After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 160B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. PROJECT SUMMARY: This project involves the installation of a bulkhead for shoreline stabilization as well as the construction of a boat ramp and dock along the shoreline of a man-made canal that connects to the Pamlico Sound in Brigands Bay, in Frisco, Dare County. Diane C. Baublitz Field Investigation Report Page Two Project Setting The application site is located at lot 326, Kings Point Drive, Brigands Bay Subdivision in Frisco, Dare County. The site consists of an 8,418 sf lot, with approximately 60 if of shoreline along a man-made canal that connects to the Pamlico Sound. Lot 326 is located toward the dead end of this canal. According to the platwork and North Carolina General Warranty Deed provided with the CAMA application, this property is owned by Diane C. Baublitz and Americus J. Rambeau. This property is a vacant lot with no improvements. This lot has a level grade and has a reported elevation of 3.8 ft above the NWL. The soils on this lot are sandy with organic-hydric type soils found between the shoreline and a distance of 20 to 30 ft. from the shoreline. This lot is vegetated in both upland grasses, as well as many facultative and obligate wetland plant species. Some areas of the lot approximately 40 ft landward of the normal water line are vegetated with high marsh Spartina species. Much of the lot is vegetated with Spartina patens. Upland plant species include live oak and eastern cedar. The area directly adjacent to the shoreline is vegetated in an approximately 8 ft. wide band of Juncus roemerianacs, Spartina alterniflora and Spartina patens coastal wetland fringe. These wetlands receive both regular and occasional flooding from the connecting waters of the Pamlico Sound. This fringe consists predominately of Juncus roemerianus and Spartina alterniflora. Approximately a 3 ft wide fringe of Spartina alterniflora exists along this shoreline. One to 2 ft of the Spartina alterniflora fringe was observed waterward of the NWL on the day of the field investigation for this application review. Lot 327 is owned by the Revocable Trust of Harold J. Miller. A bulkhead structure, with a 15 ft. long return wall located along the common property line between lots 327 and 326, is located along the shoreline of lot 327. A 3 to 4 ft wide Spartina alterniflora fringe was present waterward of this bulkhead. According to discussions with the applicant's agent, the bulkhead along this wetland fringe was previously authorized through a CAMA Major Permit. Lot 325 is owned by James P. Mills, Jr. and the shoreline of this lot is not stabilized with any structures at the common property line of lots 325 and 326. Although the application states that 1 ft of erosion has occurred on this lot along this shoreline within the last year, little evidence of shoreline erosion existed along the shoreline of lot 326 on the day of this site evaluation. Evidence of erosion of this Spartina alterniflora fringe was not observed. The canal width appears to be less than 100 ft. The water depth at this site, at a distance of 3 ft offshore, is less than one ft at NWL. The application platwork indicates that the water depth 15 ft offshore is 3 ft at NWL. The canal bottom consists of predominately sand with little organic material. No significant areas of submerged aquatic vegetation were observed along the shoreline waters during the application site visit. The waters of this canal carry the same water classification as the Pamlico Sound. The North Carolina Environmental Management Commission has designated these waters as "SA" waters (suitable for shellfish propagation and harvesting); however, the waters in this vicinity are closed to the commercial harvest of shellfish. The North Carolina Marine Fisheries and Wildlife Resources Commissions classify the waters of the Pamlico Sound as Coastal Waters. During the site investigation, no shellfish were observed along the water bottom in the vicinity of this project. Juvenile finfish were observed within the waters and wetlands along the shoreline, as well as some crustaceans. The Coastal Resources Commission (CRC) has designated these waters as Estuarine Waters and Public Trust Areas of Environmental Concern (AEC). Also under the designation of the CRC, a Coastal Shoreline AEC extends in a contour of 75 ft landward of the NWL. The CRC has also designated coastal wetland vegetated areas, like the one described above, as a Coastal Wetland AEC. Project Description Diane C. Baublitz is the applicant for this CAMA Major Permit application. The application proposes to construct a boat ramp, bulkhead and dock on lot 326 along the shoreline of the canal. A concrete boat ramp is proposed along the southern property line at the shoreline. The ramp will be a total length of 22 ft and will extend approximately 10 ft into the waters of the