Todd and I would like to meet with you and Coleen sometime in October to
discuss problems that we've had with diffuse flow and the buffers. We
have two projects that we think are good examples. One has been issued
and they had to provide us information showing diffuse flow and the
other is currently on hold do to diffuse flow issues. If you agree
please pass on to Coleen requesting a meeting sometime in October. I
have the projects in my office if you want to review them. Also, a
local engineering firm has discussed with Todd and I the possibility of
coming forward with a request for a general variance to cover diffuse
flow issues.

1. The pipe at the crossing has been revised to incorporate a shorter 72" round pipe
with headwalls so the stream impact including the dissapator is now less that the
approved permit. The total impact is now approximately 145 linear feet of stream
channel and the approved permit is for 149 linear feet.
2. The entire site is now shown on the Stormwater Management Plan and we have
designed for diffuse flow at all discharge points entering the buffer.
3. Discharges from several of the pipe outlets occur in existing drainage ways
which are required Wake County buffers. We have designed a rock dam diffuser
which utilizes a broad crested weir to diffuse the flow in the existing drainage
way prior to entering the Riparian Buffer. These rock dams will be located just
outside the Riparian Buffer in the flatter floodplain areas of the existing drainage
ways.
Based on our discussions, we have decided to go with diffuse flow at all point
discharges rather than treatment with a BW so as to avoid additional written

In order to fulfill the requirements specified in condition no. 1 of the 401 Water Quality Certification and Authorization
Certificate for impacts to the Neuse riparian buffers, this Office received plans on August 27, 2002, regarding the
requirement in the Neuse Buffer Rules (15A NCAC 2B .0233) to provide diffuse flow of stormwater through the entire
riparian buffers. The plans do not provide enough information to meet the above condition. The following is required to
meet the condition:
1) The plans show additional impacts to streams and, possibly, buffers in excess of those approved in the above
Certification. If the road crossing is built as show it is possible that stream and buffer mitigation would be required.
Also, it would be necessary to modify the Certification to account for the impacts. This would require a complete
application and appropriate fee in order for this Office to review whether or not the additional impacts could be
approved, as well as whether or not mitigation would be required.
2) The stormwater plan did not show how diffuse flow would be achieved for all of the stormwater from the entire site.
The condition states in part, "The plan shall specify all stormwater discharge points, plan details, and calculations to
indicate that diffuse flow through the protected buffers as described above will be achieved." As such, condition no. 1
has not been met and you may not proceed to conduct the impacts until plans have been provided for all of the
stormwater from the entire site.
3) Of the plans that were provided, the discharges from FES 42 and FES #16 appear to be into existing drainage ways.
As such, it is not anticipated that diffuse flow would be achieved since water tends to concentrate quickly in existing
drainage ways. It is recommended that the plans be revised to ensure compliance with the Certification and the
Neuse Buffer Rules.

Please be in receipt of the attached plans and calculations for stormwater discharge at the project
known as the Bunn Tract subdivision, located off of Ghoston Road in Raleigh, Wake County,
North Carolina. A condition of the 401 Water Quality Certification issued for this project
requires that the applicant provide a stormwater management plan to the DWQ that demonstrates
diffuse flow through the Neuse Buffers prior to conducting impacts. The attached stormwater

Rules (15A NCAC 2B.0233) with ADDITIONAL CONDITIONS
Dear Mr. Gwynn:
You have our approval, in accordance with the attached conditions and those listed below, to impact 149 feet of perennial
stream and 13,918 ft2 of riparian buffers to construct the proposed road crossing at the subject property as described
within your application dated May 23, 2002. After reviewing your application, we have determined that this fill is covered
by the Division of Water Quality (DWQ) General Water Quality Certification Number 3362. This Certification allows you to
use Nationwide Permit No. 39 when issued by the US Army Corps of Engineers (USACE). This letter shall also act as
your approved Authorization Certificate for impacts to the protected Neuse riparian buffers as required under 15A NCAC
2B .0233(8). In addition, you should get or otherwise comply with any other federal, state and local requirements before
you go ahead with your project including (but not limited to) Erosion and Sediment Control Permit and water supply
regulations. Also, this approval will expire when the accompanying 404 permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with
all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 feet of stream,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). Also, if total fills associated
with the road crossing (now or in the future) exceed 1/3 acre or 150 feet of protected buffers, compensatory
buffer mitigation may be required as described in 15A NCAC 2B .0233. For this approval to be valid, you must follow
the conditions listed in the DWQ General Water Quality Certification No. 3362 and any additional conditions listed below.
Conditions:
1. Diffuse Flow (Review)
An additional condition is that stormwater shall be directed to flow in a diffuse manner at non-erosive velocities
through the entire protected stream buffers without re-concentrating. Additionally, a stormwater management plan for
this project shall be provided to this Office before any of the impacts approved herein are conducted. The plan shall
specify all stormwater discharge points, plan details, and calculations to indicate that diffuse flow through the
protected buffers as described above will be achieved.
2. Deed notifications
Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective
buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in

