Thorpe, Environmental Management Director NCDOT, Project Development and Environmental Analysis 1598 Mail Service Center Raleigh, NC 27699-1598 SUBJECT: Proposed Bridge Replacement, Bridge No. 145 Over Wiley Branch Creek on State Road 1121 (Cabarrus Station Road), TIP No. B-4048, Cabarrus County, DWQ #09- 1204 Dear Dr. Thorpe: The Division of Water Quality (DWQ) has reviewed your submittal for a 401 Water Quality Certification for the aforementioned project. Review of your application, in association with a site visit on November 17, 2009, revealed it is lacking the necessary information required for making an informed permit decision. The permit application was deficient in the following areas: The application proposes to replace the existing bridge with a triple barrel reinforced concrete box culvert, resulting in 238 linear feet of permanent stream impact. The plans indicate that the culverts will be buried and a sill installed on one of the culverts to maintain the natural stream dimension and to provide passage for high flow events. Based on the site visit, it appears that the majority of the stream is underlain with bedrock and is very stable. Additional details, to include geotechnical data, must be provided to demonstrate that the culverts can be installed and properly buried as indicated in the plans. DWQ does not support the blasting of bedrock streams to install structures. If bedrock is present throughout the stream, DWQ would encourage NCDOT to consider replacing the bridge with another bridge or bottomless culvert. Therefore, pursuant to 15A NCAC 2H .0507(a)(5), we will have to place the permit application on hold until we are supplied with the necessary information. You have 21 days to respond in writing with the requested information or notification to this office that the information is forthcoming. If, at the end of the 21 days, this office has not received this information in writing, we will assume you are withdrawing your application and it will be returned.
