After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3371, which can be downloaded from our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. PROJECT SUMMARY: This project involves the replacement of an existing boat ramp and improvements to the adjacent ramp dockage, as well as the addition of 5 finger piers and associated mooring pilings to increase the existing dockage from 10 slips to 18 slips. r Martin's Point Homeowners Association, Dare County FIELD INVESTIGATION REPORT Page 2 PROJECT SETTING The Martin's Point Homeowners Association (MPHA) currently holds title to an approximate 3.4- acre site at the end of Martin's Point Road between lots 24 and 25, in the Subdivision of Martin's Point. This site provides existing mooring and watercraft launching marina services for the Martin's Point Subdivision. Martin's Point Subdivision is located between the Currituck Sound and Jean Guite Creek in Dare County, north ofNC 158 and the Wright Memorial Bridge. The marina site is situated along Jean Guite Creek (also commonly reference to and spelt as `Ginguite Creek'). This site is located approximately 600 feet south of the confluence of Jean Guite Creek and the Currituck Sound. The parcel is developed with a 200 ft long by 6 ft wide pier structure that includes a 32 ft by 6 ft "T" platform finger at the end ofthe pier and five 9 ft by 4 ft finger piers and associated mooring piles that create 10 existing boat slips. The site also includes a 20 ft wide boat ramp that extends 21 ft into Jean Guite Creek. This ramp has almost a 7 to 1 slope and is often difficult to discharge or retrieve boats without getting the vehicle stuck or resulting in tire slippage on the ramp. The existing ramp facility also includes a 30 ft by 6 ft courtesy launching pier along the north side of the ramp. The site is bordered by property to the south owned by Park Johns and by property to the north owned by Cliff Goodwin. USGS topographic field maps that have been annotated with historical and/or archaeological site information for this vicinity indicate that a site of historical and/or archaeological significance is located near the marina site. The MPHA site is directly along the shoreline of Jean Guite Creek and has an elevation of approximately 4 ft above the NWL. The site includes approximately 500 if of natural shoreline. The shoreline of the project site, as well as the adjacent properties are stabilized with wooden bulkhead. The site is vegetated in lawn and indigenous grasses, upland woody, hardwood and pine species, as well as some ornamental trees and shrubs. The site includes an area for parking and other community amenities (i.e., barbeque, playground equipment, etc.). Some coastal wetland vegetation (Juncus roemerianus) is present to the south of the MPHA property, waterward of the existing bulkhead alignment. Jean Guite Creek is a coastal creek that meanders north from Kitty Hawk Bay to its confluence with the Currituck Sound. The waters of Jean Guite Creek are classified by the North Carolina Marine Fisheries and Wildlife Resources Commissions as Inland Waters. These waters are also considered to be an Inland Primary Nursery Area for anadromous finfish and are considered a valuable coastal resource. To the north, the waters of the Currituck Sound are classified by the North Carolina Marine Fisheries and Wildlife Resources Commissions as Joint Waters. The North Carolina Environmental Management Commission has designated the waters of both Jean Guite Creek and the Currituck Sound as `SC' (suitable for fish propagation) waters. These waters are closed to the commercial harvest of shellfish. During the site investigation visits to this site, no shellfish were observed in the vicinity of this project. Some small finfish were observed along the shoreline and some SAV's were observed offshore. The waters of the Jean Guite Creek and the Currituck Sound are somewhat more `fresh' than the near-by portions of the Albemarle and Croatan Sounds. However, finfish and crustacean coastal resources (flounder and blue crab) are typically caught by recreational fishermen in these waters. Martin's Point Homeowners Association, Dare County FIELD INVESTIGATION REPORT Page 3 The Currituck Sound and Jean Guite Creek are shallower in depth than these adjacent sounds. Except for navigation channel areas, the average water depths, generally, do not exceed 4 or 5 ft in depth and water depths, even several hundred feet offshore in the Currituck Sound, are only 1 to 3 ft in depth. The water depths in the vicinity of the proposed additional slips are between 4 and 5 ft below the NWL. The Coastal Resources Commission (CRC) has also designated these waters as a Public Trust Area of