Director Division of Water Quality December 27, 2006 CERTIFIED MAIL: 7005 0390 0001 3200 5489 RETURN RECEIPT REQUESTED Blue Marlin, LLC c/o Gordon Frieze PO Box 1328 Wrightsville Beach, NC 28480 Subject Property: Dear Mr. Frieze: :~ DWQ Project # 050813 ver 2 Onslow County REQUEST FOR MORE INFORMATION Mimosa Bay Phase V Off Old Folkstone Rd., Onslow County On September 6, 2006, the Division of Water Quality (DWQ) in the Wilmington Regional Office (WiRO) received your application dated August 31, 2006 and additional information received November 1, 2006 to impact and additiona10.203 acres of jurisdictional wetlands to construct the proposed subdivision expansion (Phase V). The DWQ has determined that your application is incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: The road crossing indicated as wetland disturbance area 1 needs to have an additional pipe placed in the wetlands to adequately allow the passage of water from side to side. Anew drawing showing the two pipes will be needed in plan and profile view. The wetlands that are NOT covered by the covenants and restrictions (i.e. those on individual lots etc.) will be required by the Division of Water Quality (DWQ) to have deed restrictions/deed notifications placed on them. The language is posted on our web site and a notarized draft copy needs to be included in the application package. Please respond within three weeks of the date of this letter by sending this information to me in writing and 5 copies of the information to Ian McMillian of the DWQ Oversight Unit Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
