The proposed driveway improvements will comply with the Neuse River Buffer Rules (15A NCAC 2B .0233) if the following conditions are met. In addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go ahead with your project including (but not limited to) City of Raleigh construction permits, Erosion and Sediment Control and Non- Discharge. This determination is only valid for the purpose and design that you described and additional conditions listed below. If you change your project, you may be required to notify us and you may be required to send us an application for authorization. If the property is sold, the new owner must be given a copy of this letter and is thereby responsible for complying with all conditions. For this confirmation to be valid, you must follow the conditions listed below as well as any other conditions identified within 15A NCAC 213 .0233. Conditions: • Paving over the existing driveway (where crush and run currently exists) has been determined to be in compliance with the Neuse Buffer Rules (i.e., exempt) as long as no new impervious surface is added to the buffer in locations where it did not previously exist and diffuse flow of stormwater is maintained as per 15A NCAC 02B .0233(5). Please be aware that any impacts to wetlands or surface waters (e.g., streams) will need to comply with the 404 / 401 programs. Any additional impacts to the 50-foot protected buffers may be allowed, but will require written authorization from the DWQ prior to construction. Uses classified as "exempt" within the buffer rules (15A NCAC 02B .0233) are allowed without written authorization. On September 12, 2002, the DWQ placed the project on hold requesting additional information regarding your request to impact protected riparian buffers beyond the footprint of the existing impervious surfaces. (The DWQ has not yet received a written response to this letter.) On September 23, 2002, Mr. Steve Mitchell and myself met with you on the subject property to discuss your proposed project. During this meeting you described the additional impacts to the protected riparian buffer associated with the construction a driveway outside of the existing impervious surfaces. You stated that you did not wish to pave over the existing sewer easement because of the age of the sewer line and probability that it will need to replaced in the near future. You stated that you may need to disturb additional buffers uphill from the sewer easement in order to construct a driveway outside of the sewer easement. We informed you that the DWQ would be willing to review and potentially approve such an impact, but that it would require buffer mitigation as indicated within our September 12, 2002 letter. If you choose to pursue these impacts, then please respond to our September 12, 2002 letter. Be sure to provide written responses to all of the information requested within the letter, provide written justification of your reason for the additional impacts (as you stated to us in the field) and provide a mitigation plan (e.g., payment into the Riparian Buffer Restoration Fund) for the proposed impacts. Insufficient evidence is present in our files to conclude that your project must be built as planned in buffers in accordance with 15A NCAC 2B .0233. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your Authorization Certificate as required by 15A NCAC 26 .0233 and will place this project on hold as incomplete until we receive this additional information. Please provide us with information supporting your position that states your project must be constructed as planned and that you have no practicable alternative to impacting these waters. Specifically; 1. You have proposed to expand the width of an existing twelve (12)-foot wide driveway to approximately a thirty (30)-foot wide driveway. Please provide additional information as to why this plan can not be redesigned in a way to avoid or minimize the buffer impacts. 2. The site plan provided appears to measure the buffers from the centerline of the stream instead of the top of bank. The rules require that the buffer begin at the top of the bank. Please provide new plans that accurately depict the buffers starting from the top of bank. 3. Please be aware that the proposed use is classified as a "road impact other than crossings of streams and other surface waters subject to the Rule - allowable with mitigation". If approved, buffer mitigation will be required. You did not complete Part X. of the application. Please provide information on how you intend to mitigate (e.g., payment in to the Riparian Buffer Restoration Fund, Restoration or Enhancement of Buffers, etc.) for the buffer impacts as required under 15A NCAC 2B .0242. Partial mitigation might include removal of any unneeded part of the existing gravel road from the buffer. Please discuss this possibility in your response. Project Information Attach a vicinity map clearly showing the location of the property with respect -to local landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property boundaries and development plans in relation to surrounding properties. Both the vicinity map and site plan must include a scale and north arrow. The specific footprints of all buildings, impervious surfaces, or other facilities must be included. If possible, the reaps and plans should include the appropriate USGS Topographic Quad Map and NRCS Soil. Survey with the property boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion, so long as the property is clearly defined. For administrative and distribution purposes, the USACE requires information to be submitted on sheets no larger than 11 by 17-inch format; however, DWQ may accept paperwork of any size. Enclosed please find a soils map complete with topographic information as well as a plait map from Wake County Geographic Information Services. I have also enclosed a copy of a survey of the lot that was preformed by John Phelps, our surveyor this spring. Furthermore, I have enclosed an Account Summary from the Wake County Real Estate Data Base that provides other pertinent information for the lot including the book and page numbers as well as various other aspects of tax information. Concerning the impact of the proposed driveway to the vegetation presently on the lot, it is our intention to only pave the existing area where crush and run exists, and to only remove three dead trees. We would also like to have permission to encroach on the outer 20% of the existing buffer which will allow us to tie this driveway into the new house being constructed. The existing driveway has been in this present location for approximately 30 years. It also spans a sewer easement which is regularly maintained by the City of Raleigh as was seen by Steve Mitchell upon his inspection of the lot earlier this spring. At that time, Mr. Mitchell also stated that his office did not need to be involved with this lot upon permitting, I am noting that for reference for the City of Raleigh.
