According to our rules [15A NCAC 2H .0507 (A)], if final action is not taken within 60 days, the Certification is waived unless DWQ has objected in writing to your application. Therefore, DWQ has waived the requirement for a 401 Water Quality Certification for your plans to impact waters as described in your July 15, 2002 application materials. However, if additional impact occurs or your development plans change, this waiver is no longer valid and a 401 Water Quality Certification will be required. The average water depth along the proposed bulkhead alignment is -1.3 and the finished (and connecting) depth is -2.3. Based on the measurements (959'x 5'x .5') it appears that approximately 89 cubic yards of dredge spoil "muck" will be removed from the canal. All excavated spoil material will be placed in one of four 25'x 15' (1,500sf) retention areas that will be located 30' landward of the existing NWL. The proposed retention areas will have silt fencing placed around them to prevent material from migrating into adjacent open waters. The holding capacity of the retention areas total over 111 cubic yards if placed at a depth not to exceed two feet and 166 cubic yards at depth of three feet. ANTICIPATED IMPACT 1) If permitted, approximately 16,303 square feet of high ground will be disturbed in conjunction with the installation of the proposed bulkhead tie back rods and associated anchors. 2) Approximately 2,877 square feet of Estuarine and Public Trust Waters will be filled if the bulkhead alignment is approved. 3) There will be approximately 1,500sf of temporary upland disturbance associated with the spoil retention area. 4) Temporary localized turbidity will occur during construction of the bulkhead and the dredging of the canal. 5) Stabilization of the shoreline will reduce the amount of sediment and nutrient runoff from the applicant's property, into the adjacent man-made canal. PROJECT SUMMARY: The applicant Kitty Hawk Landing Association, is requesting a permit to construct a 959 linear foot bulkhead, an average of three feet waterward of normal water level and perform maintenance excavation in the canal the length of the proposed bulkhead and out to a distance five feet waterward of the proposed alignment, on Ivey Lane, in Kitty Hawk, Dare County. Kitty Hawk Landing Association Field Report Page 2 PROJECT SITE The project site is a 47,958 square foot common are for Kitty Hawk Landing Subdivision located at the entrance, on the left (east) side of Ivy Lane, in Kitty Hawk, Dare County. The physical addresses of the residential properties on the west side of Ivy Lane directly across the street from the project site are 4124 - 4166. Kitty Hawk Landing is a residential waterfront community situated along man-made canals off Albemarle Sound. Vegetation on the site is primarily domestic grasses and ornamentals. There are no Coastal or Section 404 Wetlands located within the project area. According to the application the average elevation of the lot is approximately 2.8' above NWL. The lot is flat with little to no high ground elevation change that terminates at an erosion escarpment. Vegetation grows up to the edge of the bank with a vertical drop to the water. According to the application documented erosion along the shoreline within the project area, over the past year, is approximately six inches. Located on the property is a large sign with the name of the subdivision, a small concrete slab, and a small community information sign (in the approximate center of the property). On the east side of the property is a man-made canal (Estuarine and Public Trust Waters) that is approximately 80' in width, and to the west, across the street (Ivy Drive), are single-family dwellings. Adjoining riparian uses to the north and south of the project area are single-family dwellings. The adjoining shorelines are protected with bulkheads. The water depths along the shoreline vary from -.7' at the shoreline, to -2.5' at a distance of eight feet waterward of normal water level (NWL). There is evidence of submerged aquatic vegetation within the canal adjacent to the project area, but not within the proposed work area itself. Albemarle Sound is classified as joint waters by agreement between the Marine Fisheries Commission and Wildlife Resource Commission. The Division of Environmental Management's water quality classification for Roanoke Sound is SB (swimming). Additional review indicates that there are no known geological formations associated with the applicant's property. There is an identified archeological site within the subdivision, referenced as DR17, but not within in the immediate vicinity of the applicant's property. PROJECT DESCRIPTION The applicants are proposing 959 linear feet of bulkhead to be constructed an average of three feet, and a maximum of eight feet, waterward of NWL. In addition to the bulkhead the property owners propose to undertake maintenance excavation in the adjacent man-made canal, for a distance of five feet waterward of the proposed bulkhead alignment and the length of the bulkhead. Placement of the bulkhead would result in the filling of approximately 2,877 square feet of Estuarine and Public Trust Waters (959'x 3') and the disturbance of approximately 16,303 square feet of high ground in conjunction with the placement of tieback rods and anchors, and general grading and seeding (959'x 17').
