APPROVAL of 401 Water Quality Certification
Dear Mr. Reinhardt:
You have our approval, in accordance with the attached conditions, to place fill and shade in 0.007 acre of coastal wetlands and
Public Trust Waters in order to relocate and modify an existing dock and to install a concrete boat ramp along the shoreline of a manmade
canal connecting to the Pamlico Sound in Dare County, as described in your application received by the Division of Water Quality on June
18, 2002. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number
3371, which can be downloaded from our web site at htti):Hh2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your
CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water
Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in
the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project, you
must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC
2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60
days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North
Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have any

the installation of a concrete boat ramp along the shoreline of a man-made canal that connects to the
Pamlico Sound in Brigands Bay, in Frisco, Dare County.

Project Setting
The application site is located at lot 455, Treasure Court, Brigands Bay Subdivision in Frisco,
Dare County. The site consists of an 8,414 sf lot, with a total of 80 if of shoreline along a
man-made canal that connects to the Pamlico Sound. Lot 455 is located along the west bank
of this canal. According to the application platwork and North Carolina General Warranty
Deed provided with the CAMA application, this property is owned by both, Mr. Reinhardt,
and his wife, Joy Reinhardt. The adjacent lot to the north, lot 456, is owned by Michael A.
Topp, and the lot to the south, lot 454, is owned by Winton E. Nichols, II. The Reinhardt
property includes a single family dwelling on pilings with a storage area and carport located
beneath the house structure. The entire dwelling is located within the Estuarine Shoreline
Area of Environmental Concern (AEC). Approximately one-third of the dwelling footprint is
located within the Coastal Shoreline 30 ft buffer. A bulkhead is also located along the canal
shoreline, and this structure's linear alignment is approximately 2 ft landward from the NWL.
A small 6 ft by 8 ft "L" style dock is located along the shoreline.
This lot has a level grade and has a reported elevation of 5 ft above the NWL. This lot is
maintained as a yard and is vegetated in almost entirely upland grasses and ornamental shrubs.
The area directly adjacent to the shoreline is vegetated in a two-foot to four wide Juncus
roemeriantis and Spartina alterniflora coastal wetland fringe that receives regular flooding
from the connecting waters of the Pamlico Sound. This fringe consists predominately of
Juncus roenmrianus, 'with the waterward most portion (1 ft) of this fringe consisting of
Spartina alterniflora. The fringe widens more to the south with the Spartina alterniflora
portion of the fringe expanding to a 2 ft width. A bulkhead structure is located along the
shoreline of the adjacent lot to the north and no stabilization structure is located near common
property line between lots 454 and 455. Docks and boat ramps, as well as shoreline
stabilization structures, are located along the shoreline of many of the nearby lots.
The canal width is approximately 100 ft. The water depth at this site, at a distance of 3 ft
beyond the NWL is less than one foot. The application reports that the water depth is 3 ft
below the NWL at a distance of 15 ft waterward of the NWL. The canal bottom consists of
predominately sand with little organic material. No significant areas of submerged aquatic
vegetation were observed along the shoreline during the application site visit. The waters of
this canal carry the same water classification as the Pamlico Sound. The North Carolina
Environmental Management Commission has designated these waters as "SA" waters (suitable
for shellfish propagation and harvesting); however, the waters in this vicinity are closed to the
commercial harvest of shellfish. During the site investigation visits, no shellfish were
observed along the water bottom in the vicinity of this project.
The Coastal Resources Commission (CRC) has also designated these waters as Public Trust
Area and Estuarine Water Areas of Environmental Concern (AEC). In addition, under the
designation of the CRC, the Coastal Shoreline AEC extends in a contour of 75 ft landward of

the NWL. The CRC has also designated coastal wetland vegetated areas, like the one
described above, as a Coastal Wetland AEC. The North Carolina Marine Fisheries and
Wildlife Resources Commissions classify the waters of the Pamlico Sound as Coastal Waters.
Project Description
A concrete boat ramp is proposed along the shoreline of lot 455. The ramp will be located in
an alignment perpendicular to the shoreline that will allow a boat to be backed through the
carport and into the canal. This will require the removal and relocation of the existing dock,
and the removal of a 12 ft wide portion of the existing bulkhead wall. The ramp construction
will also require the excavation of a 10 ft by 12 section of highground behind (landward of)
the bulkhead wall to allow the ramp to be located at a gradient that will provide a safe
operational slope to launch and retrieve a boat and trailer. The upper driveway portion of the
ramp will connect to the concrete carport drive beneath the house. The ramp will be a total
length of 20 ft and will be 12 ft wide. The ramp will be formed and cast on high ground, and
will be set in place afterwards. The ramp structure will be 4 inches thick and will extend
approximately 10 ft into the waters of the canal. This application does not propose any fill or
excavation below the NWL to construct or align the ramp gradient. The applicant then intends
to relocate and rebuild the dock, and position the dock structure to the immediate north of the
boat ramp location. This will allow the dock to also be used as a courtesy pier while a boat is
being launched or retrieved from the canal. This proposal does not include any maintenance
excavation of the adjacent canal bottom areas.
Anticipated Impacts
The proposed boat ramp will result in the filling of approximately 120 sf of Public Trust Area.
The ramp placement will also result in the loss of approximately 25 sf of coastal wetland
fringe habitat within and adjacent to these Public Trust Area and Estuarine Waters. The dock
relocation will result in the shading of about 12 sf of wetland fringe, and the shading of
approximately 150 sf of Public Trust Area. However, the current dock structure shades a
similar footprint of the same resources. The overall land disturbance within the Coastal
Shoreline, associated with the ramp installation will be approximately 170 sf. The structure
will result in a combined total of approximately 290 sf of wetland, water and upland land area
disturbance (or displacement) within the Estuarine System.
An inspection of mapping data on cultural resources revealed that several archaeological or
cultural resource findings had been recorded on the available maps in the immediate vicinity of
this project. It is important to not that Hatteras Island has a rich heritage in cultural resources,
and these resource maps have note been updated in at least 10 years. The potential for the
discovery of additional cultural or historical resources during site excavation is possible.

The proposed boat ramp installation activity will result in an increase in turbidity levels, at
least temporarily, along this portion of this waterway. The applicant has proposed a ramp
location that will intersect the shoreline at an area where the existing wetland fringe is
narrower and in doing so, will minimize the impacts to the existing coastal wetland fringe.
The proposed boat ramp will not encroach upon any neighboring or other public trust use, and
will provide an access for the property owner's use of the adjacent Public Trust Area of the
Pamlico Sound.

Enclosed is a completed CAMA Major Permit Application and plans
for the referenced project.
The applicant proposes the following under the enclosed
application;
Remove existing "T" head pier and construct a new "L" head
pier in the center of the lot. The waterway is approximately 100'
wide. The proposed pier will not extend more than 15' into the
waterway. A 6' wide elevated boardwalk will be constructed
over the wetland fringe to access the "L" head.
Construct a concrete boat ramp in the area of the existing pier.
The boat ramp cannot be constructed any further to the north
because of the existing septic system on the north side of the
residence. The boat ramp at this location avoids most of the
Spartina alterniaflora wetland fringe on the south side of the lot.
There are at least 2 other concrete boat ramps in this waterway.
