habitat?* WR reviewed the NOAA Essential Fish Habitat online mapper, located at: http://mm.habitat.noaa.gov/protection/efh/efhmapper/indexhtmi. The EFH mapper classifies Virginia Creek, located approximately 4,000 If east of the proposed project, as Essential Fish Habitat. However, the project does not drain to Virginia Creek, but actually drains west to Trumpeters Branch, which is not EFH. Therefore, the proposed project will not result in adverse impacts to Essential Fish Habitat within Virginia Creek. 7. Historic or Prehistoric Cultural Resources (Corps Requirement) 7a. Will this project occur in or near an area that the state, federal or tribal governments have designated as having historic or cultural preservation status?* r Yes IT No 7b. What data sources did you use to determine whether your site would impact historic or archeological resources?* WR reviewed the NC State Historic Preservation Office's online database, located at: https://www.habitat.noaa.gov/protection/efh/efhmapper/index.html to determine if there were any known historic or cultural resources Within or in the vicinity of the proposed project. The database reviewdid not identify any known resources within or in the vicinity of the proposed project. 7c. Historic or Prehistoric Information Upload 8. Based on the project area mapped with your request, a query of the NCNHP database indicates that there are no records for rare species, important natural communities, natural areas, and/or conservation/managed areas within the proposed project boundary. Please note that although there may be no documentation of natural heritage elements within the project boundary, it does not imply or confirm their absence; the area may not have been surveyed. The results of this query should not be substituted for field surveys where suitable habitat exists. In the event that rare species are found within the project area, please contact the NCNHP so that we may update our records. The attached `Potential Occurrences' table summarizes rare species and natural communities that have been documented within a one -mile radius of the property boundary. The proximity of these records suggests that these natural heritage elements may potentially be present in the project area if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one -mile radius of the project area, if any, are also included in this report. If a Federally -listed species is found within the project area or is indicated within a one -mile radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for guidance. Contact information for USFWS offices in North Carolina is found here: httr)s://www.fws.aov/offices/Directory/ListOffices.cfm?statecode=37. Please note that natural heritage element data are maintained for the purposes of conservation planning, project review, and scientific research, and are not intended for use as the primary criteria for regulatory decisions. Information provided by the NCNHP database may not be published without prior written notification to the NCNHP, and the NCNHP must be credited as an information source in these publications. Maps of NCNHP data may not be redistributed without permission. The NC Natural Heritage Program may follow this letter with additional correspondence if a Dedicated Nature Preserve, Registered Heritage Area, Clean Water Management Trust Fund easement, or Federally -listed species are documented near the project area. If you have questions regarding the information provided in this letter or need additional assistance, please contact Rodney A. Butler at rod ney.butlerConcdcr.aov or 919-707-8603. A taxon "in danger of extinction throughout all or a significant portion of its range." T = threatened. A taxon "likely to become endangered within the foreseeable future throughout all or a significant portion of its range." C = candidate. A taxon under consideration for official listing for which there is sufficient information to support listing. (Formerly "C1" candidate species.) BGPA =Bald and Golden Eagle Protection Act. See below. ARS = At Risk Species. Species that are Petitioned, Candidates or Proposed for Listing under the Endangered Species Act. Consultation under Section 7(a)(2) of the ESA is not required for Candidate or Proposed species, although a Conference, as described under Section 7(a)(4) of the ESA is recommended for actions affecting species proposed for listing. FSC=Federal Species of Concern. FSC is an informal term. It is not defined in the federal Endangered Species Act. In North Carolina, the Asheville and Raleigh Field Offices of the US Fish and Wildlife Service (Service) define Federal Species of Concern as those species that appear to be in decline or otherwise in need of conservation and are under consideration for listing or for which there is insufficient information to support listing at this time. Subsumed under the term "FSC" are all species petitioned by outside parties and other selected focal species identified in Service strategic plans, State Wildlife Action Plans, or Natural Heritage Program Lists. T(S/A) = threatened due to similarity of appearance. A taxon that is threatened due to similarity of appearance with another listed species and is listed for its protection. Taxa listed as T(S/A) are not biologically endangered or threatened and are not subject to Section 7 consultation. See below. EXP = experimental population. A taxon listed as experimental (either essential or nonessential). Experimental, nonessential populations of endangered