It you do not accept any of the conditions of this certification, you may ask for an adjudicatory treating. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27699-6714. This certification and its conditions are final and binding unless you ask fora hearing.

On behalf of Alliance Construction, Inc. (property owner), we hereby request a
jurisdictional determination for the subject property and authorization from the US Army
Corps of Engineers to use Nationwide Permits 39 to cover impacts to a perennial stream
channel. We also request written concurrence from the NC Division of Water Quality
(NC-DWQ) that the project complies with the 401 Water Quality Certification associated
with Nationwide Permit 39 and the Neuse River Basin buffer rules. A Pre-construction
Notification Application (PCN) is attached, as well as an agent authorization form.
The proposed project consists of a residential subdivision and is located approximately
3500 feet northeast of the intersection of NC 50 and NC 98. Please refer to the USGS
topographic map attached for the location of the project. S&EC conducted a detailed
wetland delineation and Neuse River Basin (NRB) Riparian Buffer evaluation on the
property in February 2002. On February 28, 2002, Ms. Deborah Edwards of NC-DWQ
evaluated the subject property and determined that features B and D are subject to the
Buffers for the entire length of the property and features C and E become subject at flags

115 and 154, respectively (see attached Soil Survey map). Ms. Edwards determined that
feature F was not subject to the Buffers (see attached letter, dated 3/4/02). Please note
that the project boundaries have changed since Ms. Edwards' site visit, and the subject
project no longer includes the parcel to the west that contains features "A" and "B".
An unnamed tributary to Falls Lake separates the eastern and western halves of the
property. The applicant proposes to impact this stream with a road crossing in order to
access to the western portion of the property (see impact 1 on attached impact map). The
proposed crossing will impact 149 linear feet of perennial stream channel and 8,154
square feet (0. 1872 acre) of Zone I and 5,918 square feet (0.1359 acre) of Zone 2 of the
riparian buffer (see figure 4).
The USACE's current policy requires applicants to avoid and minimize wetland and
stream channel impacts to the maximum extent practicable and may require
compensatory mitigation to offset unavoidable losses of waters of the US when impacts
exceed the requirements for notification (0. 10 acre) or if a discharge to a special aquatic
site such as wetlands is proposed. The applicant requested a detailed delineation of
wetlands present on property prior to site plan development in order to avoid
jurisdictional wetlands to the maximum extent practicable. However, an unnamed
tributary to Falls Lake separates the eastern and western halves of the property. The
applicant plans to use the existing Hawk Hollow Lane, which stubs into the southeastern
corner of the site, to access the property. In order to access the western half of the site
from the eastern side of the property, the applicant plans to construct a road crossing of
channel feature D (see figure 3). The applicant designed the roadway to cross the
channel at an approximately perpendicular angle to minimize impact. Because the
applicant has designed the proposed road crossing at a perpendicular angle to the channel,
and because no other impacts to jurisdictional wetlands or waters are proposed for the
project, S&EC believes the USACE should not require further compensatory mitigation
for this project.
NC-DWQ's current policy does not require wetland or stream mitigation for wetland and
stream channel impacts below 1 acre and 150 linear feet of perennial channel per project.
Because the total cumulative permanent impacts for the site are below these thresholds

(0.0 acre of wetland, 149 linear feet of perennial channel), S&EC believes that neither
wetland nor stream mitigation should be required by NC-DWQ.
Current NC-DWQ policy allows road crossings without mitigation if the impacts are less
than or equal to 150 linear feet of stream channel or 1/3 acre of riparian buffer per
tributary. Because the project impacts are within these thresholds (149 linear feet of
channel, 13,918 Q / 0.32 acre of buffer), S&EC believes that riparian buffer mitigation
should not be required.

