Dear Mr. Blake:
The Division of Water Quality (DWQ) has reviewed your plans to construct the proposed 8" HDPE directional drill crossing
at the Little River on Rains Crossroads Road (SR2320), Johnston County, NC. It is the determination of the DWQ that the
proposed activity as indicated in your request letter dated June 14, 2002 complies the Neuse River Buffer Rules (15A
NCAC 2B .0233) as an "exempt" use if the following conditions are met. In addition, you should obtain or otherwise
comply with any other required federal, state or local permits before you go ahead with your project including (but not
limited to) Erosion and Sediment Control and Non-Discharge.
This determination is only valid for the purpose and design that you described in your request and additional conditions
listed below. If you change your project, you may be required to notify us and you may be required to send us an
application for authorization. If the property is sold, the new owner must be given a copy of this letter and is thereby
responsible for complying with all conditions. For this confirmation to be valid, you must follow the conditions listed below
as well as any other conditions identified within 15A NCAC 2B .0233.
Conditions:
• The proposed project has been determined to be in compliance with the Neuse Buffer Rules (i.e., exempt) as long
as all of the crossings are perpendicular and disturb equal to or less than forty (40) linear feet of riparian buffer with
a maintenance corridor equal to or less than 10 feet in width.
Please be aware that any impacts to wetlands or surface waters (e.g., streams) will need to comply with the 404 / 401

7u20 The referenced project consist of approximately 14,500 linear feet of new 6", 4", and 2'"P'D??
water line within the NCDOT rights-of-way along US Highway 70 and several NCDOT secondary
roads (SR) within Johnston County, and one new 8" HDPE directional drill crossing at Little River
on SR 2320 (Rains Crossroads Rd).
The Little River crossing will be considered a non-electric utility waterway crossing and is
therefore exempt under the NC Department of Water Quality Administrative Code (T15A:
0213.0200). It is our understanding that this crossing will therefore not require certification or
mitigation, since it will be perpendicular to the channel and will not disturb any length of
channel or require a maintenance corridor greater than 10 feet in width.
Charlie Musser with Sungate Design Group was consulted for wetland delineation of the
reference project area. Mr. Musser found no evidence of wetlands at the two sites he
investigated, which included the Little River crossing (plan sheet 92) and the crossing around the
overflow bridge on SR 2320 (plan sheet 90A). The SCS Soil Survey for Johnston County represents
that this crossing is at a perennial stream, however the USGS quad map of this area does not
indicate a stream of any kind and Mr. Musser found no established channel. We feel that this
crossing therefore does not fall within jurisdiction of the Division of Water Quality and therefore
Water Quality Certification or Buffer Rule Approval is not required. Mr. Musser's field delineation
sketches have been attached for your review.
Verification of the wetland delineation work is being coordinated between Mr. Musser and the
US Army Corps of Engineers at this time.
On behalf of the Princeton-Kenly Water District we hereby request your concurrence that 401
Water Quality Certification and Buffer Rule Approval are not required and for this project.
