Whichard: July 30, 2002 DWQ# 02-1045 Beaufort County You have our approval, in accordance with the attached conditions, to place fill in 0.08 acre of non-vegetated wetlands in order to fill in an existing basin with a bulkhead and backfill the area and replace approximately 82 feet of existing bulkhead on your property in Beaufort County, as described in your application received by the Division of Water Quality on June 24, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http://h2o.enr.state.ne.us/ncwetiands . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its. conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: The applicant proposes to fill in an existing basin with a bulkhead and backfill the area and replace ±82' of existing bulkhead. Warren Whichard Whichards Beach Project setting The project site is located at the end of SR 1166 at Whichards Beach near the Town of Chocowinity in Beaufort County, North Carolina. Whichard Beach is a commercial campground, beach and marina complex located on the Pamlico Ri-er and a series of manmade canals. The site encompasses ±186 acres and is vegetated with lawn grass, hardwoods, pines and ornamental shrubs. The project area is vegetated with lawn grass and several cypress trees. The property in the vicinity of the project area is bulkheaded and has various docks and finger piers to create numerous slips for the existing marina complex. The project area is an existing basin and boat ramp area that is bulkheaded with an existing 15 inch drain tile which empties into the back of the basin. The project site is approximately 3' above the normal water level. The manmade basin and canal connect to the Pamlico River which is classified as SB-NSW by the Environmental Management Commission. The Pamlico River at the project site is coastal water but is closed to shell fishing. Project description The applicant proposes to close off and fill the existing ±82' by ±27' and ±40' by ±33' manmade basin by constructing a new 70' bulkhead from corner to corner of the existing bulkhead. Approximately 3,534 ft2 are proposed to be filled in the manmade basin. The existing 15" culvert will be extended to the newly installed bulkhead. The applicant also proposes to replace ±82' of existing bulkhead T waterward of the existing alignment on the downstream side of the basin area. Anticipated impacts The project as proposed will result in the filling of +3,698 ft' of a manmade basin and canal bottom adjacent the Pamlico River. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by .applicant.
