This letter is in regard to your application request under the Coastal Area Management Act
(LAMA) to construct three wave attenuators in Shallowbag Bay in Dare County. Processing of the
application, which was received by the Division of Coastal Management's Elizabeth City office on June
21, 2002, is now complete. Based on the state's review, the Division of Coastal Management has made
the following findings:
1) The application proposes the construction of three wave attenuators: two, 4 feet wide by 150'/z feet
long and one, 4 feet wide by 2061/2 feet long.
2) The proposed location of the largest wave attenuator is parallel to the shoreline and approximately
400 feet from the shore and 210 feet waterward of the existing docking facility.
3) One of the smaller structures is also proposed to be located parallel to the shoreline and
approximately 300 feet from the shore in front of the marina entrance. A portion of this structure
is proposed within the riparian corridor of the adjacent property to the north.

The second smaller structure is proposed to be perpendicular to the shoreline and entirely in the
riparian corridor of the adjacent property to the north.
A total of approximately 250 linear feet of the proposed wave attenuators is to be constructed
outside of the riparian corridor of the Shallowbag Bay Club.

6) The adjacent riparian property owner to the north has objected to the placement of the proposed wave
attenuators being constructed within his riparian corridor. The property owner further claimed that
the proposed structures would impede his access to the channel in Shallowbag Bay.
7) The U.S. Army Corps of Engineers, which is responsible for enforcing the provisions of Section 10
of the Rivers and Harbors Act, recommended that the application be denied based on the potential of
the proposed wave attenuators to adversely affect established navigation patterns in Shallowbag Bay.
8) The N.C. Division of Marine Fisheries objected to the project as proposed due to "the loss and/or
impacts to Public Trust Waters. The project as proposed will result in a severe hazard to navigation.
This area of Shallowbag Bay is heavily utilized for boating and fishing (recreational and
commercial). This project will interfere with the use of this area."
9) The Division of Coastal Management has also determined that the proposed wave attenuators would
obstruct navigation along this shoreline and in Shallowbag Bay.
10) Based upon the findings outlined above, the proposed project has been determined to be inconsistent
with the following Rules of the Coastal Resources Commission:
A) 15A NCAC 07H.0207(d) Use Standards for Public Trust Areas, which states that "In the
absence of overriding public benefit, any use which significantly interferes with the public
right of navigation or other public trust rights which the public may be found to have in these
areas shall not be allowed. "
B) 15A NCAC 07H.0208(a)(2)(H), which states "Development shall not impede navigation or
create undue interference with access to, or use of, public trust areas or estuarine waters. "
Given the preceding findings, it is necessary that your request for issuance of a CAMA Major Permit
be denied. This denial is made pursuant to N.C.G.S. 113A-120 (a)(8), which requires denial for projects
inconsistent with the state guidelines for Areas of Environmental Concern or local land use plans.
If you wish to appeal this denial, you are entitled to a hearing. The hearing will involve appearing
before an Administrative Law Judge who listens to evidence and arguments of both parties and then makes a
recommendation to the Coastal Resources Commission. Your request for a hearing must be in the form of a
written petition, complying with the requirements of §150B of the General Statutes of North Carolina, and
must be filed with the office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-
6714, (919) 733-2698, within twenty (20) days from the date of this letter. A copy of this petition should be
filed with this office.
Also, you should be advised that as long as this state permit renewal denial stands, your project must
be deemed inconsistent with the N.C. Coastal Management Program, thereby precluding the issuance of
Federal permits for this project. The Federal Coastal Zone Management Act (CZMA) gives you the right to
appeal this finding to the U.S. Secretary of Commerce within thirty (30) days of receipt of this letter. Your

appeal must be on the grounds that the proposed activity is (1) consistent with the objectives or purposes of
the CZMA, or (2) is necessary in the interest of national security, and thus, may be federally approved.

You have our approval, in accordance with the attached conditions, to shade 0.047 acre of Public Trust Waters in order to
construct three wave attenuators adjacent to your property and in Shallowbag Bay in Dare County, as described in your application
received by the Division of Water Quality on July 8, 2002. After reviewing your application, we have determined that this fill is covered by
General Water Quality Certification Number 3371, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands .
This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you
should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and
Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA
Permit expires unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