canal. The ramp will be 12 ft in width. The concrete ramp will be formed and pre-cast in 4-inch thick sections on highground and will be set in place afterwards. A 12 ft long return wall will be constructed along the north side of the proposed ramp. This application does not propose any fill or excavation to construct or align the ramp gradient. This application does not include any proposal for upland fill for a driveway access to the ramp structure. The applicant proposes to stabilize the shoreline with a wood bulkhead and align this structure with the existing bulkhead on lot 327 to the south. A 12 ft long return wall will be installed between lots 326 and 325. According to the application, the proposed bulkhead will be a total length of 50' and the structure's alignment will not extend waterward of the NWL. The proposed bulkhead will be constructed of treated wood and the tieback area will be backfilled with sand from an off-site source. As proposed, the tieback and backfill area will extend approximately 12 ft landward of NWL. This proposed bulkhead alignment will result in the placement of no fill material below the NWL. The applicant also proposes to construct 10 ft by 14 ft dock somewhat near the center of the lot. A 5 ft wide by 6 ft long walkway is proposed to access the dock from the shoreline. The dock structure will be approximately 15 ft from the common property line of lots 326 and 325. The boat ramp and dock structures are proposed for private use of the property owner(s). This proposal does not include any maintenance excavation of the adjacent canal bottom areas beyond the boat ramp, bulkhead or dock structure alignments. Anticipated Impacts The bulkhead alignment is proposed to transect the existing coastal wetland fringe, resulting in the proposed filling and excavation of the remaining Juncus fringe. This bulkhead alignment will result in the filling of no Public Trust Area. However, the bulkhead (and boat ramp) will result in the loss of approximately 480 sf of coastal wetland fringe and the habitat within and adjacent to this coastal wetland fringe, Public Trust Area and Estuarine Waters. The overall land disturbance within the Coastal Shoreline, associated with the tieback area, will be approximately 720 sf. The bulkhead and boat ramp structures, and the backfill, tieback and grading activities associated with their installation, will result in a total of approximately 1,020 sf of coastal wetlands, water and land disturbance (or displacement) within the Estuarine System. An inspection of mapping data on cultural resources revealed that several archaeological or cultural resource findings had been recorded on the available maps in the immediate vicinity of this project. It is important to note that Hatteras Island has a rich heritage in cultural resources and these maps have not been updated in at least 10 years. The potential for the discovery of additional cultural or historical resources is possible. The proposed dock structure will shade 140 sf of Public Trust Area of waters that connect to the Pamlico Sound. The structure, as proposed in this application, also appears to shade approximately 30 sf of a• healthy coastal wetland fringe. The platwork does not indicate that this walkway will be elevated over the remaining wetland fringe. Elevating this walkway would minimize impacts on the remaining wetland fringe in the vicinity of this pier walkway. The proposed boat ramp and shoreline stabilization structures, and the filling and grading activities associated with their installation will result in an increase in turbidity levels, at least temporarily, along this portion of this waterway. The placement of a bulkhead structure may result in the alteration of the shallow water habitat bottom adjacent to the proposed bulkhead alignment. The project, as proposed, will bi-sect the existing healthy coastal wetland fringe, and it is anticipated that unless the bulkhead alignment is moved more landward than currently proposed, the remaining Spartina alterniflora fringe will be seriously impacted. In addition, the bulkhead structure's placement adjacent to the shoreline of a lot that is not currently stabilized may exacerbate erosion on the adjacent lot (lot 325). The proposed structures and their construction will not interfere with any riparian access or public trust concerns along this canal and this proposal does not include any maintenance excavation of the adjacent canal water bottom or upland site work not related to the installation of the boat ramp, bulkhead and dock. The applicant proposes the following under the enclosed application; Construction of 62 lin. ft. of bulkhead with backfill landward of NWL and a 3' fringe of Spartina alterniflora. Any 404 wetland on this site is minimal. The bulkhead proposed is in alignment with other previously permitted bulkheads to the south (i.e. see CAMA Permit #150-00 issued to Harold I. & Mary V.
