Dear Mr. Tyndall:
You have our approval, in accordance with the attached conditions (WQC # 3371) to do the
following activity at 801 Sutton Steam Plant Road in Wilmington in New Hanover County. This
approval allows you to:
1). Dredge 60,000 square feet of shallow bottom habitat (22,000 cubic yards of material to be
removed) for maintenance dredging of a boat/barge basin.
This approval is only valid for the purpose and design that you described in your CAMA application
dated April 17, 2002 received by the Division of Water Quality (DWQ). After reviewing your
application, we have determined that General Water Quality Certification Number 3371 covers this
activity. This Certification can also be found on line at:
http:/Wo.enr.state.nc.us/ncwetlands/certs.html.
This Certification allows you to use your CAMA Permit when the NC Division of Coastal
Management issues it. Please keep in mind that there may be additional Federal, State or Local
regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-
Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval
will expire when the accompanying 404 or CAMA Peat expires unless otherwise specified in the
General Certification.
Please be aware that if you change or modify your project, you must notify the Division
(DWQ) in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is
thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the
future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506
(h). For this approval to be valid, you must follow the conditions listed in the attached certification and
the additional conditions listed below.
1). When dredging the basin, turbidity must be controlled so that at turbidity. does not exceed 50 NTUs
outside the project area. The use of turbidity curtains may be required,if the turbidity exceeds this
threshold. Please contact this Office at the number listed below if there are any problems with
turbidity;
2). The attached Certificate of Completion (COC) must be submitted to the Division upon final
construction of the site.

The project site is located at 801 Sutton Steam Plant Rd., off US Hwy. 421, on the north side of the
Cape Fear River, in New Hanover County. The 3,300 acre tract is the site of the Sutton Power Plant,
a coal fired, steam turbine generator facility which provides electricity to Wilmington and the
surrounding counties. The tract has over three (3) miles of shoreline on the Cape Fear River. The
facility includes the steam plant and associated offices, buildings and electrical sub-stations; a closed
system of thermal wastewater cooling lakes, two diked ash pond retention areas (150 acres), a diked
petroleum storage tank area, a diked coal storage area, and a boat/barge basin and wharf. The barge
facility was constructed in 1971 and consists of an existing basin (350' X 190') and an adjacent
concrete dock (350 feet long and 50 feet wide). There is a system of old pumps and pipes on the
dock, once used to unload fuel oil, that will be dismantled and removed. The dock is fronted by a
steel bulkhead, which is fitted with a timber fender system. The remainder of the basin shoreline is
stabilized by rip rap (stone).
In the project area, the waters of the Cape Fear River are classified as C-Sw, by the NC Division of
Water Quality. These waters are designated as Primary Nursery Area (PNA), by the NC Division of
Marine Fisheries. The Cape Fear River is approximately 600 feet wide in this location, and is
classified as Joint waters by the NC Division of Marine Fisheries and the NC Wildlife Commission.
The applicants propose to perform maintenance dredging of the existing basin. The project
dimensions are 400 feet long and 150 feet wide, to its previously permitted depth of -14 feet at mean
low water QvMW). The work would be -completed by hydraulic pipeline dredge. Given the existing
water depths, the project would produce approximately 22,000 cubic yards of spoil material. This
material would be pumped to an existing 68 acre, diked ash disposal area, which is not currently in
use and is located approximately 2,000 feet west of the project site. The applicants propose _to replace.
the three (3) existing and add two (2) mooring dolphins on the south side of the basin. Eight (8)
additional mooring dolphins are proposed along the north downstream bank of the river (30' to 40'
offshore) to create a barge staging area. Each dolphin would consist of _a seen -(7)pile .cluster- The
existing timber fender system would be repaired as necessary. On the dock -and _llighground area, a
crane and hopper/conveyor system is proposed to unload the coal from the barges and transport it to
the coal storage area.
ANTICIPATED IMPACTS
The proposed project would disturb 60,000 square feet of previously dredged bottom. Given its large
area (68 acres), it is unlikely that the deposition of excavated material within the existing diked ash
disposal area would reach the discharge elevation of the water control structure. However, should a
discharge occur, the water-control structure is piped to the cooling lake and would not effect surface
waters. The project would facilitate continued operation of the Carolina Power & Light Company's
Sutton Power-Plant.