Environmental Concern (AEC). In addition, under the designation of the CRC, a Public Truest Shoreline AEC extends in a contour of 30 ft landward of the NWL. PROJECT DESCRIPTION The permittee proposes to construct 5 additional 3 ft wide by 12 ft long finger piers and place sufficient number of mooring pilings to create a total of 18 boat slips. The overall structure length and overall mooring field will remain unchanged. The applicant also wishes to make improvements to the existing boat ramp facility that is located adjacent to the existing marina pier. These improvements include the removal and replacement of the existing 20 ft wide by 21 ft long concrete boat ramp with a 15 ft wide by 26 ft long concrete ramp to accommodate longer boat trailers. The proposed ramp will be constricted in place and will require the temporary installation of a cofferdam to de-water the ramp area. This portion of the applicant's proposal will include, along the south side of the new ramp, the placement of an additional courtesy launching pier with a 6 ft by 6 ft platform to assist boat launching during different wide conditions. The pier (dock) will extend 30 ft beyond the NWL and will include the above referenced platform along the south side of the new pier directly adjacent to the bulkhead. ANTICIPATED IMPACTS The proposed additional finger piers and boat ramp courtesy dock will result in a 396 sf increase in shading of the Public Trust Area of Jean Guite Creels. The proposed courtesy dock and finger piers will not result in the shading or disturbance of any vegetated wetlands. The proposed finger piers and mooring piles will not interfere with any adjacent riparian access or public trust uses. The proposed courtesy dock platform will be approximately 30 ft from the neighbor's riparian alignment and should not present any access interference. This project is consistent with those projects described in 7H Use Standard riles as `water dependent'. The proposed total available mooring area will not exceed that square footage allowed under the '27 sf rule. Martin's Point Homeowners Association, Dare County FIELD INVESTIGATION REPORT Page 4 The proposed boat ramp replacement will extend approximately 5 ft beyond the existing ramp location and will result in the disturbance and excavation of an additional 75 sf of public trust area bottom beyond the dimension of the existing ramp. This ramp replacement will result in the removal of approximately 16 cy of sand and old ramp material from below or near the NWL and the placement of slightly less than 20 cy of sand, rock and concrete ramp material below or near the NWL. This ramp replacement will not impact any significant submerged aquatic vegetation and will provide a safer and an "easier to use" boat launching facility than the existing ramp. The increase in the number of vessels to be moored in this area will carry with it the increased impact on the water from the effects of leaching bottom paint components. In that these waters are designated as a PNA, direct and bioaccumulation effects are a consideration. The construction of the proposed structures will result in temporary elevated water column turbidity to the public trust waters and their recognized nursery area functions. However, these impacts can be minimized and should still allow the existing shall water habitat to afford its recognized uses during and after the proposed construction if appropriate protective measures and construction timing are incorporated into the subsequent permit decision. This project does not propose any upland site constriction or land disturbance such as parking, boardwalk or bath facilities. Increase the number of pier slips from 10 to 18. The proposed project involves the construction of 5 finger piers on the existing pier, the installation of 12 mooring poles and the relocation of one existing mooring pole. 2. Removal and replacement of the existing boat ramp which is 20' wide and 21' long. The proposed new ramp is 15' wide and 26' long. The additional length is to accomodate larger trailer boats. The proposed new boat ramp will be constructed in place and will require the installation of a coffer dam to de-water the area. 3. Construction of a launching pier to the south of the proposed new boat ramp. The proposed new launching pier will be 30' long and 6' wide (similar to the existing launching pier on the north side of the boat ramp). It will include a 6' x 6' platform along the existing bulkhead to provide access. The proposed new launching pier will facilitate the launching and retrieval of boats under certain wind conditions. This project will be undertaken only if the existing boat ramp is replaced, as described in (2) above.
