DANIEL SMITH Director NORTH', CAROLINA Environmental Quafrty April 1, 2020 DWR # 20200253 Wake County Mattamy Homes Attn: Mr. Robert Bailey 1210 Trinity Rd, Suite 102 Cary, NC 27513 Subject: REQUEST FOR ADDITIONAL INFORMATION Magnolia Park Subdivision Dear Mr. Bailey: On February 18, 2020, the Division of Water Resources — Water Quality Programs (Division) received your application dated February 14, 2020, requesting a 401 Water Quality Certification and Neuse River Buffer Authorization from the Division for your project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: For impact #1: Please provide cross section details showing the provisions for aquatic life passage. [15A NCAC 02H .0506(b)(2)] 2. For impact #1: Per GC4139, all work must be done "in the dry". Therefore, dewatering methods will be necessary to temporarily dewater the stream channel during pipe installation. Please provide a construction sequence that details the method of dewatering to be utilized at the site and the sequence of construction events to be followed to ensure compliance with this condition. In addition, please ensure that the location of the temporary impacts are shown on the construction drawings and clearly indicated in the revised impact table. [15A NCAC 02H .0502(b)(3)] At multiple locations throughout the project, the impact plan sheets do not match the grading plan sheets provided. For instance, it appears that Impacts #1 and #2 are switched between the two sets of plans as to which one is a temporary utility crossing and which is a permanent greenway crossing. Impacts 8 and portions of impact 9, impacts 12-14 appear to not be necessary in accordance with the grading plans. However Sheet C4.4 of the grading plans show multiple impacts to streams, wetlands and buffers from the Greenway alignment which are not incorporated into the impact tables or sheets. Please re -review all documents and ensure they are accurate, that they match, and submit updated PCN tables, impact sheets and grading sheets as necessary. Please note that Impact #5 will be considered as a stormwater outfall under the Neuse Buffer Rules Table of Uses, rather than as a stormwater control measure. [15A NCAC 02B .0233(9)] 5. Impacts #10 and #11 appears to be within the footprint of the existing pond dam if the grading sheet is accurate. In this case, the addition of a greenway to the existing dam will not be considered new buffer impacts as the dam will continue to be exempt as an existing use within the buffer. [15A NCAC 02B .0233(9)] Pursuant to Title 15A NCAC 02H .0502(e) and 15A NCAC 02B [Neuse] .0233, the applicant shall furnish all of the above requested information for the proper consideration of the application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1) copy of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail Service Center, Raleigh, NC 27699-1617 OR by submitting all of the above requested information through this link: https://edocs.deg.nc.gov/Forms/Supplemental-Information-Form (note the DWR# requested on the link is referenced above). If all of the requested information is not received within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and the appropriate fee. Please be aware that you have no authorization under the Water Quality Certification Rules for this activity and any work done within waters of the state may be a violation of North Carolina General Statutes and Administrative Code.
