This letter shall act as your approval for the use of the "General" Major Variance; From the Neuse and Tar-Pamlico Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots within the Coastal Counties as defined by the Coastal Area Management Act with ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management Commission (EMC) on May 10, 2001. In addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control and CAMA permits. This approval is only valid for the purpose and design that you described in your variance request May 1, 2002 and received by the Division of Water Quality (DWQ) Wetlands/401 Unit on June 12, 2002 except as modified below. If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. 1. Stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers as identified within 15A NCAC 213 .0259(5). No new ditching or piping of stormwater through the protected buffers is allowed. 2. No impacts (e.g., clearing of trees, new impervious surfaces, etc.) shall occur to Zone 1 of the protected riparian buffers (except for "exempt" activities) unless otherwise approved by the DWQ. I have listed the lot for sale and I want to have the necessary permits in place should an interested party make an offer I would be able to close within 30 to 45 days. The lot is 50x135 as shown on the enclosed map with septic tank installed and completed in 1985. 1 have enclosed a copy of the Septic permit signed off by Ricky Gibbs, Sanitation Inspector at the time. Also, I have also enclosed a copy of the deed showing the date Oyster Creek was platted November 20, 1969. There is a residential home on the left and right of Lot 114. This lot should be allowed to be developed as ones already have been that subdivision. The owners have already invested time and money in purchasing this lot, and now to reduce their investment by limiting the size of the house that can be built would be a hardship to them. The difference in the size of the house would almost double (see drawing of lot). With the 30'variance in place, the house size could be 1428 sq ft, and if not allowed the house could only be 748.