Pre-Construction Notification (PCN) Application Form
For Section 404 and/or Section 10 Nationwide, Regional and General Permits, Section 401
General Water Quality Certifications, and Riparian Buffer and Watershed Buffer Rules
This form is to be used for projects qualifying for any of the U.S. Army Corps of Engineers' (USACE)
Nationwide, Regional or General Permits as required by Section 404 of the Clean Water Act and/or
Section 10 of the Rivers and Harbors Act, and for the North Carolina Division of Water Quality's
(DWQ) associated General 401 Water Quality Certifications. This form is also to be used for any
project requiring approval under any Riparian Buffer Rules implemented by the N.C. Division of Water
Quality. This form should not be used if you are requesting an Individual 404 Permit or Individual 401
Water Quality Certification. The USACE Individual Permit application form is available online at
http://www.saw.usace.army.miI/wetlands/Penn app.htm.
The USACE is the lead regulatory agency. To review the requirements for the use of Nationwide,
Regional or General permits, and to determine which permit applies to your project, please go to the
USACE website at http://www.saw.usace.anny.niil/wetiaiids/rei-,tour.litni, or contact one of the field
offices listed at the end of this application. The website also lists the responsible project manager for
each county in North Carolina and provides additional information regarding the identification and
regulation of wetlands and waters of the U.S.
The DWQ issues a corresponding Certification (General or Individual), and cannot tell the applicant
which 401 Certification will apply until the 404 Permit type has been determined by the USACE.
Applicants are encouraged to visit DWQ's 401/Wetlands Unit website at
http://h2o.enr.state.ne. us/ncwetlands to read about current requirements for the 401 Water Quality
Certification Program and to determine whether or not Riparian Buffer Rules are applicable. The
applicant is also advised to read the full text of the General Certification (GC) matching the specific 404
Permit requested. In some cases, written approval for some General Certifications is not required,
provided that the applicant adheres to all conditions of the GC. Applicants lacking access to the internet
should contact DWQ's Central Office in Raleigh at (919) 733-1786.
Trout Waters Coordination - Special coordination with the North Carolina Wildlife Resources
Commission (NCWRC) is also required for projects occurring in any of North Carolina's twenty-five
counties that contain trout waters. In such cases, the applicant should contact the appropriate NCWRC
regional coordinator (listed by county on the last page of this application).

CAMA Coordination - If the project occurs in any of North Carolina's twenty coastal counties (listed on
the last page of this application) the applicant should also contact the North Carolina Division of Coastal
Management (DCM) at (919) 733-2293. DCM will determine whether or not the project involves a
designated Area of Environmental Concern, in which case DCM will act as the lead permitting agency.
In such cases, DCM will require a Coastal Area Management Act (CAMA) Permit and will coordinate
the 404/401 Permits.
USACE Permits - Submit one copy of this form, along with supporting narratives, maps, data forms,
photos, etc. to the applicable USACE Regulatory Field Office (addresses are listed at the end of this
application). Upon receipt of an application, the USACE will detennine if the application is complete as
soon as possible, not to exceed 30 days. This PCN form is designed for the convenience of the applicant
to address information needs for all USACE Nationwide, Regional or General pennits, as well as
information required for State authorizations, certifications, and coordination. Fully providing the
information requested on this form will result in a complete application for any of the USACE
Nationwide, Regional or General permits. To review the minimum amount of information that must be
provided for a complete PCN for each USACE Nationwide permit, see Condition 13, 65 Fed.Reg. 12893

Processing times vary by permit and begin once the application has been determined to be complete.

