SUBJECT: Nationwide 14 Permit Application for US 17 / Sloop Point Rd improvements,
Pender County, Project Number: 41246.3
Please find enclosed a PCN application from the North Carolina Department of Transportation
for a Nationwide 14 permit from the Army Corps of Engineers for intersection improvements at
US 17 and SR 1561 Sloop Point Rd. in Pender County. The scope of the project includes
intersection improvements within the median in the vicinity of the intersection and the
construction of two bulb-outs for cross-over turning movements. All improvements are shown in
the attached plans. Bulb-outs 1 and 2 are located at Stations 971+45 to 973+80 and 991+20 to
993+40, respectively. The widening at Bulb-out 2 is the only part of the project with
jurisdictional impacts. To construct Bulb-out 2, the existing shoulder adjacent to the South-
bound lane will be widened 0-35 feet from the existing edge of pavement for a length of 225
feet. This will allow safer U-turn movements for north-bound traffic through the existing median
break.
IMPACTS TO WATERS OF THE UNITED STATES
This project is located in the Cape Fear River Basin within USGS hydrologic unit 03030007
(subbasin 030623). The proposed project will permanently impact 0.021 acres of wetlands
(from Sta. 992+20 to Sta.993+40) to widen the existing shoulder to accommodate Bulb-out 2.
All wetland impacts are shown on the attached plans. The wetlands are within the upper
reaches of the Virginia Creek (classified as SA HQW) watershed. There will be no stream
impacts. There are no permanent or temporary utility impacts proposed with this project.
COMPENSATORY MITIGATION
The Department has avoided and minimized impacts to jurisdictional resources to the greatest
extent possible. Based upon our September 17, 2009 field meeting, mitigation will not be
required for the minimal wetland impacts.

NATURAL AND HISTORIC RESOURCES
Federally Protected Species
Species with the federal classification of Endangered, Threatened, Proposed Endangered and
Proposed Threatened are protected under provisions of Section 7 and Section 9 of the
Endangered Species Act of 1973 as amended (16 U.S.C. 1531 et seq.). The United States
Fish and Wildlife Service lists twelve federally protected species for Pender County. A GIS and
field review has been conducted for these species and their habitat for this project and a
determination of "No Effect" for the listed species is recommended.

Historical Resources
Pursuant to Section 106 of the National Historic Preservation Act and the Advisory Council on
Historic Preservations Regulations for Compliance with Section 106 codified at 296 CFR Part
800; this project. has been,reviewed and cleared for effects on historical and archeological
resources. Please see attached " No Survey Required" forms.
REGULATORY APPROVAL
Section 404 Permit: The Department of Transportation is requesting to proceed under
Nationwide 14 in accordance with 72 FR 11092, March 12, 2007.
Section 401 Permit: We are also requesting by copy of this letter issuance of the 401 Water
Quality Certification 3704 from the DWQ. We have provided a method of debiting $240 to be
submitted to the DWQ for processing the WQC permit request, as noted in the subject line of
this application.

In the general vicinity of the project limits there exists commercial properties along US 17, residential developments, and
forested land. In the immediate vicinity of Bulb-out 2, there is a maintained powerline corridor and a mowed grassed
parcel which is currently undeveloped.

This project includes safety improvements to the intersection of US 17 and SR 1561. The improvements include new
concrete islands, median work to construct and modify turn lanes, and widening for bulb-outs to accommodate U-tum
movements in two locations. Al work is shown on the attached plans. The bulb-out adjacent to the S-bound lane (Bulb-
out 2) is the only widening that will impact jurisdictional wetlands. Bulb-out 2 will be 225 feet in length and will require
widening of 0-35 feet from the existing edge of pavement. Standard road building equipment will be used including a
backhoe and motor grader.

Widening for two bulb-outs, turn lanes, and median cross-over improvementss on US 17 near intersection
with SR 1561 (Sloop Point Road): approximatley 950 feet North ofintersection adjacent to south-bound
land and approximatley 1100 feet South of intersection adjacent to norht-bound land. All proposed work
'lays within the existing ROW
SUMMARY OF CULTURAL RESOURCES REVIEW
Brief description of review activities, results of review, and conclusions:
OSA quad maps, archaeologcial report files, and soil maps were reviewed on September 2, 2009. No
sites were recorded within the APE or within the vicinity of the project. Historic Structures reported
reported no eligible historic sites within the vicinity of the project. Soil survey documented Leon fine
sand, Kutch fine sand and Murville muck soil series.
Brief Explanalion of why the available information provides a reliable basis for reasonably predicting
that there are no unidentified historic properties in the APE:
APE centered on US 17/SR 1561 (Sloop Point Road) intersection and encompasses the proposed .48 mile
length of project and 30-foot widening from exisitng roadway. Review of the OSA maps documenting
recorded sites failed to reveal any sites with the APE or vicinity of the proposed project. No
archaeological properties are present with the existing ROW, to which the proposed project will be
confined.