species (e.g., red wolf) are treated as threatened species on public land, for consultation purposes, and as species proposed for listing on private land. P = proposed. Taxa proposed for official listing as endangered or threatened will be noted as "PE" or "PT", respectively. Bald and Golden Eagle Protection Act (BGPA): In the July 9, 2007 Federal Register( 72:37346-37372), the bald eagle was declared recovered, and removed (de -listed) from the Federal List of Threatened and Endangered wildlife. This delisting took effect August 8,2007. After delisting, the Bald and Golden Eagle Protection Act (Eagle Act) (16 U. S.C. 668-668d) becomes the primary law protecting bald eagles. The Eagle Act prohibits take of bald and golden eagles and provides a statutory definition of "take" that includes "disturb". The USFWS has developed National Bald Eagle Management Guidelines to provide guidance to land managers, landowners, and others as to how to avoid disturbing bald eagles. For mor information, visit http://www.fws. og v/migratorybirds/baldea lg e.htm Threatened due to similarity of auuearance(T(S/A)): In the November 4, 1997 Federal Register (55822-55825), the northern population of the bog turtle (from New York south to Maryland) was listed as T (threatened), and the southern population (from Virginia south to Georgia) was listed as T(S/A) (threatened due to similarity of appearance). The T(S/A) designation bans the collection and interstate and international commercial trade of bog turtles from the southern population. The T(S/A) designation has no effect on land management activities by private landowners in North Carolina, part of the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss. https://www.fws.gov/raleigh/species/cntylist/pender.html 4/2/2020 Pender County Endangered Species, Threatened Species,Federal Species of Concern, and ... August 10, 2017 Mr. Andy Furr Hilltop Management, LLC 1730 Scotts Hill Loop Road Wilmington, NC 28411 Re: Hilltop Storage Property -Hampstead, Pender County Wetlands Assessment Report W R Project # 03170417.00 Mr. Furr: On June 7, 2017, WithersRavenel conducted a site review of the ±5.53 acre property, located on Machine Gun Road, for the purpose of evaluating the presence of wetlands and streams within the project. The project consists of one parcel (Parcel ID: 4215-23-1857-0000), located approximately 1500 feet northwest of the intersection of Old Whiteville Road and US Highway 17 in Hampstead, Pender County (Lat: 34.4396631°N; Long:-77.63291061W). The project is located in the White Oak basin (HUC 03020302), and the site drains to the Virginia Creek (Stream Index: 18-87; Surface Water Classification: SA;HQW). Proposed Activities The proposed activities consist of development of the property, including all associated infrastructure including utilities, access and stormwater management. Site Conditions The entire site is undeveloped, and has been historically timbered and cleared and the vegetation is periodically mowed which has prevented reforestation. The vegetative composition was consistent throughout the site, and consisted of a mixture of loblolly pine saplings (Pinus taeda), immature long leaf pine saplings (Pinus palustris), bracken fern (Pteridium aquilinum), bushy blue stem (Andropoogon glomeratus), giant cane (Arundinaria gigantea), horsetail (Equisetum arvense), gallberry (Ilex coriacea), red bay (Persea borbonia), horse sugar (Symplocos tinctoria), creeping blueberry (Vaccinium crossifolium), and trumpet honeysuckle (Lonicera sempervirens). The Pender County Soil Survey classified the soils within this area as Kureb Fine Sand (KuB) and Leon Fine Sand (LnA). Kureb soils are classified as "excessively drained" soils. Leon Fine Sand is classified as "poorly drained". Leon Fine Sand soils are found in broad flats throughout Pender County and contain both upland and wetland components. Wetland/Stream Determination Prior to conducting the site visit, WR reviewed aerial photographs, the USDA Soil Survey for Pender County (1990), the 2013 USGS Quadrangle Map (Topsail and Holly Ridge) and Pender 115 MacKenan Drive I Cary, NC 27511 t: 919.469.3340 1 f: 919.467.6008 www.withersravenel.com I License No. C-0832 Cary I Greensboro Pittsboro I Raleigh I Wilmington ::WithersRavenel Our People. Your Success. County GIS data (i.e. topography, streams, etc.). WR reviewed the project for the presence of wetlands and surface waters jurisdictional to the Corps of Engineers (Corps) and/or NC Division of Water Resources (DWR) based on protocols set forth in the 1987 USACE Wetlands Delineation Manual and 2010 Atlantic and Gulf Coastal Plain Regional Supplement (Version 2.0). The site review did not identify any wetlands or surface waters within the subject property. The soils within the review area were consistent with Leon Fine Soils as mapped. The onsite soils exhibited greater than 70% uncoated sand grains, which indicates an absence of wetland hydrology, and does not meet hydric soil criteria. There were no hydrologic indicators observed in the upper 12 inches of the soil surface, and saturation was not observed within 16 inches of the soil surface, and therefore the site did not meet wetland hydrology criteria. Additionally, the vegetation does not meet hydrophytic critera based on the prevalence index. Summary In conclusion, the subject property consists entirely of uplands and coordination with the Corps of Engineers or NC Division of Water Resources is not necessary for development of the property.
