The activity must be conducted as indicated in your application received by the Division of Water Quality on June 21, 2002. We have determined that General Water Quality Certification Number 3362 covers this activity. For this approval to be valid, you must follow the conditions listed in the attached Certifications. Please pay special attention to Condition Numbers 8, 9, 15 and 16. This Certification allows you to use Nationwide Permit Number 39 when issued by the US Army Corps of Engineers. Please keep in mind that there may be additional Federal, State and Local regulations applicable to your project, such as the Sedimentation and Pollution Control Act, Non-Discharge and Water Supply Watershed Regulations, whereby you may be required to obtain permits and/or approvals prior to beginning your project. The park is located adjacent to U.S. Hwy 601 north of its intersection with 1-40. Future development of the park requires the extension of Endeavor Way over an unnamed tributary to Bear Creek in the South Yadkin Drainage basin. See attached copy from USGS Quad " Mocksville". The stream channel is be jurisdictional. However, other wetlands are not immediately obvious. The drainage area above the culvert is approximately 320 acres. The 96" culvert itself is planned to be 150 feet long with inlet and outlet protection consisting of gabions over fabric. The culvert is recessed below the channel bed in order to provide for aquatic wildlife. The total impacted length is approximately 150'. Anti-seepage collars will be installed at each end of the culvert and the culvert invert will be set 16" below the existing stream invert per the Culvert Profile attached. Dorney, Division of Water Quality Dept. of Environment and Natural Resources FROM: Ron Linville, Regional Coordinato Habitat Conservation Program DATE: July 2, 2002 SUBJECT: Review of 401 Certification Application by Hollingsworth Corporation, DWQ No. 020992, Unnamed Tributary Bear Creek, Davie County The applicant is requesting 401 Water Quality Certification from the North Carolina Division of Water Quality. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Southpoint Industrial Park is being developed in Mocksville. Proposed impacts to jurisdictional waters include 150 linear feet of 96" culvert with inlet and outlet gabion protection. Other previous impacts to waters may have occurred in the project area. Waters in the area are classified as WS-11. Based on our review of the proposed project we do not believe this project will have significant impacts on aquatic habitats provided the following conditions are utilized: 1. Culverts 48" or larger should be buried approximately l' into the streambed. Culverts less than 48 inches in diameter should be buried to a depth equal to or greater than 20% their size to allow for aquatic life passage. These measurements must be based on natural thalweg depths. 2. Stormwater management practices should be utilized on site to prevent secondary impacts to downstream aquatic habitat and water quality. Pre and post runoff hydrographic conditions should be equal to the extent practicable. The use of riprap or gabions should not preclude aquatic life movement during low flow conditions. 4. Wooded 100' undisturbed stream buffers are recommended for jurisdictional waters. Floodplain impacts should be avoided to the maximum extent possible to minimize flood issues and reduce secondary environmental impacts. We are not familiar with funding sources of the project(s) or the road improvements. If public funds or lands are involved in the industrial park, an Environmental Assessment pursuant to the State Environmental Policy Act may be appropriate.
