Stabilization that I have put in by hand three times since 2/23/03 has disappeared three times. Todd Tugwell with the Corps has approved me putting in boulders where the land used to be. filling in behind them with dirt and rocks and planting on top of that. He suggested I touch base with your agency to make sure this was OK with you. Is it OK? Please let me know as soon as possible so I can get this done. Also, John Vilas is removed as agent. Project Information Attach a vicinity map clearly showing the location of the property with respect to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the maps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. DWQ prefers full-size construction drawings rather than a sequential sheet version of the full-size plans. If full-size plans are reduced to a small scale such that the final version is illegible, the applicant will be informed that the project has been placed on hold until decipherable maps are provided. 1. House is visible across field from here the road goes around the field (approx. 0.5 miles). Address is 565 Triplett Town Rd 5. Describe the purpose of the proposed work: To stabilize eroding stream banks alone perennial tributary and to restore a small unimportant intermittant channel The existing perennial stream has a drainage area of approx 450 acres (0.7 sq mj) It has an average bankfull width of approx 11 feet It flows along the property line between the applicants land and her neighbor's land The stream banks are unstable and eroding in several areas such that the channel has migrated as much as 10 feet into the applicant's property in laces; this condition has been exacerbated by the aggressive placement of fill by the neighbors. The applicant wishes to stabilize the stream banks on her side of the stream using natural stability concepts and practices to the extent practical There are four general areas in need of stabilization measures these are shown on the attached sketch. In each case the banks will be laid back to provide a bankfull bench These areas will be stabilized with root wads sod willow transplants and live stakes To the extent suitable rock can be found on site rock vanes will also be installed in the most vulnerable areas. While there will be disturbance of the stream bed in association with installation of root wads and vanes there will not be an permanent fill laced in the channel and the stream bed bankfull boundaries will remain essentially unchaned as a result of the proposed project This phase of the project will involve stabilization of approximately 145 linear feet of stream bank A Nationwide Permit 13 is requested for this activity. The second phase of the project is to restore a section of small unimportant intermittant channel that enters the perennial stream in the middle of the property. This small channel drains approximately 8.5 acres has a bankfull width of 6 feet and area of 4.4 square feet The existing intermttant channel is stable for the first 80 linear feet below the road and ro ertline but becomes a deep eroded ditch for the last 50 feet above the perennial stream The applicant proposes to restore the lower 50 linear feet of this channel by constructing a step pool channel on new location as shown on the attached sketch and details. This channel will be stabilized with sod, plantings and rock cross vanes/step-pool structures placed to control grade A Nationwide Permit_ 39 is requested for this activity. 11. List the type of equipment to be used to construct the project: Standard construction equipment: track excavator, backhoe dump truck 12. Describe the land use in the vicinity of this project: Rural residential agricultural and undeveloped. Very low density. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. The proposed work and associated impacts are intended to restore and stabilize channel areas that are currently unstable and eroding and will therefore result in an overall improvement to water quality. The methods proposed (root wads sod mats willow transplants and rock vanes) are designed to provide the desired stability as well as enhance instream habitat The property already has a single family dwelling on it and no additional development is proposed Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. Page 8 of 13 If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.nc.us/ncwetlands/strmmide.htmi. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. No mitigation is proposed 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Describe the purpose of the proposed work: To stabilize eroding stream banks along perennial tributary and to restore a small unimportant intermittant channel The existing perennial stream has a drainage area of approx 450 acres (0.7 sq mi) It has an average bankfall width of approx 11 feet It flows along the property line between the applicants land and her neighbor's land The stream banks are unstable and eroding in several areas such that the channel has migrated as much as 10 feet into the applicant's property places, this condition has been exacerbated by the aggressive placement of fill by the neighbors. The applicant wishes to stabilize the stream banks on her side of the stream using natural stabthty concepts and practices to the extent practical There are four general areas in need of stabilization measures these are shown on the attached sketch. In each case the banks will be laid back to _provide a bankfull bench These areas will be stabilized with root wads sod willow transplants and five stakes To the extent suitable rock can be found on site rock vanes will also be installed in the most vulnerable areas. While there will be disturbance of the stream bed in association with installation of root wads and vanes there will not be 4 BY fill laced in the channel and the stream bed bankfull boundaries will remain essentially unchaned as a result of the proposed project This phase of the project will involve stabilization of approximately 145 finear feet of stream bank A Nationwide Permit 13 is requested for this activity. The second phase of the project is to restore a section of small pWWortant intermittant channel that enters the perennial stream in the middle of the property. This smallchannel drains approximately 8.5 acres has a bankfull width of 6 feet and area of 4.4 square feet The existing mtermittant channel is stable for the first 80 linear feet below the road and property but becomes a deep eroded ditch for the last 50 feet above the perennial stream The applicant proposes to restore the lower 50 linear feet of this channel by constructing a step pool channel on new location as shown on the attached sketch and details. This channel will be stabilized with sod, plantings and rock cross vanes/step-pool.-structures placed to control grade A Nationwide Permit 39 is requested for this activity. 11. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
