Approval of 401 Water Quality and Additional Conditions DWQ Project # 020805 Carteret County You have our approval, in accordance with the attached conditions (WQC # 3351) to conduct the following activity at your property located at 205 Atlantic Beach Causeway, Atlantic Beach, Carteret County. This approval allows you to: 1). construct an extension of the existing bulkhead; 2). remove the boat ramp and and backfill with sand; 3). construct a seven slip docking facility. This approval is only valid for the purpose and design that you described in your CAMA application dated February 2, 2002 received by the Division of Water Quality (DWQ). After reviewing your application, we have determined that this activity is covered by General Water Quality Certification Number 3351. This Certification allows you to use your CAMA Permit when it is issued by the NC Division of Coastal Management. Please keep in mind that there may be additional Federal, State or Local regulations applicable to your project, such as (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations and Coastal Stormwater. In addition, this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the General Certification. If you change or modify your project, you must notify the Division (DWQ) in writing and you may be required to send us a new applcation for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional condition listed below: 1). Turbidity controls must be maintained throughout construction, so that turbidity does not exceed 25 NTUs outside the project area; 2). The attached Certificate of Completion (COC) must be submitted to the Division upon final construction of the site. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 276 1 1-7447. PROJECT SUMMARY: The applicant proposes to construct a seven slip docking facility and eliminate an old boat ramp behind his existing realty company in Atlantic Beach off the Causeway. FIELD INVESTIGATION REPORT: THOMPSON / CARTERET COUNTY PAGE #2 9. NARRATIVE DESCRIPTION: Project Setting The applicant owns property at 205 Atlantic Beach Causeway just north of the intersection of Highway 58 (East Fort Macon Rd.) and the Atlantic Beach Causeway in Atlantic Beach, Carteret County. The property in question is adjacent to a man-altered bay/canal, which is ultimately tributary to Bogue Sound. The applicant's property is 127' deep and 102' wide on the waterfront or approximately one third of an acre. The tract's approximate elevation is 3' above mean high water. Currently the land is occupied by the Sound and Sea Real Estate Company which occupies a 1,230 ft2 building as well as a 128 ft2 storage building. There is an existing bulkhead running the length of the property to an existing boat ramp on the north side of the tract. There are no piers, tie poles or other structures waterward of the bulkhead. East of the real estate office are 9 existing parking spaces along with the current boat ramp approach running from the bulkhead uphill or east across the property. The area surrounding the office is maintained with lawn grass where not currently paved. The applicant has had three previous permit actions: (1) In 1978 a bulkhead and pier were permitted under a major permit (2) In 1985 a major permit was issued for upland fill and (3) In 1993 a bulkhead was permitted under a general permit. As stated above the bulkhead remains intact but there no longer are any piers behind the real estate office. Sound and Sea Realty is adjacent to a man-altered bay on the west side of Atlantic Beach Causeway. This bay/canal system is ultimately tributary to Bogue Sound and both waterbodies are classified as SA HQW by the Division of Water Quality. The waters are closed to shellfish harvesting and are not recognized as a nursery area. The water depth in the project area is approximately 4' at the bulkhead and 7' at the proposed end of the finger piers at mean high water with a tidal amplitude around 3'. The substrate in the project area is primarily sand. Project Description The applicant is proposing to close off the existing boatramp with a new section of bulkhead and then build a new seven slip docking facility. The docking facility will provide rental spaces for interested parties. A new vinyl bulkhead will match the existing bulkhead on the south side of the property and run 32' north to the neighboring bulkhead. The new alignment will close off the existing ramp and run approximately 18" waterward of the existing bulkhead on the north side of the property. The bulkhead will be filled with dried dredge material from the canal system, which primarily consists of course sand. As stated earlier the boatramp will be filled with the same substrate as the bulkhead and revegetated 15' landward of the new bulkhead to match the existing lawn. The remainder of the concrete approach will remain and be utilized as additional parking spaces. The docking facility will consist of four finger piers running perpendicular to the bulkhead with mooring pilings creating seven new slips. The finger piers are 2.5' wide and will run 34' waterward of the bulkhead and will be flanked by four sets of pilings set 15' apart. The docking structure will be complete with the proposed boardwalk partly FIELD INVESTIGATION REPORT: THOMPSON / CARTERET COUNTY PAGE #3 canterlevered over the bulkhead. The boardwalk will run the width of the property (102') with 5.5' over the highground and 2' over the edge of the bulkhead. The 7.5' wide boardwalk structure will serve as the loading and unloading area for the rental docks. Waivers are required and have been secured since the boardwalk and docking facility runs property line to property line. The seven proposed slips are proposed in line with the adjacent piers and will not extend beyond the established pier head alignment along this shoreline. Finally, there are no facilities (restroom, trash receptacles, gas pumps, etc.) proposed for the property. Anticipated Impacts The finger piers and mooring pilings will usurp 3,264 ft2 of public trust area while the shore parallel boardwalk will shade 765 ft2 of highground. The finger piers, mooring pilings, and the portion of the boardwalk over water will shade 524 ft2 of.public trust bottom. Short- term turbidity would be expected through the installation of the new pilings yet long-term turbidity would not be expected from the boat traffic due to adequate water depths and a sandy substrate in the proposed facility location. Impact on navigation of the canal and to the boating public should be negligible. Brad E.
