The site is located within the Catawba River Basin and contains one jurisdictional area: Stream A (Attachment A - Figure 3). Proposed development of this site consists of filing and grading the property for future commercial opportunities. Carolina Wetland Services (CWS) has been authorized to act as an agent for McGirt Trucking in this matter (Attachment B). On behalf of McGirt Trucking, CWS is submitting a Pre-Construction Notification application (PCN) (Attachment C) with attachments in accordance with Nationwide Permit General Condition No. 13, and pursuant to Nationwide Permit No. 39. Proposed impacts from this project include 119 linear feet (0.01 acre) of unimportant intermittent channel (Stream A) and 100 linear feet of important channel (Stream A) (Attachment A - Figure 4). This project will avoid impacting approximately 45 linear feet of perennial channel (Stream A). n 5.5-acre Crafters Lane Property June 19, 2002 Nationwide Permit No. 39 Application Proiect No. 2002-0179-04 Existing Conditions The following sections describe the existing conditions of the property. Current Land Use The 5.5-acre Crafters Lane Property is located in south Charlotte, North Carolina, on the northwest corner of Crafters Lane and Westinghouse Boulevard (Attachment A - Figures 1 and 2). Approximately 1.5 acres of the property had been graded prior to the field investigation conducted by CWS (Attachment A - Figure 3). For the purposes of this report, only the remaining 4 acres of undisturbed land were investigated. The majority of the site is wooded with dominant vegetation consisting of black willow (Salix nigra), sweetgum (Liquidambar styraciua), pignut (Carya glabra), water oak (Quercus nigra), tulip poplar (Liriodendron tulipifera), red maple (Acer rubrum), and honeysuckle (Lonicera japonica). The current land use surrounding this parcel is vacant and commercial. Jurisdictional Delineation and Verification CWS's Gregory C. Antemann and Andrea Hughes delineated on-site jurisdictional waters of the U.S.' on January 18, 2002. Jurisdictional waters of the U.S. were delineated using the U.S. Army Corps of Engineers (USACE) - Routine On-site Determination method. This method is defined in the 1987 Corps of Engineers Wetlands Delineation Manua12. The results of the on-site field investigation conducted by CWS indicate that there is one on-site jurisdictional area: Stream A (Attachment A - Figure 3). Stream A is an unnamed tributary to Kings Branch. Kings Branch is part of the Catawba River basin and is rated "Class C Waters" by the North Carolina Division of Water Quality (NCDWQ). No wetland areas were identified during the delineation. Therefore, on-site jurisdictional areas consist of the bed and bank of Stream A. A Routine Wetland Determination Form representative of the adjacent upland areas is included (Attachment D). Mr. Steve Chapin of the USACE verified the delineated and surveyed jurisdictional on March 26, 2002 (Attachment E). A reduced copy of the signed Wetland Boundary Survey has been included as Attachment A - Figure 3. Table 1 is a summary of on-site jurisdictional areas. ' "Jurisdictional waters of the U.S." includes essentially all surface waters such as: all navigable waters and their tributaries, all interstate waters and their tributaries, all wetlands adjacent to these waters, and all impoundments of these waters. 2 Environmental Laboratory. Classification Length (if) Stream A unimportant intermittent 1191f (0.01 acre) Stream A important intermittent 100 if Stream A perennial 451f Stream Classifications Stream A begins approximately 125 feet northwest of the existing on-site fill slope and flows generally northwest across the property. The upstream limit of Stream A is approximately 119 linear feet in length and is evaluated to be unimportant intermittent. This portion of Stream A had weak riffle-pool sequences, sinuosity and channel braiding (Attachments F and G - SCP#1). This section of Stream A scored a 19.5 out of a possible 71 points on the NCDWQ Stream Classification Form and has a drainage area of approximately 14 acres. A photograph of the unimportant intermittent portion of Stream A has been included as Attachment H - Photograph A. At a two-foot nick point, Stream A appears to become an important intermittent channel. This portion of Stream A is approximately 100 linear feet in length and has moderate levels of riffle-pool sequences, sinuosity and a continuous bed and bank (Attachments F and G - SCP#2). Groundwater discharge was present and salamanders were sampled on the day of the field investigation. This portion of Stream A scored a 30 out of a possible 71 points on the NCDWQ Stream Classification Form and has a drainage area of approximately 20 acres. A photograph of the important intermittent portion of Stream A has been included as Attachment H - Photograph B. Approximately 45 linear feet of Stream A appears to be perennial. This portion of the stream exhibits strong sinuosity and a well-defined bankfull bench (Attachments F and G - SCP#3). Groundwater flow with an average width of four feet and crayfish were observed on the day of the field investigation. This portion of Stream A rated a 37 out of a possible 71 points on the NCDWQ Stream Classification Form and has a drainage area of approximately 27 acres. 