County Dear Ms. Clements: This office has reviewed the riparian buffer restoration plan, Project No. 20010061, submitted by the East Group on 25 April 2002 to address the violations of the Center Field Properties, LLC site known as Cedar Ridge. The proposed plan is acceptable as proposed with one condition: • Submit a copy of the written deed restrictions for Lots 1,2,3,4,5,6, and 7 for the protection of the adjacent 50 ft. riparian buffers within 30 days of receipt of this letter and prior to the sale of any of these lots. Areas that were filled within the buffer will be brought back to original grade. The plan proposes the number of trees required meeting the 320 trees per acre requirement. The types of trees and the methodology of planting are also provided. The breakdown of areas disturbed is as follows: Area 1 - 880 LF of Buffer x 30' Wide = 26,400 sf = 0.60 acres @ 320 trees/acre = 192 trees Area 2 - 30 LF of Buffer x 30' = 900 sf = 0.02 acres @ 320 trees/acre = 7 trees Area 3 - 0.12 acres @ 320 trees/acre = 39 trees The trees in the disturbed areas will be planted beginning mid September 2002, which should increase the chance of tree survival. 2. All drainage ditches/swales within the buffer area will be pulled back and allowed to sheet flow through the buffer. The ditch cut during installation of the utilities will be filled in and no longer used for drainage. The existing pipe along the east E N G I N E E R I N G side of NCSR 1700 will be shortened so that it discharges outside of the riparian - buffer. The drainage pipe between lots 6 and 7 will be shortened (from original ARCHITECTURE design) as indicated on the restoration plan. All other drainage pipes will be - installed as originally designed with release outside of the riparian buffer. SURVEYING TECHNOLOGY Since 1975, servicing clients worldwide 3. The project property was purchased by Center Field Properties from Cartrette Construction. The original permit issued to Cartrette Construction was for 7.7 acres of land disturbance within the subdivision. Since the property was sold, revised Erosion and Sedimentation Control Plan and revised construction drawings have been submitted to the Land Quality Section of NC DENR for the entire development. This plan was sent with a letter from the previous owner transferring the original permit for the project to Center Field Properties, LLC, along with a revised Financial Responsibility/Ownership Form and additional fee required. 4. The areas disturbed within the buffers will be reestablished as required by planting trees and seeding. Once established Zone 1 of the buffer will be allowed to return to its natural state. Land disturbing activities within the buffer will cease once areas filled have been repaired to their original grade. Also, temporary erosion control measures will be installed as designed to decrease the amount of sediment leaving the site through drainage ditches. Included with this letter are three copies of the Restoration Plan. The plan indicates the Seeding Schedule to be used along with the Schedule for Implementation of the Restoration Plan. Your response should addvw the following items: Neuse Riparian buffer restoreAion plan -11 is also required that a planting plan be developed such that, at least two native tree species be planted at a density sufficient to provide 320 trees per acre at maturity. This density can be achieved by planting approximately 436 (10x10 feet spacing) to 681(8x8 feet spacing) trees per acre. Your plan must include the types of native woody vegetation selected, methodology of planting, and site map indicating the location of the plantings. Also, you should provide a detailed schedule with dates of when these activities will be accomplished. You must also achieve sheet flow of stormwater out-side of the 50 foot buffer zone. Please detail in your response how this will he accomplished. You should clearly discuss your efforts to both secure and come into full compliance with the General Stormwatcr Permit (NCG010000). You should also detail the events that resulted in your non-compliance with the above mentioned requirement to secure a permit (this discussion should include full compliance with Erosion and Sedimentation Plan). You should also explain how you propose to prevent these problems from reoccurring in future projmts and horn' you plan to abate alt of the above mentioned impacts. Robert Tankard and Mr. Tom Steffens of the Washington Regional Office and Mr. Danny Smith of the Central Office of the Division of Water Quality (DWQ) conducted a site visit of the subject tract. The inspection and file review found the following violations: Neuse Riparian Buffer zone violations in the northern unnamed tributary and Long Branch, and Discharging without a NCGO 10000 permit (General NPDES Stormwater Pcrmit). On April 4, 2002, Mr. Tankard and Mr. Bob Zarzecki of the Central Office of the Division of Water Quality conducted a follow-up investigation. Mr. Tankard and Mr. Zarzecki met with Mr. Eddie Lewis and with yourself to discuss the issues of two other streams that showed up on the Pitt County Soils map. The inspection, file review Lind staff discussion found the following violations: Ncuse Riparian Buffer zone violations of the middle urmamed tributary that was located on your project site. On April 18, 2002, Mr. Robert Tankard and Ms, Deborah Sawyer, Division of Water Quality, conducted a final inveMigation. it was detemliued that more fill and disturbance had occurred in zone 1 of the most northern unnamed tributary.
