We received your request for a modification to the 401 Water Quality Certification for the above-referenced
property, issued on April 19, 2006. In your 401 Certification approval Letter, condition N. 8 states that since a
herbaceous riparian buffer was being planted beyond zone 2 (out to 200 feet), no credit would be given.
Per your request dated November 17, 2009, DWQ approves of the requested modification to the existing 401
Water Quality certification, and pending meeting the success criteria of at least 320 stems per acre at the end
of five years of monitoring, nutrient offset credit can be generated out to 200 feet from the top of the ditch
banks.