3 1 5.5-acre Crafters Lane Property June 19, 2002 Nationwide Permit No. 39 Application Project No. 2002-0179-04 Purpose and Need for the Project The 5.5-acre Crafters Lane Property currently serves as a deposition site for fill dirt that McGirt Trucking accumulates through its trucking business. The proposed project will allow the site to be prepared for future commercial development. Project History Steve Mc Girt, McGirt Trucking, received a Notice of Violation for insufficient erosion control measures at the 5.5-acre Crafters Lane Property from Steve Gucciardi, Erosion Control Coordinator for the City of Charlotte Engineering and Property Management Department - Land Development Division, dated January 8, 2002, (Attachment I). During a field investigation conducted on that date, Mr. Gucciardi observed severe sedimentation of the on-site channel and requested several corrective actions be taken by the landowner, including the submission of a stream monitoring plan to his office. Mr. McGirt contracted CWS to prepare a Stream Monitoring Report, conduct stream monitoring activities for a period of three years, and submit Stream Monitoring Reports annually to Mr. Gucciardi following each monitoring event. During the process of preparing the initial Stream Monitoring Report and delineating on-site jurisdictional waters of the U.S., CWS informed Mr. McGirt of the project's Section 404 permitting requirements. CWS was then contracted to permit the project through the submission of this application. Avoidance and Minimization After reviewing the results of the delineation conducted by CWS, on-site grading and construction plans were redesigned to avoid impacting the perennial portion of Stream A (45 linear feet). Proposed Impacts to jurisdictional Waters The proposed project on the 5.5-acre Crafters Lane Property will result in unavoidable impacts to jurisdictional waters of the U.S. These impacts have been determined utilizing an overlay of the surveyed boundaries of jurisdictional waters of the U.S. and the grading plan (Attachment A - Figure 4). A total of 119 linear feet of unimportant intermittent channel and 100 linear feet of important intermittent channel will be impacted by site grading for this project. 4 5.5-acre Crafters Lane Property June 19, 2002 Nationwide Permit No. 39 Application Proiect No. 2002-0179-04 Activities that will result in impacts to jurisdictional waters of the U.S. will be required to follow the General Conditions of Nationwide Permit No. 39 (Federal Register, Vol. 67, No. 10; January 15, 2002). In compliance with these general conditions, an erosion and sediment control plan will be implemented according to guidelines established by the North Carolina Division of Environment and Natural Resources (NCDENR). All sediment and erosion control measures placed in waters of the U.S. will be removed and restored to natural grade within two months of the North Carolina Division of Land Resources (NCDLR) releasing the project. In addition, the contractor will avoid placing fresh concrete into waters of the U.S. and will construct culverts and other structures below the streambed to allow low flow passage of water and aquatic life. Compensatory Mitigation In order to compensate for the proposed impacts to jurisdictional waters of the U.S., this project proposes the maintenance of a 25-foot riparian buffer on both sides of the on-site perennial portion of Stream A. In addition, CWS will perform a series of Stream Habitat Evaluations, NCDWQ Stream Classifications, pebble counts according to Rosgen's Stream Classification Methods, and benthic macroinvertebrate surveys annually for three years to determine the effects of past sedimentation and to monitor Stream A's water quality. Stream Monitoring Reports will be submitted annually for three years to Mr. McGirt, McGirt Trucking, and Mr. Gucciardi, the City of Charlotte Engineering and Property Management Department - Land Development Division. Storm Water Management Plan The client's current grading and erosion control plan provides only for the filling and grading of the 5.5-acre Crafters Lane Property. Final use of the property is undetermined at this time. An appropriate Storm Water Management Plan will be designed once the total proposed impervious cover is determined.