Project Setting
The applicants' property consists of a 6.66 acre tract located behind McDonald's
restaurant on the east side of US Highway 64/264 in Manteo on Roanoke Island, Dare County.
The property is adjacent to Shallowbag Bay and is "U" shaped with a 120' wide and 750'
long basin in the center that connects to Shallowbag Bay. The property is the site of an
authorized 76 unit condominium complex and a 99 slip marina. At this time the project is
nearly complete.
The adjacent property to the north is a Juncus marsh and the adjacent property to the
south is also a Juncus marsh and is separated by a canal. The soils on the property are sandy
and the vegetation consists of yard grasses and ornamental shrubs.
The waters of Shallowbag Bay are classified as SC by the Division of Environmental
Management. All waters in Shallowbag Bay and its tributaries are declared as prohibited
territory for shellfish taking by the Shellfish Sanitation Branch.
Development Proposal
In order to reduce the wave action experienced at the marina, the applicant proposes to
construct three wave attenuators in Shallowbag Bay near the entrance. The proposed wave
attenuators resemble a floating dock in that guide pilings are used as horizontal stabilizers and
to keep the structure in place. The floating attenuator is 4' wide, 26" high and the length is
150.5' for two units and 206.5' for a third unit. The units appear to be rigid, unlike a floating
dock. According to the proposal, the pilings will be approximately 34' long with
approximately 13' above the normal water level (NWL).
The water depths in the area of the development proposal range from -6 ft. to -7 ft.
below NWL and the bottom is sandy.
The location of the largest proposed structure is parallel to the general shoreline and
approximately 400 ft. from shore and approximately 160 ft. waterward of the outboard slips of
the marina. One of the smaller structures is also parallel to the general shoreline and in front
of the marina entrance. It is approximately 330 ft. from shore and located partially in the
riparian corridor of the adjacent property to the north. The second smaller structure is
proposed to be perpendicular to the shoreline and entirely in the corridor of the adjacent
property to the north.
Anticipated Impacts
The proposed structure will shade 2030 sq. ft. of Public Trust Area and Estuarine
Waters Areas of Environmental Concern. Approximately 250 linear ft. of the structure will be

constructed outside of the applicants' riparian corridor. The adjacent riparian property owners
whose riparian corridor will be encroached have objected by letter.
Location of structures within the Public Trust waters will constitute a greater
obstruction to navigation of vessels transiting laterally along this shoreline. It will effectively
enclose an area of approximately one and three quarters acres of Public Trust in addition to a
similar area already enclosed by permitted docks.
Temporary water turbidity will occur during construction.

Major Modification for Shallowbag Bay Club
CAMA Major Permit #132-89
The proposed project is a modification to the existing CAMA Major Permit #132-89. Shallowbag Bay
Club, Inc. is proposing an addition of three (3) wave attenuators at the entrance to Shallowbag Bay Club
Marina (see attached site plan/drawings) to provide protection for the existing channel (see surveyed
channel on attached plat) and existing offshore boating facility.
The marina is substantially built as proposed in the original application that allows for the location of slips
in the offshore basin. What was not available in 1989 was an adequate design of surface mounted wave
attenuators that would allow for control of wave activity associated with strong wind-driven energies. An
offshore shoal is located approximately 400 feet from the existing east dock. During storm events this
shoaling creates damaging wave energies towards the existing marina. The attached plan distinguishes
between existing and proposed structures by highlighting the remaining proposed structures and lighter line
type the existing structures. The old piling layout that was depicted has been removed from the revised
plat since these pilings no longer exist. This revision should clarify the location of the existing pier.
The proposed lengths of the attenuators are: (1) 206.5' and (2) 150.5' with 4 foot widths and 16 inch
height (see details attached). Water depths at attenuators are approximately 4.5 to 8 feet (see surveyed
depths on attached plat). Wave attenuator apparatus is 26" in height and extends approximately 16 inches
above the water surface. The pilings extend approximately 13 feet above the wave attenuator apparatus.
The proposed attenuators (polyethylene incased expanded poly styrene (eps) flotation will be constructed
off site using a commercial source (Sound Marine) and installed off shore using a barge with a hydraulic
pump to drive 12" diameter x 35' length pilings into the floor (driven approximately 13 feet deep into the
sediment) of the Roanoke Sound. Once the pilings (37 total) are in place the attenuators will be placed
through the pilings to allow vertical movement (floating) of the attenuators to correlate with the fluctuation
of wind driven tides (attenuator 26" in height, includes 10 inches below the water surface). Placement of
the wave attenuators are proposed approximately 40 to 200 (see individual placement on the attached plat)
feet from the existing boating facility where water depths are approximately 4.5 to 8 feet deep. A waiver
letter was obtained from the north adjacent riparian property owner to allow the construction to take place
within his riparian corridor (attachment). Current ebb and flow have been provided in the vicinity of the
proposed wave attenuators.

attached drawings): wave attenuators propose d to be installed offshore
using barge for transport and hydraulic Dum p to drive in pilings
(12"dia. 35'length), which run through the middle of each attenuator to
allow vertical movement of the attenuator apparatus in relation to the
fluctuation of wind driven tides. (Wave attenuators float freely with
the (vertical) ride fluctuation but are held in place (location on attached
plat) by several pilings (on 14 foot centers) w
substrate of the bay (approx 13' deep) Wave hich are driven into the