401 Water Quality Certification or Buffer Rules - All information is required unless otherwise stated
as optional. Incomplete applications will be returned. Submit seven collated copies of all USACE
Permit materials to the Division of Water Quality, 401 /Wetlands Unit, 1650 Mail Service Center,
Raleigh, NC, 27699-1650. If written approval is required or specifically requested for a 401
Certification, then a non-refundable application fee is required. In brief, if project impacts include less
than one acre of cumulative wetland/water impacts and less than 150 feet cumulative impacts to
streams, then a fee of $200 is required. If either of these thresholds is exceeded, then a fee of $475 is
required. A check made out to the North Carolina Division of Water Quality, with the specific name of
the project or applicant identified, should be stapled to the front of the application package. For more
information, see the DWQ website at http://h2o.ehnr.state.nc.us/newetlands/fces.htini. The fee must be
attached with the application unless the applicant is a federal agency in which case the check may be
issued from a separate office. In such cases, the project must be identifiable on the U.S. Treasury check
so that it can be credited to the appropriate project. If written approval is sought solely for Buffer Rules,
the application fee does not apply, and the applicant should clearly state (in a cover letter) that only
Buffer Rule approval is sought in writing. Wetlands or waters of the U.S. may not be impacted prior to
issuance or waiver of a Section 401 Water Quality Certification. Upon receipt of a complete application
for a 401 Certification, the Division of Water Quality has 60 days to prepare a written response to the
applicant. This may include a 401 Certification, an on-hold letter pending receipt of additional

III. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property

A site meeting was held with Ms. Deborah Edwards of the NC-DWQ to determine the location
of Neuse Buffers on the property. A copy of the letter describing, her determination is attached
(NBRRO 02-049).

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
The applicant reauested a detailed delineation of wetlands prior to site plan development in
order to avoid jurisdictional wetlands to the maximum extent practicable. However, channel
"D", an unnamed tributary to Falls Lake, separates the eastern and western portions of the
property. The applicant plans to use the existing Hawk Hollow Lane, which stubs into the
southeastern corner of the site to access the property. In order to access the western half of the
site the applicant plans to construct a road crossing of channel feature 2. The applicant designed
the roadway to cross the channel and riparian buffer at an approximately perpendicular angle to
minimize impact.
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.

USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://h2o.enr.state.nc.us/ncwetlands/stmigide.htjiii.
Provide a brief description of the proposed mitigation plan. The description should provide

of Property, Conservation Easement, Riparian Buffer Restoration / Enhancement, Preservation or
Payment into the Riparian Buffer Restoration Fund). Please attach all appropriate information as
identified within 15A NCAC 213 .0242 or.0260.
NA - Current NC-DWQ policy requires Buffer mitigation for impacts greater than 1/3 acre or
150 linear feet of riparian buffer. Because the applicant is below this threshold, S&EC believes
Buffer mitigation should not be required by the NC-DWQ.
XI. Stormwater (DWQ Only)
Describe impervious acreage (both existing and proposed) versus total acreage on the site.
Discuss stormwater controls proposed in order to protect surface waters and wetlands
downstream from the property.
According to Mr. John Callahan (John A. Edwards and Company, impervious surface coverage
on-site will not exceed 15%. Silt fencing and temporary sediment basins will be used during
construction to control stormwater run-off.

Clearly detail the ultimate treatment methods and disposition (non-discharge or discharge) of
wastewater generated from the proposed project, or available capacity of the subject facility.

This letter will serve as confirmation of the buffer determination made by S&EC at the
subject property referenced by the Raleigh Regional Office as NBRRO 02-049.
On February 28, 2002, I conducted a site visit at the above referenced project as identified
on the attached maps. It was determined that the Features A, B, C, D, E and F shown on the
Wake County Soil Survey and on the USGS Bayleaf, NC Quad map are subject to protection
under the Neuse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and
Maintenance of Existing Riparian Areas, Administrative Code T15A: 0213.0233 (NCAC .0233).
Features A, B and D are subject for the entire length while on property, feature C is subject below
flag 115 (start NBR), feature E is subject below flag 154 (start NBR) and feature F is not subject.
This letter only addresses, the applicability of the Neuse Buffer Rules. For information
relevant to wetlands and other impacts, please contact the Central Office at 733-1786. Thank you
