Extension project as described in your application dated June 7, 2002. This letter shall act as your approval for the use of the "General" Major Variance; From the Neuse, Tar-Pamlico, Randleman and Catawba Riparian Buffer Protection Rules for expansions of and improvements to AIRPORT FACILITIES with ADDITIONAL CONDITIONS as approved by the Water Quality Committee (WQC) of the Environmental Management Commission (EMC) on April 10, 2002. In addition, you should get any other required federal, state or local permits before you proceed with your project including (but not limited to) Sediment and Erosion Control permits. This approval is only valid for the purpose and design that you described in your variance request dated June 7, 2002 except as modified below. If you change your project, you must notify us and you may be required to send us a new request for approval. If the property is sold, the new owner must be given a copy of this approval and is thereby responsible for complying with all conditions. For this approval to be valid, you must follow the conditions listed below. Conditions: You are required to mitigate for impacts to the protected riparian buffers. The required area of mitigation to compensate for impacts to the protected riparian buffers is 60,812 square feet as required under this variance approval and 15A NCAC 26 .0242. We understand that you wish to make a payment into the Riparian Buffer Restoration Fund administered by the NC Wetlands Restoration Program (WRP) to meet this mitigation requirement. This has been determined by the DWQ to be a suitable method to meet the mitigation requirement. In accordance with 15A NCAC 2B .0242(7), this contribution will satisfy our compensatory mitigation requirements under 15A NCAC 2B .0233(9)(C). Until the WRP receives and clears your check (made payable to: DENR - Wetlands Restoration Program Office), no impacts specified in this approval shall occur. The Authority makes this submittal pursuant to and in accordance with the General Major Variance recently adopted by the Environmental Management Commission, using the PCN because the GMV Form is not yet available. The Site Preparation for Taxiway L Extension Project (the Project) is not subject to the requirements of the "No Practical Alternatives" test under the Water Supply Rule or the 401 Rules. Describe the existing land use or condition of the site at the time of this application: The existing land use is airport/industrial. The project site is in a developed area on airport property, adjacent to the project area for Taxiway J. Other airport development previously disturbed the project area, which is currently relatively steeply graded maintained grasslands. 7. Property size (acres): The Raleigh-Durham International Airport occupies more than 5,000 acres. This site preparation project would disturb an area approximately one acre in size, and would revegetate the area (with the types of maintained grassland that is at the site today) following grading, pending future development in the vicinity. 8. Nearest body of water (stream/river/sound/ocean/lake): Stormwater basin "004," which outfalls to an unnamed tributary of Sycamore Creek. 9. River Basin: Neuse River. (Note - this must be one of North Carolina's seventeen designated major river basins. The River Basin map is available at http://h2o.enr.state.nc.us/admin/maps/.) 10. Describe the purpose of the proposed work: The primary purpose of this project is to perform site preparation (filling and grading) for the second phase of the extension of Taxiway L. The first phase of Taxiway L extension will Page 2 of 10 connect Taxiways J and L. The second phase of Taxiway L extension will provide access to the planned Air Cargo Complex from the intersection of Taxiways J and L, as shown on the Airport Layout Plan (ALP) in Attachment 3. The second phase of Taxiway L extension will require a significant amount of earthwork and grading because of the existing topography north and east of the intersection of Taxiways J and L. This project is intended to avoid the significant operational issues and safety concerns that would arise if site preparation for the second phase of Taxiway L extension were deferred until the construction of the Air Cargo Complex, at which point Taxiways J and L will be heavily-used, active taxiways. FAA Advisory Circular 150/5370-2D, Operational Safety on Airports During Construction, sets forth the guidelines for ensuring operational safety during periods of construction. These guidelines mandate that all personnel and equipment operating in an active taxiway safety area must be mobile and moved out of the area for each passing aircraft. It will not be feasible to remove personnel and equipment from the area of the second phase Taxiway L extension construction site for every aircraft using Taxiway J, which will be the only cross-field taxiway at the north end of the airport. Therefore, the presence of the construction operations will require closure of Taxiways J and L. Short-term closures of Taxiways J and L necessary to build the second phase of Taxiway L extension will be manageable; longer-term closures that would be necessary allow access for equipment to fill and grade the site and then build the second phase of Taxiway L extension are not feasible. In other words, deferring site preparation for the second phase of Taxiway L extension would severely disrupt operation of the Airport due to FAA requirements to ensure safety in areas of construction. By completing this project and performing second phase Taxiway L extension site preparation activities before Taxiway J is an active taxiway, the Authority will minimize these operational conflicts and safety concerns. The elevation difference between the future edge of the second phase Taxiway L extension safety area and the existing stormwater channel into the stormwater retention basin is approximately 40 feet. The distance between the future edge of the second phase Taxiway L extension safety area and the edge of the stormwater retention basin is approximately 130 feet. FAA Advisory Circular (AC) 150/5300-13, Airport Design, includes dimensional design standards for taxiways, including taxiway shoulders and taxiway safety areas. For Airplane Design Group IV aircraft, the width of a taxiway and its shoulder and safety area is 171 feet. Beyond that width, this AC recommends a maximum fill slope of 4:1 in order to minimize the risk to aircraft that might leave the taxiway and shoulder. Therefore, in anticipation of these design standards, it is necessary to pipe the existing length of stormwater channel (approximately 220 feet) to perform site preparation for the second phase Taxiway L extension. Although the existence of the stormwater retention basin precludes achieving a 4:1 slope, piping the channel to the edge of the stormwater retention basin will create sufficient room for an approximate 3:1 slope. Piping this length of stormwater channel will significantly reduce the steepness of the slope that would otherwise be required, thereby minimizing the risk to aircraft that might stray from the taxiway surface. The Authority anticipates that the FAA would accept a request for a waiver of the design standard in this instance. As a secondary benefit of the project, these site preparation activities would eliminate some non-standard slopes that currently exist on the north and northeastern edges of the current Page 3 of 10 design for the area of the intersection of Taxiway J and the Taxiway L extension. This area was designed and approved prior to adoption by the Environmental Management commission of the Airport General Major Variance (GMV). Because the GMV was not then available, the design includes very steep slopes in order to avoid impacts to Zone 1 surrounding the stormwater retention basin area and to limit the grading and revegetating activities in Zone 2 of that basin area. Although approved by the FAA, these non-standard shoulder slopes located at a relatively sharp curve in the future Taxiway J present a safety concern to aircraft on the taxiway. Site preparation for the second phase Taxiway L extension ameliorates this situation and increases the margin of safety of aircraft maneuvering on Taxiways J and L. 11. List the type of equipment to be used to construct the project: The project includes earthwork, drainage, and erosion control. The project requires construction equipment necessary to perform these functions. 