The forest cover varies between hardwoods that occur near the existing tributaries, floodplain/wetland areas, and mixed pine dominated stands on higher elevations. The forest community is dominated by Sweetgum (Liquidambar styraciflua) and red maple (Acer rubrum), with some mixed oaks and loblolly pine (Pinus taeda). The open areas have been mowed and appear to be mostly early successional plants. Jurisdictional waters of the US were classified according to USAGE guidance. The results of the jurisdictional determination investigation indicated that there were several jurisdictional streams present within the subject property. Streams SA and SC (on site), and Streams SA, SB, SC, SD, SE, and SF (off -site sewer) that occur within the project area. Streams SA (Site), SC (Site), and SA (Sewer) are all perennial intermittent streams that occur within the project area. Streams SB (Sewer), SC (Sewer), SD (Sewer), SE (Sewer), and SF (Sewer) are all intermittent Streams. All of these streams drain to Price Mill Creek and would be considered non -wetland waters of the US that are a part of the Catawba River Basin (HUC# 03050103)(USGS 1974). Jurisdictional wetlands were also located within the project area. Two wetland areas located within the project parcel (Site Wetlands WA and WB). These two wetland areas would be considered small basin type wetlands. The wetlands that occur along the proposed sewer line (Sewer Wetlands WA, WB/WC, WD, WE, WF, WG, WH, and WJ) are all dominated by sweetgum and red maple in the overstory. The understory is dominated by Japanese stiltgrass (Microstegium vimineum), soft rush (Juncus effusus), and various vines: catbrier (Smilax rotundifolia) and poison ivy (Toxicodendron radicans). 4b. Explain the purpose of the proposed project:* The growth of the greater Charlotte metropolitan area including Union County, has been enormous since the end of the "Great Recession." The demand for commercial space has skyrocketed since 2013. Currently, demand is strong in and near the Independence Boulevard (US 74) corridor of Union County (and also the greater Charlotte metropolitan area). With this in mind, the applicant proposes to construct a ±47-acre business park. The overall purpose of the project is to provide additional commercial space (for specific clients) to meet the growing needs of this area of Gaston County and the greater Charlotte Metropolitan area. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The project consists the following impacts: Impact #'s 1 and 2 consist of the filling of two small, low quality wetland areas (0.19-ac and 0.22-ac respectively)(Permanent Impact). These fill areas are required in order to be able to accommodate all required infrastructure of the proposed tenants. Impact #'s 4, 5, 9, and 10 consist of the construction of a sewer line through several small, lowquality wetland areas. These impacts are permanent in nature due to the need to maintain a maintenance corridor. However, the impact (conversion from forested wetland to herbaceous wetland) does not cause a loss of wetland area and therefore, should not require mitigation. Impact #'s 3, 4a, 6, 7, and 8 consist of construction of a sewer line (open cut) across these stream reaches. These impacts are considered temporary in nature. The impacted areas will all be stabilized using either bio-stabilization or hard armoring techniques (based on engineering recommendations) and all disturbed areas will be returned to pre -construction contours. Typical construction equipment will be used for this project. Those pieces of equipment include, but are not limited to: bulldozers, track hoes, dump trucks, etc. 4j. Impact Justification and Mitigation v 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Every effort was made to avoid and minimize impacts across the project. However, avoiding the two wetland areas on the site proved to be impossible due to their landscape position and their physical position on the site. Their overall length made matters worse since they are long and linear, meaning that to avoid them would drastically reduce the available building footprint to such a point that 25 % of the project area would be unusable. This 25 % reduction in the size of the project would also occur in the most valuable portion of the site (the frontage on Old Monroe Road). In these types of commercial business parks, large footprints of buildings and other infrastructure are required to meet the needs of the tenants that will occupy them. Avoidance was achieved in other portions of the site. The sewer line was designed to meet the requirements of Union County Public Works and included the boring of two wetland areas that were of higher quality than the other wetlands along the sewer. The two wetland areas that are being bored are part of a larger bottomland hardwood wetland system that appears to be relatively undisturbed at the present time. The other wetlands that are being impacted by the sewer line are small remnant wetlands that lie adjacent to agricultural operations and/or utility lines Their functionality has been reduced due to activities adjacent to them. 1b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: As mentioned above, the two higher quality wetlands present within the project are being bored in an effort to reduce overall impacts. 2. Since the sewer construction consists of the excavation of a trench for the sewer and then replacement of the material in the trench, there is no discharge of additional fill into the floodplain which would cause a rise in the flood elevation (no rise). Please note that this decision does not assure that participation in the DMS in - lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts. It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will be approved. You must also comply with all other state, federal or local government permits, regulations or authorizations associated with the proposed activity including G.S. § 143-214.11.