12. Describe the land use in the vicinity of this project: The land in the immediate vicinity of the project is generally airport/industrial land use, including access roads and the Airport General Aviation Area. IV. Prior Project History If jurisdictional determinations and/or permits have been requested and/or obtained for this project (including all prior phases of the same subdivision) in the past, please explain. Include the USACE Action ID Number, DWQ Project Number, application date, and date permits and certifications were issued or withdrawn. Provide photocopies of previously issued permits, certifications or other useful information. Describe previously approved wetland, stream and buffer impacts, along with associated mitigation (where applicable). If this is a NCDOT project, list and describe permits issued for prior segments of the same T.I.P. project, along with construction schedules. The Authority has not requested jurisdictional determinations or permits for this project. However, the Authority has an Airport-wide jurisdictional determination plat (Action ID 19921400, signed by the Corps September 27, 1999) that includes the project area. Attachment 4 provides a copy of the section of the plat that includes the project area. The Corps determined that the stormwater retention basin is "waters of the United States" and that a stormwater drainage channel between the pond and a pipe that is part of the Authority stormwater system is not .jurisdictional. The Division of Water Quality determined that the stormwater drainage channel and stormwater retention pond both are subiect to the Neuse Rules. V. Future Project Plans Are any future permit requests anticipated for this project? If so, describe the anticipated work, and provide justification for the exclusion of this work from the current application. The December 1994 Long-Range Planning Committee Report on Master Plan Alternatives -fo Raleigh-Durham International Airport. Volume I - Master Plan Alternatives ("Master Plan") contemplates future development of the immediate area. The proposed project, which partially prepares the site for that development, is consistent with the Master Plan. The Authority anticipates that the future development of the area may require permits. However, although the 1994 Master Plan includes extension of Taxiway L and construction of a cargo area, Page 4 of 10 that development is not yet in the pre-design phase. Therefore, insufficient information is available and it is not viable to include that work in this application, because the extent of impacts and need for permits are unknown. VI. Proposed Impacts to Waters of the United States/Waters of the State It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to wetlands, open water, and stream channels associated with the project. The applicant must also provide justification for these impacts in Section VII below. All proposed impacts, permanent and temporary, must be listed herein, and must be clearly identifiable on an accompanying site plan. All wetlands and waters, and all streams (intermittent and perennial) must be shown on a delineation map, whether or not impacts are proposed to these systems. Wetland and stream evaluation and delineation forms should be included as appropriate. Photographs may be included at the applicant's discretion. If this proposed impact is strictly for wetland or stream mitigation, list and describe the impact in Section VIII below. If additional space is needed for listing or description, please attach a separate sheet. 1. Provide a brief written description of the proposed impacts: The project would not impact wetlands or waters of the United States. The project would impact riparian buffer (both Zone 1 and Zone 2) along the stormwater drainage channel. The project would convert a length of an open stormwater drainage channel to piped flow between an existing 78-inch stormwater pipe and downstream stormwater retention basin. This ephemeral or intermittent drainage channel delivers flow from the stormwater system to the basin. This open stormwater drainage is not a jurisdictional water of the United States (see Attachment 4). The project will not disturb the existing stormwater retention basin, which the Corps has classified jurisdictional. The riparian buffer impacts would be to both Zone 1 and Zone 2 buffer, along the entire length (approximately 220 feet) of the drainage channel, which DWQ determined to be a subject feature. Riparian buffer impacts to Zone 2 of the riparian buffer around the stormwater retention pond might occur, depending on site geometry and FAA approval of a waiver of the maximum 4:1 fill slope design standard. Impacts would be limited to grading and revegetating. The project is to regrade the area as site preparation; therefore, although the project would alter the topography in the vicinity, the project would not add impervious surface and would revegetate the entire disturbed buffer with the same type of grass that exists today. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. Discuss stormwater controls proposed in order to protect surface waters and wetlands downstream from the property. The project will not add impervious surface. Stormwater from this drainage basin flows through the stormwater system to the existing stormwater retention basin "SDO 004" via several large pipes. The Authority installed SDO 004 in the early 1990s as an element of the North Cargo Ramp development. The Authority Page 9 of 10 constructed this pond as a permanent facility for water quality and peak flow reduction for the air cargo complex. The pond design accommodated the ultimate development of the RDU cargo complex and the associated changes in character and size of the watershed. Post-development assumptions included all long-range plans for taxiways, roadways, and aprons. The project would include necessary erosion and sediment control measures. XII. Sewage Disposal (DWQ Only) Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of wastewater generated from the proposed project, or available capacity of the subject facility. The proposed project will not generate wastewater. The presence of workers at the project sight may add a minor amount of domestic wastewater to the Raleigh-Durham Airport Authority collection system, which discharges sanitary wastes to the Town of Cary, under a Wastewater and Sewer Agreement.
